Present:

HIS EXCELLENCY THE GOVERNOR-GENERAL IN COUNCIL

PURSUANT to section 63 of the Maori Purposes Act 1931, His Excellency the Governor-General, acting by and with the advice and consent of the Executive Council, hereby revokes the Order in Council referred to in Part I of the Schedule hereto in so far as it affects the land mentioned in Part II of the said Schedule.

ORDER in Council, under section 32 of the Maori Land Amendment and Maori Land Claims Adjustment Act 1928, made on 5 December 1929, and published in the Gazette, 12 December 1929, page 3230.

Boundaries of County of Manukau and Borough of Howick Altered

HIS EXCELLENCY THE GOVERNOR-GENERAL IN COUNCIL

PURSUANT to the Local Government Commission Act 1953; His Excellency the Governor-General, acting by and with the advice and consent of the Executive Council, hereby makes the following order.

ORDER

  1. On and from the 1st day of October 1959, the areas described in the Schedule hereto are hereby excluded from the County of Manukau and included in the Borough of Howick.

  2. The alteration of boundaries of the said county and the said borough hereinbefore made shall be deemed to have been effected under the Municipal Corporations Act 1954.

SCHEDULE

AREAS EXCLUDED FROM COUNTY OF MANUKAU AND INCLUDED IN BOROUGH OF HOWICK

ALL that area in the North Auckland Land District containing 375 acres, more or less, bounded by a line commencing at the easternmost corner of Lot 2, D.P. 40828, in Block III, Otahuhu Survey District, on the southern boundary of the Borough of Howick and proceeding south-westerly along the north-western side of the Howick-Manurewa Main Highway to and north-westerly along the north-eastern boundaries of part Allotment 10, Parish of Pakuranga, on Deeds Plan 179, another part Allotment 10 and Allotment 6, Parish of Pakuranga, to the northernmost corner of the last-mentioned allotment; thence along a line bearing 279° 03′ 30″ crossing Botany Road for a distance of 353·78 links; thence northerly generally along a series of right lines parallel to and 250 links distant from the western side of Botany Road aforesaid to the intersection of the most northern of those lines with a right line parallel to and 275 links distant south-easterly from the south-eastern side of Bradburys Road; thence south-westerly along a right line parallel to and 275 links distant from the last-mentioned roadside to and along the south-eastern boundaries of Lots 1, 2, 3, 4, 5, 6, and 7, D.P. 34192, along a right line across part Lot 1, D.P. 1841, to and along the south-eastern boundaries of Lots 8, 9, and 10, D.P. 34192, along a right line across Lot 1, D.P. 31709, to and along the south-eastern boundaries of Lots 1, 2, and 3, D.P. 40867, a right line to and along the south-eastern boundaries of Lots 5, 6, 7, and 8, a right line to and along the south-eastern boundary of Lot 10, the eastern boundaries of Lots 12, 13, 14, and 15, the south-eastern boundaries of Lots 16, 17, 18, and 19, a right line to and along the south-eastern boundaries of Lots 21, 22, 23, and 24, a right line to and along the south-eastern boundaries of Lots 26, 27, 28, and 29, all the aforesaid lots being on D.P. 40867, to the southernmost corner of the last-mentioned lot; thence westerly along the southern boundary of Lot 29 aforesaid to its westernmost corner and along a line bearing 301° 21′ crossing Bradburys Road for a distance of 350 links; thence northerly generally along a series of right lines parallel
to and 250 links distant from the western side of the said Bradburys Road to the intersection of the most northern of those right lines with the production south-westerly of the north-western boundary of Lot 39, D.P. 41886; thence along that production and the said north-western boundary and a right line to and along the north-western boundaries of Lots 38, 37, 36, 35, 34, 33, 32, 31, 30, 29, and 28, a right line to and along the north-western boundaries of Lots 27, 26, 25, 24, 23, 22, 21, 20, 19, 18, 17, 16, 15, 14, 13, and 12, a right line to and along the north-western boundaries of Lots 11, 10, and 9, the south-western and north-western boundary of Lot 6 and the north-western boundary of Lot 5, all the aforesaid lots being on D.P. 41886, to and westerly along the northern boundary of part Lot 12, D.P. 11021, to and along the eastern boundary of Lot 4, D.P. 11021, to and again westerly along the southern side of the Ellerslie-Howick Main Highway to a point in line with the western boundary of the land on S.O. 32987 (Pakuranga Domain, Gazette, 1947, page 1726) being part Allotment 13, Section 1, Small Farms near Howick; thence along a right line across that highway to and along the aforesaid western boundary and down the middle of the stream forming the north-eastern boundary of part Allotment 13, D.P. 15620, and along the south-eastern boundary of Allotment 37, Section 1, Small Farms near Howick, along a right line across Cherry Road to and along the south-eastern boundary of Allotment 38 and south-easterly along the south-western boundary of Allotment S.W. 35, both allotments being of Section 1, Small Farms near Howick, to and north-easterly along the north-western side of Hutchinsons Road to the southernmost corner of Allotment 57, Section 1 aforesaid; thence south-easterly along the production of the south-western boundary of that allotment across Hutchinsons Road to and again north-easterly along its south-eastern side and the south-eastern side of Gills Road to the northernmost corner of Lot 1, D.P. 45095; thence along a right line across Bleakhouse Road to and along the southern boundary of Lot 36, D.P. 42335, and the generally southern boundaries of part Lot 1, D.P. 23143, to the boundary of the Borough of Howick; thence southerly and easterly generally along that borough boundary as described in Gazette, 1952, page 1363, to the point of commencement.

Also all that area in the North Auckland Land District containing 56 acres, more or less, bounded by a line commencing at the south-eastern corner of Lot 83, D.P. 36704, in Block IV, Otahuhu Survey District, on the generally southern boundary of the Borough of Howick and proceeding south-westerly generally along the north-western boundary of Lots 13, 7, and 10, D.P. 17330, to and north-westerly along the north-eastern side of Sandspit Road to the boundary of the Borough of Howick; thence northerly and easterly generally along the aforesaid borough boundary as described in Gazette, 1952, page 1363, to the point of commencement.

PURSUANT to the Local Government Commission Act 1953, His Excellency the Governor-General, acting by and with the advice and consent of the Executive Council, hereby makes the following order.

ORDER

  1. On and from the 1st day of October 1959, the area described in the Schedule hereto is hereby excluded from the County of Waikohu and included in the County of Cook.

  2. The alteration of the boundaries of the said counties hereinbefore made shall be deemed to have been effected under the Counties Act 1956.

AREA EXCLUDED FROM COUNTY OF WAIKOHU AND INCLUDED IN COUNTY OF COOK

ALL that area in the Gisborne Land District, County of Waikohu, containing 2,814 acres, more or less, bounded by a line commencing at a point being the northernmost corner of Lot 1, D.P. 2175, situated in Block II, Waimata Survey District, being also a point on the boundary of the Cook County as described in Gazette of 22 March 1956, page 410, and proceeding in an easterly direction generally along the said Cook County boundary to the westernmost corner of Waihora 2B 1B, in Block III, Waimata Survey District; thence north-westerly generally along the south-western boundaries of Waihora 2B 1A, 2C 1A, the south-eastern and
