Present:
HIS EXCELLENCY THE GOVERNOR-GENERAL IN COUNCIL
PURSUANT to section 11 of the Housing Act 1955, His
Excellency the Governor-General, acting by and with the
advice and consent of the Executive Council, hereby orders and
declares that the access way described in the Schedule hereto
shall, on and after the date of this Order in Council, vest
in the Mayor, Councillors, and Citizens of the City of Auckland
and be under the control and management of the
Auckland City Council.
SCHEDULE
ALL that access way in the North Auckland Land District
containing 8 8 perches, situated in Block IX, Rangitoto
Survey District, City of Auckland, Auckland R.D., and being
Lot 226, D.P. 43378. Part certificate of title, Volume 728,
folio 19, Auckland Land Registry.

HIS EXCELLENCY THE GOVERNOR-GENERAL IN COUNCIL
PURSUANT to section 131 of the Public Works Act 1928, His
Excellency the Governor-General, acting by and with the
advice and consent of the Executive Council, hereby amends
the Order in Council dated the 14th day of January 1952,
published in Gazette, 17 January 1952, Volume I, page 36,
and deposited in the Land Registry Office at Auckland as
No. S. 27728, authorising the laying off of the street described in the Schedule of the said Order in Council subject
to a condition as to the building line, by varying the condition with regard to the building line imposed by the said
Order in Council so that no building or part of a building
shall at any time be erected on Lot 23, D.P. S. 1054, within
a distance of 42 ft. from the centre line of the said street.

THE land described in the Schedule hereto is exempted from
the operations of Part III of the Coal Mines Act 1925.
SCHEDULE
ALL that area of land in the Town of Westport containing
26 perches, more or less, being Lot 2 of Section 124 as
shown in Deposited Plan No. 5264 of the said Town, and
being part of the land in certificate of title, Volume 3, folio
117, Nelson Registry.
As witness the hand of His Excellency the Governor-General this 12th day of February 1958.
