PART I—CONSTITUTION OF MOUTERE HILLS RURAL FIRE DISTRICT

  1. The area specified in the First Schedule to this order is hereby constituted and declared to be a rural fire district to be known as the Moutere Hills Rural Fire District.

  2. The trees and other plants on lands described in the Second Schedule to this order are hereby specified as the property for the protection of which the district is constituted.

  3. The period between the 1st day of September in any one year and the 30th day of April in the following year (both days inclusive) is hereby declared to be a closed fire season in the district.

  4. The Moutere Hills Rural Fire District shall, for the purposes of the Forest and Rural Fires Act 1955, be administered by a rural fire committee, which shall be known as the Moutere Hills Rural Fire Committee.

PART II—REGULATIONS

  1. The Rural Fire Committee Regulations 1949 shall, so far as they are applicable and with the necessary modifications, apply to the Moutere Hills Rural Fire Committee constituted by these regulations; and these regulations shall be deemed to be special regulations for the purpose of those regulations.

MEMBERS

  1. The Committee shall consist of seven members as follows:

(a) Four persons shall be appointed by H. Baigent and Sons Ltd. by writing signed on behalf of that company by one director and the secretary thereof. In the event of any member of the Committee appointed as aforesaid ceasing to hold office the said company shall be entitled to fill up the vacancy, subject, nevertheless, to the Rural Fire Committee Regulations 1949;

(b) One person shall be appointed by Tasman Forests Ltd. by writing signed on behalf of that company by one director and the secretary thereof. In the event of the member of the Committee appointed as aforesaid ceasing to hold office the said company shall be entitled to fill up the vacancy, subject, nevertheless, to the Rural Fire Committee Regulations 1949;

(c) One person (herein referred to as the remaining forest owners representative) shall be appointed either by a resolution passed by a majority of those present at a meeting of owners (other than H. Baigent and Sons Ltd., and Tasman Forests Ltd.) of forests with a minimum area of 10 acres situated within the district, or by a majority vote by ballot of those present at such a meeting, as those so present by resolution determine;

(d) One person (herein referred to as the farmers representative) shall be appointed by the Moutere Branch of the Federated Farmers of New Zealand Incorporated by writing signed on behalf of that society by the president and secretary thereof. In the event of the member of the Committee appointed as aforesaid ceasing to hold office the said society shall be entitled to fill up the vacancy, subject, nevertheless, to the Rural Fire Committee Regulations 1949.

FIRST SCHEDULE

NELSON LAND DISTRICT—NELSON CONSERVANCY

Moutere Hills Rural Fire District

ALL those areas in Waimea County, containing approximately 76,600 acres and described generally as follows:

All that area containing approximately 9,600 acres, situated in Blocks VI, VII, X, XI, XIV, and XV, Motueka Survey District, and bounded generally as follows: Towards the east generally by part Lot 2 of Section 34 on D.P. 529, and Sections 35 and 36, Rural District of Motueka, Block VII aforesaid; towards the north by the northern side of Edwards Road; towards the east generally by the eastern side of Central Road, the northern side of Holdaway Road, by the north-eastern side of a public road, and Sections 40, 41, 54, and 53, District of Moutere, Block XI aforesaid; towards the south-east by the south-eastern side of Wills Road, Section 17, Block XI aforesaid, and Sections 152, 139, and 138, District of Moutere, Block XV aforesaid; towards the south generally by Section 76 of Square 3, Block XV aforesaid, and the southern side of Rosedale Road; towards the west generally by Section 82 of Square 3, Block XV aforesaid, Sections 4 and 124, Block XIV aforesaid, by Sections 47, 45, and part Sections 44, 43, and 42 of Square 3, Block X aforesaid; generally towards the south-east by the southern side of a public road, part of Sections 42 and 43 of Square 3, Block X aforesaid on D.P. 2483, Section 4, Block X aforesaid, Section 14 of Square 3, Block X aforesaid, and the south-eastern side of a public road; towards the west generally by Section 63 of Square 3, Block X aforesaid, Lot 1 on D.P. 699, and Section 65 of Square 3, Block X aforesaid; towards the north-west generally by Lots 4 and 3, on D.P. 2257, part of Section 58 and Section 135 of Square 3, Block VI aforesaid, by the north-western side of a public road, by Sections 12, 1, and 16, Block VI aforesaid, and Sections 24 and 13, Block VII aforesaid; and towards the north generally by Lot 2 of Section 33, District of Motueka, and a public road.

Also all that area containing approximately 3,800 acres, situated in Blocks XIII and XIV, Motueka Survey District, and Block II, Wai-iti Survey District, and bounded generally as follows:

Towards the north generally by Section 33 of Square 7, and Section 9 of Square 3, Block XIV, Motueka Survey District, Lot 2 on D.P. 869, and by a right line from the south-eastern corner of that section to the north-western corner of Lot 1 on D.P. 66; towards the north-east by Lots 1, 2, 3, and 4 of D.P. 66, and Sections 9 and 14, Block XIV, Motueka Survey District; towards the south-east by Sections 13 and 17, Block XIV, Motueka Survey District, Sections 109, 109A, and part Section 108 of Square 2, Block II, Wai-iti Survey District; towards the south generally by the right bank of the Dove River, Sections 22, 21, 20, and 19 on D.P. 60, the northern side of a public road, Lot 3 on D.P. 2786, and Sections 18 and 25, Block XIII, Motueka Survey District; towards the south-west by Sections 1 and 14, Block XIII aforesaid; towards the north-west by Sections 8 and 7, Block XIII aforesaid, and by the north-western side of a public road.
