Exemption of Positions from Provisions of the Public Service Act 1912

ORDER IN COUNCIL
At the Government House at Wellington this 29th day of October 1958
Present:
HIS EXCELLENCY THE GOVERNOR-GENERAL IN COUNCIL
PURSUANT to section 4 of the Public Service Act 1912 and to subsection (1) of section 2 of the Public Service Amendment Act 1927, His Excellency the Governor-General, acting by and with the advice and consent of the Executive Council, hereby makes the following declaration and order:

Nothing in the Public Service Act 1912 shall apply to the officer or officers described in the Schedule hereto.

The declaration made on the 31st day of March 1913, pursuant to section 4 of the Public Service Act 1912 and published in the 1913 Gazette at page 1011, is hereby amended by omitting from the Schedule thereto the words: “The Private Secretary to the Prime Minister”.
SCHEDULE
ANY person for the time being holding the office of Principal Private Secretary or Joint Principal Private Secretary to the Prime Minister.

PURSUANT to section 104 of the Rating Act 1925, His Excellency the Governor-General, acting by and with the advice and consent of the Executive Council, hereby exempts the Maori freehold land described in the Schedule hereto from payment of all rates made or levied by any local authority.

Revocation of Order in Council Setting Apart Maori Freehold Land as a Maori Reservation

PURSUANT to section 439 (5) of the Maori Affairs Act 1953, His Excellency the Governor-General, acting by and with the advice and consent of the Executive Council, hereby revokes the Order in Council made on the 22nd day of February 1955 and published in the Gazette on the 3rd day of March 1955, at page 327, and affecting the Maori freehold land described in the Schedule hereto.

Setting Apart Maori Freehold Land as a Maori Reservation

HIS EXCELLENCY THE GOVERNOR-GENERAL IN COUNCIL
PURSUANT to section 439 of the Maori Affairs Act 1953, His Excellency the Governor-General, acting by and with the advice and consent of the Executive Council, hereby sets apart the Maori freehold lands described in the Schedule hereto as a Maori reservation for the purposes of a meeting place and a place of historical interest for the common use and benefit of the Ngati Tautahi hapu.

HIS EXCELLENCY THE GOVERNOR-GENERAL IN COUNCIL
PURSUANT to section 128 of the Public Works Act 1928, His Excellency the Governor-General, acting by and with the advice and consent of the Executive Council, hereby approves of the resolution passed by the Wellington City Council on the 14th day of August 1958 and set out in the First Schedule hereto, in so far as it affects the side and portion of street described in the Second Schedule hereto, subject to the condition that no building or part of a building shall at any time be erected on the land described in the said Second Schedule within a distance of 25 feet from the centre line of the said portion of the said street.
FIRST SCHEDULE
THE Wellington City Council, being the local authority having control of the streets in Wellington City, by resolution declares that the provisions of section 128 of the Public Works Act 1928, shall not apply to the western side of the portion of Fernhill Terrace adjoining Lot 28, D.P. 422, being all (or part) of the land in certificate of title, Volume 420, folio 13, Wellington Registry, as is more particularly shown on the plan annexed hereto.
SECOND SCHEDULE
THE western side of all that portion of street situated in the Wellington Land District, City of Wellington, known as Fernhill Terrace, fronting Lot 28, D.P. 422, being part Section 1, Harbour District, Township of Wadestown; as the same is more particularly delineated on the plan marked P.W.D. 156757 deposited in the office of the Minister of Works at Wellington, and thereon coloured red.

PURSUANT to section 11 of the Housing Act 1955, His Excellency the Governor-General, acting by and with the advice and consent of the Executive Council, hereby orders and declares that the access way described in the Schedule hereto shall, on and after the date of this Order in Council, vest in the Mayor, Councillors, and Citizens of the Borough of Masterton, and be under the control and management of the Masterton Borough Council.
SCHEDULE
ALL that piece of land in the Wellington Land District containing 7·56 perches, situated in the Borough of Masterton, being Lot 77, D.P. 20072, being part Section 43, Manaia Block. Parts certificates of title, Volume 316, folio 62, and Volume 346, folio 98, Wellington Land Registry.
