GISBORNE CITY COUNCIL

NOTICE OF INTENTION TO TAKE LAND

In the matter of the Municipal Corporations Act 1954 and the Public Works Act 1928, and their respective amendments.

NOTICE is hereby given that the Gisborne City Council proposes to execute a certain public work, namely, construction of a street, and for the purposes of such public work the land described in the Schedule is required to be taken, and notice is hereby further given that a plan of the land so required to be taken is deposited in the office of the Town Clerk to the said Council, Council Chambers, Fitzherbert Street, Gisborne, and is open for inspection, without fee, by all persons during ordinary office hours.

All persons affected by the execution of the said public work or by the taking of such land who have any well grounded objections to the execution of the said public work, or to the taking of the said land, must state their objections in writing and send the same within forty days from the first publication of this notice to the Town Clerk at the Council Chambers, Fitzherbert Street, Gisborne.

SCHEDULE

APPROXIMATE area of land required to be taken: 2 roods.

Description of land: Lot 7, Block 1, D.P. 1424, part Whataupoko 3 Block.

DECLARATION

IN conformity with the above Act, I, Ernest Bissett, General Manager of The Guardian Trust and Executors Co. of New Zealand Ltd., do solemnly and sincerely declare:

  1. That the liability of the members is limited. The capital of the company is £100,000 fully paid, divided into 20,000 shares of £5 each.

The assets of the company in its corporate capacity on the 31st day of December last were £188,794.

The liabilities of the company in its corporate capacity on that day were £7,349.

The first annual licence was issued on the 10th day of March 1911.

  1. That, in the capacity of trustees and executors, the amount of moneys received on account of estates up to the 31st day of December last was £80,213,682.

The amount of moneys paid on account of estates up to that day was £79,939,848.

The amount of balances held in trust accounts at various banks on account of estates under administration on that day was £273,834.

  1. And I make this solemn declaration conscientiously believing the same to be true and by virtue of the provisions of an Act of the General Assembly of New Zealand intituled the Justices of the Peace Act 1927.

MASTERTON TROTTING CLUB (INC.).

RESOLUTION

THE following regulations were laid before the members of the Masterton Trotting Club (Inc.) at a meeting held on the 9th day of September 1957 at Masterton with a recommendation by the chairman of such club, Mr A. N. Ayshford, that the same be passed at once with a view to their approval by His Excellency the Governor-General in pursuance of the Gaming Act 1908, section 33.

Mr A. N. Ayshford, the chairman of such club and the meeting moved, and Mr I. J. Gilliland seconded, and it was resolved that such regulations should be adopted and that the chairman and secretary be authorised to sign the same in authentication thereof.

The following are the regulations referred to:

MASTERTON TROTTING CLUB (INC.)

REGULATIONS

(Under the Gaming Act 1908)

IN pursuance and exercise of the powers in that behalf contained in section 33 of the Gaming Act 1908 and of all other powers and authorities it enabling in that behalf, the Masterton Trotting Club, a racing club within the meaning of the said Act (hereinafter referred to as “the said club”), doth hereby make the following regulations controlling the admission of persons to that part of the Masterton Racing Club (Inc.) situated in the district of Wairarapa and known as the Opaki Racecourse while the said racecourse is used or occupied by the said club for race meetings.

  1. These regulations shall come into force on the date of the same being published in the Gazette.

  2. In these regulations the words “bookmaker,” “racing club,” and “race meeting” shall have the meanings ascribed to those terms respectively by section 2 of the Gaming Act 1908.

  3. The following persons shall be and are hereby excluded from the racecourse above described while the same is used or occupied by the said club for a race meeting, namely:

(a) Bookmakers.

(b) Bookmakers’ clerks, bookmakers’ assistants, and bookmakers’ agents.

(c) All persons under disqualification inflicted by any racing or trotting club in the Dominion of New Zealand, the Commonwealth of Australia, or elsewhere if affiliated to the New Zealand Racing Conference, or the New Zealand Trotting Conference, or the New Zealand Trotting Association.

(d) Common prostitutes and persons who habitually consort with thieves or persons who have no lawful visible means of support.

(e) Professional tippers, persons convicted of housebreaking or pocket picking, forgery, uttering, or possessing counterfeit coin, theft, false pretenses, receiving stolen goods, mischief, assault, or any offence or crime of any kind under the Crimes Act 1908, and also idle and disorderly persons, rogues, and vagabonds, and incorrigible rogues convicted under the Police Offences Act 1908, and persons convicted of an offence under the Gaming Act 1908. Provided always that the Executive Committee appointed by the New Zealand Racing Conference, upon being satisfied by evidence as to character and otherwise that any persons who, by reason of any conviction, comes within the scope of this regulation, should have relief from the effect thereof, may grant exemption to any such person, and may at any time revoke any such exemption without notice to such person, and without assigning any reason for such revocation.

The foregoing regulations of the Masterton Trotting Club (Inc.) were made and passed by such club on the 9th day of September 1957 and signed by the chairman and secretary.

Under the Regulations Act 1936, statutory regulations of general legislative force are no longer published in the New Zealand Gazette, but are supplied under any one or more of the following arrangements:

(1) All regulations serially as issued (punched for filing), subscription £2 per calendar year in advance.

(2) Annual volume (including index) bound in buckram, 35s. per volume. (Volumes for years 1936–37 and 1939–42 are out of print.)

(3) Separate regulations as issued.

The price of each regulation is printed thereon, facilitating the purchase of extra copies.

Orders should be placed with the Government Printer, Publications Branch, Wellington C.1. Separate copies of regulations may also be purchased from the Printing and Stationery Department, 130 Oxford Terrace, Christchurch, or from the Chief Post Offices at Auckland and Dunedin.
