AUTHORISING Edward Percy Harold Burbury, of Glen Wye, Culverden, Farmer, to Use Water for the Purpose of Generating Electricity

At the Government House at Wellington this 13th day of August 1958 Present:
HIS EXCELLENCY THE GOVERNOR-GENERAL IN COUNCIL
PURSUANT to the Public Works Act 1928, His Excellency the Governor-General, acting by and with the advice and consent of the Executive Council, hereby grants to Edward Percy Harold Burbury, of Glen Wye, Culverden, farmer (hereinafter referred to as the licensee), a licence, subject to the conditions hereinafter set forth, to take and use from an unnamed stream (hereinafter referred to as the said stream), situated in Section 5, Block VIII, Skiddaw Survey District, in the County of Amuri, for the purpose hereinafter set forth, a stream of water not exceeding 21 cu. ft. per second at any one time.

CONDITIONS

IMPLIED CONDITIONS

  1. The conditions directed to be implied in all licences by the Water Power Regulations 1934 and the Electrical Supply Regulations 1935 shall be incorporated in and shall form part of this licence, except in so far as the same may be inconsistent with the provisions hereof.
    LICENCE SUBJECT TO REGULATIONS
  2. This licence is issued under the Water Power Regulations 1934, and is subject thereto, and to the Electrical Supply Regulations 1935, the Electrical Wiring Regulations 1935, the Radio Interference Regulations 1934, and to all regulations hereafter made in amendment thereof or in substitution therefor respectively.
    UTILISATION OF WATER AND LOCATION OF HEADWORKS
  3. Water shall be used under this licence solely for the purpose of generating electricity and shall be taken from the said stream at the point in Section 5, Block VIII, Skiddaw Survey District, indicated on the plan marked P.W.D. 83378 deposited in the office of the State Hydro-electric Department at Wellington.
    GENERAL DESCRIPTION OF WORKS
  4. The licensee is hereby authorised, subject to the conditions hereof, to construct, maintain, and use the following works for the purpose of this licence, the positions of the said works being indicated on the said plan P.W.D. 83378.
    (a) Headworks consisting of an intake with water race and pipelines leading to the powerhouse hereinafter referred to, giving a static head of approximately 10ft.
    (b) Water wheel and powerhouse with all necessary equipment for generating electricity situated in Section 5, Block VIII, Skiddaw Survey District.
    (c) Tail race leading from the said water wheel back to the said stream.
    SYSTEM OF SUPPLY
  5. The system of supply shall be a direct-current system as described in paragraph (d) of regulation 21-01 of the Electrical Supply Regulations 1935.
    DURATION OF LICENCE
  6. Unless sooner lawfully determined, this licence shall continue in force until the 31st day of March 1979.
    RENTAL
  7. For the purposes of assessing the rental or annual sum payable in respect of this licence, the maximum generating capacity of the plant at the commencement of this licence is 1 kilowatt.
    NO RIGHT TO WATER CONFERRED
  8. Nothing in this licence shall of itself confer upon the licensee any right to water.

    Declaring Hunter's Road in the Takuta Farm Settlement in Raglan County to be County Road

    At the Government House at Wellington this 13th day of August 1958 Present:
    HIS EXCELLENCY THE GOVERNOR-GENERAL IN COUNCIL
    PURSUANT to section 112 of the Public Works Act 1928, His Excellency the Governor-General, acting by and with the advice and consent of the Executive Council, hereby orders and declares that the portion of road described in the Schedule hereto shall, on and after the date of this Order in Council become county road.
    SCHEDULE
    ALL that portion of road in the South Auckland Land District, situated in Block V, Maramarua Survey District, Raglan County, commencing at the southernmost corner of Allotment 215, Onewhero Parish, and proceeding thence in a northerly direction generally for a distance of approximately 35 chains and terminating at the north-eastern corner of Allotment 215, Onewhero Parish.
    As the same is more particularly delineated on the plan marked P.W.D. 156774 (S.O. 38198) deposited in the office of the Minister of Works at Wellington, and thereon coloured red and marked A-B.

    Declaring Road in Block XIV, Ohura Survey District, to be Government Road

    HIS EXCELLENCY THE GOVERNOR-GENERAL IN COUNCIL
    PURSUANT to section 112 of the Public Works Act 1928, His Excellency the Governor-General, acting by and with the advice and consent of the Executive Council, hereby orders and declares that the portion of road described in the Schedule hereto shall, on and after the date of this Order in Council become Government road.
    SCHEDULE
    ALL that piece of road in the Taranaki Land District containing 12'3 perches, situated in Block XIV, Ohura Survey District, Taranaki R.D., adjoining or passing through Section 37; as the same is more particularly delineated on the plan marked P.W.D. 156733 (S.O. 8857) deposited in the office of the Minister of Works at Wellington, and thereon coloured green.

    Varying a Condition as to Setting Back the Building Line of Portion of a Street Known as Imlay Crescent in the City of Wellington, Imposed by Order in Council Under Section 117 of the Public Works Act 1905

    At the Government House at Wellington this 13th day of August 1958 Present:
    HIS EXCELLENCY THE GOVERNOR-GENERAL IN COUNCIL
    PURSUANT to section 131 of the Public Works Act 1928, His Excellency the Governor-General, acting by and with the advice and consent of the Executive Council, hereby amends the Order in Council dated the 18th day of May 1908, published in Gazette, 28 May 1908, Vol. 1, page 1516, and deposited in the Land Registry Office at Wellington as No. 398, exempting the street known as Imlay Crescent in the City of Wellington from the provisions of section 117 of the Public Works Act 1905, subject to a condition as to the building line, by varying the condition with regard to the building line imposed by the said Order in Council so that no building or part of a building shall at any time be erected on Lot 1, D.P. 2611, within a distance of 23 ft 6 in from the centre line of the said street.

    Authorising the Construction of the Wanganui Metropolitan Motorway

    ORDER IN COUNCIL
    At the Government House at Wellington this 13th day of August 1958 Present:
    HIS EXCELLENCY THE GOVERNOR-GENERAL IN COUNCIL
    PURSUANT to the Public Works Act 1928, and section 3 of the Public Works Amendment Act 1947, His Excellency the Governor-General, at the request of the National Roads Board, and acting by and with the advice and consent of the Executive Council, hereby authorises the construction of a motorway commencing near the junction of the Wanganui-Levin State Highway and Nepia Road in the County Town of Putiki and proceeding thence through the said County Town, the City of Wanganui, and the County of Waitotara and terminating at Westmere near the junction of the Hawera-Wanganui State Highway with the Rapanui Main Highway.
