At the Government House at Wellington this 7th day of October 1959

Present:

HIS EXCELLENCY THE GOVERNOR-GENERAL IN COUNCIL

PURSUANT to section 63 of the Maori Purposes Act 1931, His Excellency the Governor-General, acting by and with the advice and consent of the Executive Council, hereby revokes the Order in Council referred to in Part I of the Schedule hereto in so far as it affects the land mentioned in Part II of the said Schedule.

PURSUANT to the Local Authorities Loans Act 1956, His Excellency the Governor-General, acting by and with the advice and consent of the Executive Council, hereby consents to the borrowing by the local authorities mentioned in the Schedule hereto by way of loan of the whole or any part of the respective amounts specified in that Schedule.

PURSUANT to the Soil Conservation and Rivers Control Act 1941, His Excellency the Governor-General, acting by and with the advice and consent of the Executive Council, hereby amends the Order in Council dated the 22nd day of March 1944 and published in Gazette, 23 March 1944, Volume I, page 275, declaring the number of members and apportioning representation on the Wairarapa Catchment Board by deleting the Schedule thereto, as amended by Order in Council dated the 5th day of April 1944, and published in Gazette, 5 April 1944, Volume I, page 341, and substituting the following Schedule.

Boundaries of County of Maniototo and Borough of Naseby Altered

HIS EXCELLENCY THE GOVERNOR-GENERAL IN COUNCIL

PURSUANT to the Local Government Commission Act 1953, His Excellency the Governor-General, acting by and with the advice and consent of the Executive Council, hereby makes the following order.

ORDER

  1. On and from the 1st day of April 1960, the area described in the First Schedule hereto is hereby excluded from the County of Maniototo and included in the Borough of Naseby.

  2. On and from the date aforesaid the area described in the Second Schedule hereto is hereby excluded from the Borough of Naseby and included in the County of Maniototo.

  3. The alteration of the boundaries of the said county and the said borough hereinbefore made shall be deemed to have been effected under the Municipal Corporations Act 1954.

FIRST SCHEDULE

AREA EXCLUDED FROM COUNTY OF MANIOTOTO AND INCLUDED IN BOROUGH OF NASEBY

ALL that area in the Otago Land District and in the Mount Ida Riding of Maniototo County containing 81 acres, more or less, bounded by a line commencing at the south-eastern corner of Section 72, Block I, Naseby Survey District, and proceeding westerly, northerly, and easterly along the southern, western, and northern boundaries of that Section 72 and north-easterly across a road to the westernmost corner of Section 105, Block I, Naseby Survey District; thence generally easterly along the northern boundary of that Section 105 to and along the northern boundary of a closed street (formerly Neagh Street) and its production across Leven Street to the south-western bank of the Hogburn; thence generally south-easterly along the south-western bank of the Hogburn to the middle of the stream draining the Naseby Reservoir; thence generally south-westerly down the middle of that stream which flows approximately along the line of the old western bank of the Hogburn to the southern side of the road forming the southern boundary of the Town of Naseby; thence westerly along the southern side of that road, the southern boundary of Section 103, Block I, Naseby Survey District, and again the southern side of that road to a point in line with the eastern side of Hollywood Street; thence northerly to and along that side to the northern side of Eask Street; thence north-westerly across Hollywood Street to and along the north-eastern side of the road being the continuation of Eask Street to the corner distant 843·3 links, more or less, from Hollywood Street; thence northerly along a right line to the point of commencement excluding all of the Borough of Naseby as described in Gazette, 1882, page 131, lying within the above-described area.

SECOND SCHEDULE

AREA EXCLUDED FROM BOROUGH OF NASEBY AND INCLUDED IN COUNTY OF MANIOTOTO

ALL that area in the Naseby Borough being part of the bed of the Hogburn Sludge Channel containing 4 acres, more or less, situated to the east of Block VIII, Town of Naseby, and bounded by a line commencing at the south-eastern corner of the Borough of Naseby and proceeding westerly along the borough boundary to the middle of the stream flowing from the Naseby Reservoir; thence north-easterly up the middle of that stream to the eastern boundary of the Borough of Naseby between Avoca and Oughter Streets; thence southerly along that boundary to the point of commencement.
