Taking Land for Public Purposes in Niue Island

ORDER IN COUNCIL
At the Government Buildings at Wellington this 17th day of November 1959
Present:
THE HON. C. F. SKINNER, M.C., PRESIDING IN COUNCIL
PURSUANT to section 357 of the Cook Islands Act 1915, His Excellency the Governor-General, acting by and with the advice and consent of the Executive Council, hereby takes the land described in the Schedule hereto for the following public purpose, namely, education.
SCHEDULE
ALL those pieces of land situated in the District of Alofi in the Island of Niue, Cook Islands, containing together 1 rood 2·7 perches, more or less, being the whole of the land known as Paliati Section 17 and Paliati Section 18, Alofi District, and being all the land comprised in an order of the Native Land Court at Niue made on the 7th day of November 1941 on investigation of title; as the same is more particularly delineated on the plan signed by the Resident Commissioner of Niue and deposited in the office of the Registrar, Native Land Court at Niue, under No. 12.

Vesting Reclaimed Land in Lake Rotorua in the Corporation of the Borough of Rotorua

PURSUANT to the Rotorua Borough Reclamation Empowering Act 1931, His Excellency the Governor-General, acting by and with the advice and consent of the Executive Council, hereby vests the land described in the Schedule hereto in the Mayor, Councillors, and Citizens of the Borough of Rotorua, in trust, for recreation purposes.

SOUTH AUCKLAND LAND DISTRICT
SECTION 2, Block LXXIII, Town of Rotorua, and Section 7, Block V, Town of Rotorua. Formerly Crown land reclaimed from Lake Rotorua, situated in Block I, Tarawera Survey District: Area, 5 acres and 26 perches, more or less, as shown on plan marked M.D. 10679 and deposited in the office of the Marine Department at Wellington, and thereon edged red.

The Western Side of Portion of Whangae Road in the Kawakawa Town District Exempted from the Provisions of Section 128 of the Public Works Act 1928

THE RIGHT HON. W. NASH, C.H., PRESIDING IN COUNCIL
PURSUANT to section 128 of the Public Works Act 1928, His Excellency the Governor-General, acting by and with the advice and consent of the Executive Council, hereby approves of the resolution passed by the Kawakawa Town Council on the 6th day of October 1959 and set out in the First Schedule hereto, in so far as it affects the side and portion of the street described in the Second Schedule hereto.
FIRST SCHEDULE
NORTH AUCKLAND LAND DISTRICT
THE Kawakawa Town Council, being the local authority having control of the streets in the Town District of Kawakawa, by resolution declares that the provisions of Section 128 of the Public Works Act 1928 shall not apply to the western side of the portion of Whangae Road adjoining part Te Wharau Block, being the land in certificates of title, Volume 523, folio 229, and Volume 523, folio 223, Auckland Land Registry.
SECOND SCHEDULE
NORTH AUCKLAND LAND DISTRICT
THE western side of all that portion of street known as Whangae Road in the Kawakawa Town District fronting part Te Wharau Block; as the same is more particularly delineated on the plan marked P.W.D. 160496 deposited in the office of the Minister of Works at Wellington, and thereon coloured red.

Authorising the Laying Off of a Street Off Tampin Road in the Borough of Manurewa, Subject to a Condition as to the Building Line

THE RIGHT HON. W. NASH, C.H., PRESIDING IN COUNCIL
PURSUANT to section 186 of the Municipal Corporations Act 1954 and section 125 of the Public Works Act 1928, His Excellency the Governor-General, acting by and with the advice and consent of the Executive Council, hereby authorises the Manurewa Borough Council to permit the laying off of the proposed street described in the Schedule hereto at a width for part of its length of less than 66 ft but not less than 40 ft, subject to the condition that no building or part of a building shall at any time be erected on the subdivision of the land shown edged green on the plan marked P.W.D. 160508 referred to in the said Schedule within a distance of 15 ft from the side line of the said street.

THAT proposed street in the Borough of Manurewa, containing by admeasurement 1 rood 20·1 perches, more or less, being part Lots 1 and 2, D.P. 38351, parts Lot 4, D.P. 14114, part Lot 1, D.P. 32349, and part Lot 2, D.P. 12984, all being part Clendons Grant.
As the same is more particularly delineated on the plan marked P.W.D. 160508 deposited in the office of the Minister of Works at Wellington, and thereon coloured red.

PURSUANT to section 186 of the Municipal Corporations Act 1954 and section 125 of the Public Works Act 1928, His Excellency the Governor-General, acting by and with the advice and consent of the Executive Council, hereby authorises the Manurewa Borough Council to permit the laying off of the proposed street described in the Schedule hereto at a width for part of its length of less than 66 ft but not less than 40 ft, subject to the condition that no building or part of a building shall at any time be erected on Lots 1 to 8 and 14 to 19 of a subdivision of the land shown edged green on the plan marked P.W.D. 160509 referred to in the Schedule hereto, within a distance of 45 ft from the centre line of the said street or on Lot 20 of the said subdivision within a distance of 35 ft from the centre line of the said street.

THAT proposed street in the Borough of Manurewa, containing by admeasurement 2 roods 10·2 perches, more or less, being part Lot 7, D.R.O. Plan 355, and being part Allotment 8, Parish of Papakura.
As the same is more particularly delineated on the plan marked P.W.D. 160509 deposited in the office of the Minister of Works at Wellington, and thereon coloured red.
