THE UPPER HUTT BOROUGH COUNCIL

NOTICE OF INTENTION TO TAKE LAND

In the matter of the Municipal Corporations Act 1954 and
in the matter of the Public Works Act 1928.
Notice is hereby given that the Mayor, Councillors, and
Citizens of the Borough of Upper Hutt require to take the
land described in the Schedule hereto in connection with a
public work, namely service lane. Notice is hereby further
given that a plan of the said land is open for inspection by
all persons, without fee, during office hours at the offices of the
Upper Hutt Borough Council, Upper Hutt.
All persons affected are hereby required to set forth in
writing any well grounded objections to the execution of such
work or to the taking of such land and to send such writing
within forty (40) days from the first publication of this notice
to the Town Clerk, Upper Hutt Borough Council, Upper Hutt.

SCHEDULE
ALL those pieces of land situated in the Borough of Upper
Hutt, being parts of Section 128 of the Hutt District
containing:
First, decimal two two (00·22) perches, being the part Lot
1, D.P. 17133, coloured blue on S.O. Plan 24213, and being
part of the land comprised in and described by certificate of
title, Volume 641, folio 76 (Wellington Registry);
Secondly, one decimal eight seven (1·87) perches, being
Lot 2, D.P. 17133; coloured sepia on S.O. Plan 24213, and
being all of the land comprised in and described by certificate
of title, Volume 655, folio 49 (Wellington Registry);
Thirdly, two decimal four one (2·41) perches, being the
part Lot 1, D.P. 15242, coloured orange on S.O. Plan 24213,
and being part of the land comprised in and described by
certificate of title, Volume 352, folio 52 (Wellington Registry);
Fourthly, one decimal nought five (1·05) perches, being
the part Lot 9, D.P. 1831, coloured blue on S.O. Plan 24213,
and being part of the land comprised in and described by
certificate of title, Volume 194, folio 271 (Wellington Registry);
Fifthly, one decimal nought five (1·05) perches, being the
part Lot 10, D.P. 1831, coloured orange on S.O. Plan 24213,
and being part of the land comprised in and described by
certificate of title, Volume 203, folio 33 (Wellington Registry);
Sixthly, one decimal nought five (1·05) perches being the
part Lot 11, D.P. 1831, coloured blue on S.O. Plan 24213, and
being part of the land comprised in and described by certificate
of title, Volume 231, folio 178 (Wellington Registry);
Seventhly, one decimal six eight (1·68) perches, being
the part Lot 12, D.P. 1831, coloured orange on S.O. Plan
24213, and being part of the land comprised in and described
by certificate of title, Volume 161, folio 96 (Wellington
Registry); and
Eighthly, three decimal two nine (3·29) perches being the
part Lot 13, D.P. 1831, coloured sepia on S.O. Plan 24213,
and being part of the land comprised in and described by
certificate of title, Volume 203, folio 34 (Wellington Registry).

In the matter of the Charitable Trusts Act 1957 and in the
matter of a certain trust created by the will of John
Smith, late of Levin, retired farmer, deceased.
NOTICE is hereby given, pursuant to section 36 of the Charitable
Trusts Act 1957, of application to the Supreme Court at Wellington
for approval of a scheme of Adrian Herbert Lawrance Treadwell
and Joseph Patrick Smith, the trustees of the will
of the above-named John Smith, deceased, for administration
of a charitable bequest under the above-mentioned will.
The said trustees have prepared a scheme for the disposition
of moneys held by them in a fund known as the “Chapel Fund”,
which by the above-mentioned will they were directed
to apply “towards the erection of the Roman Catholic
Memorial Chapel at Foxton intended to be erected to the
memory of the late Chaplain Captain Dore, formerly Parish
Priest of Foxton aforesaid”, and which they are unable to so
apply as there is now no fund constituted for the erection of
such a memorial chapel.

Particulars of the Said Scheme

The trustees shall stand possessed of personal property
comprising the trust known as the “Chapel Fund”, together
with interest which has accrued and will accrue thereon, upon
trust to pay the costs of and incidental to the preparation
of the scheme and to hold the balance for the Roman Catholic
Archibishop of Wellington to be applied in or towards erecting
or repairing a church or churches in the parish known as St.
Mary’s Parish, Foxton, which embraces in its district the Town
of Shannon.

The said scheme and the Attorney-General’s report thereon
have been filed in and may be inspected at the said Court.
The date proposed for the hearing of the application to
approve the said scheme is the 29th day of July 1960.
Any person desiring to oppose the said scheme is required
to give written notice of his intention to do so to the Registrar
of the Supreme Court at Wellington, and to the said trustees
whose address for service is at the offices of Messrs Treadwells,
Solicitors, 4 Panama Street, Wellington, and to the Attorney-
General, not less than seven clear days before the said date
proposed for the hearing of the application.

NOTICE OF PRIVATE BILL

In the matter of the Standing Orders of the House of
Representatives relating to Private Bills and in the matter
of a Private Bill to amend the Church of England Trusts
Act 1913.
NOTICE is hereby given that it is the intention of the under-
signed to present a petition to the House of Representatives,
in Parliament assembled, for leave to bring in a Bill under
the Short Title of “The Church of England Trusts Amend-
ment Act 1960” during the ensuing session of Parliament to
commence on the 22nd day of June 1960.
The objects of the Bill are:
(1) To confer upon incorporated Diocesan Boards of Trustees
the same powers of selling, exchanging, mortgaging, and
leasing lands conveyed directly to them by donors or vendors
as they have under sections 8 and 9 of the Church of England
Trusts Act 1913, and its amendments (namely the Church of
England Trusts Amendment Act 1937 and the Church of England
Trusts Amendment Act 1945) in respect of lands originally
conveyed to other trustees and later transferred to incorporated
Diocesan Boards of Trustees.
(2) To confer upon the Standing Committee of the Diocese
of Wellington power to appoint trustees of the Wellington
Diocesan Maori Endowment Trust Board when the Synod
of the Diocese of Wellington is not in session.
The promoters of the Bill are Herbert Edgar Evans,
of Wellington, barrister, Edward Westwood Henderson, of
Auckland, barrister, Wybrants Olphert, of Wellington,
barrister, and Stuart Tichborne Campbell Sprott, of Wellington,
diocesan secretary, being the members of a commission set
up by the Standing Committee of the Church of the Province
of New Zealand, commonly called the Church of England,
with power to promote a Bill having the objects above set
forth.
The address to which communications or notices to the
promoters may be sent and at which a copy of the Bill may
be inspected is the Diocesan Office, 20 Mulgrave Street, in
the City of Wellington.
