Declaring Land Acquired for a Government Work and Not Required for That Purpose to be Crown Land

PURSUANT to section 35 of the Public Works Act 1928, the Minister of Works hereby declares the land described in the Schedule hereto to be deemed to have been Crown land subject to the Land Act 1948 as from the 3rd day of October 1957.

SCHEDULE

ALL that piece of land in the Canterbury Land District containing 4·1 perches, situated in Block IX, Christchurch Survey District, being Lot 2, D.P. 19641, being part Reserve 320. Part certificate of title, Volume 629, folio 77, Canterbury Land Registry.

Agreement for Grant of Easement in Favour of Sydney Underwood, of Coal Creek, Fruitgrower, Over a Portion of Road in Block II, Teviot Survey District, Assented To

WHEREAS Sydney Underwood, formerly of Dunedin, gas operator, and now of Coal Creek, fruitgrower, is the owner of water race licence No. 1511R for one-quarter head of water for irrigation and domestic purposes subject to certain conditions endorsed on water licence No. 7332 of which water race licence No. 1511R is a renewal:

And whereas by an agreement dated the 19th day of February 1953, the said Sydney Underwood agreed to assign to Her Majesty the Queen all his right title and interest in the said water race licence No. 1511R:

And whereas the Minister of Works has agreed to grant to the said Sydney Underwood an easement to convey water under the portion of road described in the Schedule hereto in satisfaction of compensation aforesaid:

And whereas the said Sydney Underwood has agreed to accept such grant of easement in satisfaction of the said compensation:

Now, therefore, the Minister of Works hereby gives notice, pursuant to section 97 of the Public Works Act 1928, that he assents to the agreement hereinbefore referred to.

SCHEDULE

ALL that portion of road in the Otago Land District situated in Block II, Teviot Survey District, Otago R.D., adjoining the northern boundary of Section 160; as the same is more particularly delineated on the plan marked P.W.D. 154351 (S.O. 12046) deposited in the office of the Minister of Works at Wellington.

Agreement for Grant of Easement in Favour of the South Otago Freezing Co. Ltd., a Duly Incorporated Company Having its Registered Office at Finegand, Over Road in Block XXII, Clutha Survey District, Assented To

WHEREAS by an agreement dated the 3rd day of March 1955, the South Otago Freezing Co. Ltd., a duly incorporated company having its registered office at Finegand, agreed to set over and transfer to Her Majesty the Queen an easement to convey water reserved by memorandum of transfer No. 128489 (Otago Land Registry) over land comprised in a plan deposited in the Land Registry Office at Dunedin as No. 5305:

And whereas the said South Otago Freezing Co. Ltd. is entitled to receive compensation for the transfer of the said easement:

And whereas the Minister of Works has agreed to grant to the said South Otago Freezing Co. Ltd. an easement to use and maintain the existing water pipeline in and under portion of road comprised and described in Proclamation No. 6137 in full satisfaction of the compensation aforesaid:

And whereas the said South Otago Freezing Co. Ltd. has agreed to accept such grant of easement in full satisfaction of the said compensation:

Now, therefore, the Minister of Works hereby gives notice, pursuant to section 97 of the Public Works Act 1928, that he assents to the agreement hereinbefore referred to.

Notice of Intention to Take Land for Road, and for the Use, Convenience, and Enjoyment of a Road, in Blocks III and VII, Mata Survey District, being Land Required for the Approaches to the New Kopuaroa Bridge

NOTICE is hereby given that it is proposed, under the provisions of the Public Works Act 1928, to execute a certain public work, to wit, the construction of a road and for the purposes of such public work the land described in the First Schedule hereto is required to be taken for road and the land described in the Second Schedule hereto is required to be taken for the use, convenience and enjoyment of a road; and notice is hereby given that the plan of the land so required to be taken is deposited in the post office at Ruatoria and is there open for inspection, and that all persons affected by the execution of the said public work or by the said taking of the said lands should, if they have any well grounded objections to the execution of the said public work or to the taking of such lands, set forth the same in writing, and send such writing within forty days from the first publication of this notice, to the Minister of Works at Wellington.

Town and Country Planning Act 1953—Newmarket Borough: Notice of Extension of Period of Effectiveness of Refusals and Prohibitions

PURSUANT to subsection (6) of section 38 of the Town and Country Planning Act 1953, notice is hereby given that the period of effectiveness of each refusal or prohibition made by the Newmarket Borough Council in the interests of the Newmarket Borough district scheme, which refusal or prohibition but for this notice would expire between the date of public notification hereof and the 1st day of February 1959 inclusive, is hereby extended to the said 1st day of February 1959.
