The Eastern Side of Portion of Peter Street in the City of Dunedin Exempted from the Provisions of Section 128 of the Public Works Act 1928, Subject to a Condition as to the Building Line

At the Government Buildings at Wellington this 17th day of April 1958
Present:
THE RIGHT HON. W. NASH PRESIDING IN COUNCIL
PURSUANT to section 128 of the Public Works Act 1928, His Excellency the Governor-General, acting by and with the advice and consent of the Executive Council, hereby approves of the following resolution passed by the Dunedin City Council on the 3rd day of February 1958, and set out in the First Schedule hereto, in so far as it affects the side and portion of the street described in the Second Schedule hereto, subject to the condition that no building or part of a building shall at any time be erected on the land described in the Second Schedule hereto within a distance of 27 ft. from the centre line of the said street.
FIRST SCHEDULE
THE Dunedin City Council, being the local authority having control of the streets in the City of Dunedin, by resolution declares that the provisions of section 128 of the Public Works Act 1928 shall not apply to the eastern side of the portion of Peter Street adjoining Lots 20, 21 and 22, Block II, Deeds Plan 93, being part Section 20, Block VI, Town District, being all the land in certificate of title, Volume 264, folio 28, Otago Land Registry.
SECOND SCHEDULE
THE eastern side of all that portion of street in the Otago Land District, City of Dunedin, known as Peter Street, fronting Lots 20, 21, and 22, Deeds Plan 93, being part Section 20, Block VI, Town District. As the same is more particularly delineated on the plan marked P.W.D. 155741 deposited in the office of the Minister of Works at Wellington, and thereon bordered red.

PURSUANT to section 128 of the Public Works Act 1928, His Excellency the Governor-General, acting by and with the advice and consent of the Executive Council, hereby approves of the following resolution passed by the Dunedin City Council on the 24th day of February 1958, and set out in the First Schedule hereto, in so far as it affects the side of the street described in the Second Schedule hereto, subject to the condition that no building or part of a building shall at any time be erected on the land described in the Second Schedule hereto within a distance of 22 ft. 11 in. from the centre line of the said street.
FIRST SCHEDULE
THE Dunedin City Council, being the local authority having control of the streets in the City of Dunedin, by resolution declares that the provisions of section 128 of the Public Works Act 1928 shall not apply to the south-western side of Kyber Pass adjoining subdivision of Section 54 and part Section 53, Block XIX, Town of Dunedin, being all the land comprised and described in certificate of title, Volume 148, folio 122, Otago Registry.
SECOND SCHEDULE
THE south-western side of all that street situated in the Otago Land District, City of Dunedin, known as Kyber Pass, fronting Section 54 and part Section 53, Block XIX, Town of Dunedin. As the same is more particularly delineated on the plan marked P.W.D. 155742 deposited in the office of the Minister of Works at Wellington, and thereon bordered red.

PURSUANT to section 16 of the New Zealand Army Act 1950, His Excellency the Governor-General has been pleased to approve of the following appointments, promotions, transfers, resignations, and retirements of officers of the New Zealand Army:
HEADQUARTERS, 3RD INFANTRY BRIGADE
Captain Bernard William Roberts, M.M., E.D., relinquishes the appointment of B.R.A.S.C.O., and is transferred to the Reserve of Officers, General List, Royal N.Z. Army Service Corps, in the rank of Captain. Dated 27 February 1958.
ROYAL N.Z. ARTILLERY
Regular Force
Captain Henry Peter Thomas Willis, E.D., is transferred to the Reserve of Officers, General List, Royal N.Z. Artillery, in the rank of Captain. Dated 10 April 1958.
Territorial Force
With reference to the notice published in the Gazette, Volume III of 1949, page 2741, relating to Major J. F. G. Stark, E.D., delete the words “in the rank of Major, with seniority from 26 February 1935”; substitute “in the rank of Lieutenant-Colonel”.
