THE MINING ACT 1926

NOTICE is hereby given that Ormond Lester McKellar, of Alexandra, farmer, has applied to the Warden of the Otago Mining District for a dry race commencing in the Crown water race on Dunstan Flat, 4 chains south of the Aerodrome Road, running thence westerly a distance of 3½ chains under the Dunstan Road and Government railway and terminating on Lot 19 subdivision of Sections 2 and 4, Block VII, Leaning Rock.

The application will be heard at the Warden’s Court, Cromwell, on Wednesday, 24 August 1960, at 10 a.m., and objections must be filed in the Registrar’s office and notified to the applicant at least three days before the time appointed for hearing.

CHARITABLE TRUSTS ACT 1957

In the matter of the Charitable Trusts Act 1957 and in the matter of the estate of William Colenso, late of Napier, in the Provincial District of Hawke’s Bay and Dominion of New Zealand, Clerk in Holy Orders, now deceased.

PURSUANT to section 36 of the above Act, the Mayor, Councillors, and Citizens of the City of Napier (hereinafter referred to as “the Corporation”) hereby give notice that it has prepared and filed in the office of the Supreme Court at Napier a scheme under section 34 of the said Act providing for:

(a) Variation of the disposition under the will of the said deceased of the income on the sum of £500 bequeathed to the Corporation by the deceased, whereby the deceased provided for such income to be used as a fund for assisting poor distressed seamen and strangers in want.

(b) Variation of the disposition under the will of the said deceased of the income on the sum of £500 bequeathed to the Corporation by the deceased, whereby the deceased provided for such income to be used as a fund for purchasing prizes to be distributed to the successful scholars at the Public Government schools at Napier, as varied by an order of the Supreme Court at Napier, dated the 10th day of July 1944, to provide free library subscriptions for scholars at the public Government schools of Napier who were in each year promoted to Standard IV.

and will make application for the approval of the said scheme to the Supreme Court at Napier, on Friday the 19th day of August 1960 at 10 a.m. The said scheme and the report of the Attorney-General thereon is open for inspection by the public, without charge, at the Supreme Court at Napier during office hours. Any person desiring to oppose the said scheme shall give written notice of his intention to do so to the Registrar of the Supreme Court at Napier, to the Corporation, and to the Attorney-General on or before the 11th day of August 1960.

NOTICE OF RESULT OF POLL ON LOAN PROPOSAL

PURSUANT to section 38 of the Local Authorities Loans Act 1956, notice is hereby given that a poll of the ratepayers of the Kapiti Riding of the County of Hutt taken on the 9th day of July 1960 on the proposal of the above-named local authority to raise a loan of £28,000, to be known as the Paraparaumu Beach Pavilion Loan 1959, £28,000, for the purpose of providing a community pavilion and ancillary works at Paraparaumu Beach resulted as follows:

The number of votes recorded for the proposal was 73
The number of votes recorded against the proposal was 170
The number of informal votes was 2

I therefore declare that the proposal was rejected.
