FIRST SCHEDULE

THE Auckland City Council, being the local authority having control of the streets in the City of Auckland, by resolution declares that the provisions of section 128 of the Public Works Act 1928 shall not apply to that portion of the eastern side of Dundonald Street fronting part Allotment 2 of Section 7, Suburbs of Auckland, and being the land comprised in certificates of title, Volume 466, folio 195, and Volume 479, folio 189; and being more particularly shown coloured red on plan marked A. 2424/2.

SECOND SCHEDULE

THE eastern side of all that portion of street in the North Auckland Land District, City of Auckland, known as Dundonald Street, fronting part Allotment 2 of Section 7, Suburbs of Auckland.

As the same is more particularly delineated on the plan marked P.W.D. 155487 deposited in the office of the Minister of Works at Wellington, and thereon coloured red.

THE HON. C. F. SKINNER, M.C., PRESIDING IN COUNCIL

PURSUANT to section 128 of the Public Works Act 1928, His Excellency the Governor-General, acting by and with the advice and consent of the Executive Council, hereby approves of the resolution passed by the Palmerston North City Council on the 6th day of February 1958 and set out in the First Schedule hereto in so far as it affects the side and portion of street described in the Second Schedule hereto.

FIRST SCHEDULE

THE Palmerston North City Council, being the local authority having control of the streets in the City of Palmerston North, by resolution declares that the provisions of section 128 of the Public Works Act 1928 shall not apply to the south-eastern side of Main Street fronting a subdivision of Section 606, Township of Palmerston North, comprised in certificate of title 7/210.

SECOND SCHEDULE

THE south-eastern side of all that portion of street, situated in the Wellington Land District, City of Palmerston North, known as Main Street, fronting Section 606, Township of Palmerston North; as the same is more particularly delineated on the plan marked P.W.D. 155491 deposited in the office of the Minister of Works at Wellington, and thereon coloured red.

PURSUANT to the Municipal Corporations Act 1954 as amended by section 2 of the Municipal Corporations Amendment Act 1956, His Excellency the Governor-General, acting by and with the advice and consent of the Executive Council, hereby consents to the closing of the portion of the street known as Ferguson Avenue, in the City of Napier, described in the Schedule hereto.

ALL that piece of street in the Hawke’s Bay Land District containing 14·1 perches, adjoining Lots 17 to 21 (inclusive), D.P. 6167, part Napier Town Section 664, Block IV, Heretaunga Survey District, City of Napier, Hawke’s Bay R.D.; as the same is more particularly delineated on the plan marked P.W.D. 155127 (S.O. 3016) deposited in the office of the Minister of Works at Wellington, and thereon coloured green.

PURSUANT to section 6 of the Public Works Amendment Act 1955, His Excellency the Governor-General, acting by and with the advice and consent of the Executive Council, hereby amends the Order in Council dated 5 May 1953 and published in Gazette, 7 May 1953, Volume II, page 709, and deposited in the Land Registry Office at Auckland under No. 13811, authorising the Birkenhead Borough Council to permit the laying off of a street in the Borough of Birkenhead at a width for parts of its length of less than 66 ft., but not less than 50 ft., subject to a condition as to the building line, by cancelling the building line imposed by the said Order in Council in so far as it affects the northern side of Lot 43, D.P. 41159, being the whole of the land comprised and described in certificate of title, Volume 1357, folio 32, Auckland Land Registry.

PURSUANT to section 186 of the Municipal Corporations Act 1954 and section 125 of the Public Works Act 1928, His Excellency the Governor-General, acting by and with the advice and consent of the Executive Council, hereby authorises the Dunedin City Council to lay off the proposed portion of street described in the Schedule hereto at a width for part of its length of less than 66 ft. but not less than 51 ft.

SCHEDULE

THAT portion of proposed street in the Otago Land District, City of Dunedin, containing 1 rood 16·63 perches, being part Oates Street, D.P. 252, being part Section 2, Block IV, Upper Kaikorai Survey District, Otago R.D. (S.O. 12336); as the same is more particularly delineated on the plan marked P.W.D. 152625 deposited in the office of the Minister of Works at Wellington, and thereon coloured yellow.
