HIS EXCELLENCY THE GOVERNOR-GENERAL IN COUNCIL
PURSUANT to section 131 of the Public Works Act 1928, His Excellency the Governor-General, acting by and with the advice and consent of the Executive Council, hereby amends the Order in Council dated 1 September 1930, and published in Gazette, 4 September 1930, Volume III, page 2705, and registered in the Land Registry Office at Wellington under No. 1570, authorising the laying off of the street, now known as Kauri Street, subject to a condition as to the building line, by cancelling the condition as to the building line imposed by the said Order in Council in so far as it affects Lot 12, D.P. 10017, being part Suburban Section 168, Township of Palmerston North. Balance certificate of title, Volume 497, folio 211, Wellington Land Registry.

Varying a Condition as to Setting Back the Building Line of Portion of Gray (Formerly Alfred) Street, in the Borough of Milton, Imposed by Order in Council Under Section 128 of the Public Works Act 1928

HIS EXCELLENCY THE GOVERNOR-GENERAL IN COUNCIL
PURSUANT to section 131 of the Public Works Act 1928, His Excellency the Governor-General, acting by and with the advice and consent of the Executive Council, hereby amends the Order in Council dated the 3rd day of December 1935, published in Gazette, 5 December 1935, Volume III, page 3594, and deposited in the Land Registry Office at Dunedin as No. 4311, exempting the north-eastern side of portion of Gray (formerly Alfred) Street in the Borough of Milton from the provisions of Section 128 of the Public Works Act 1928, subject to a condition as to the building line, by varying the condition as to the building line so that no building or part of a building shall at any time be erected on Lots 1 and 2, D.P. 4670, being part Section 132, Block XVI, Tokomairiro District, Borough of Milton, being all the land in certificate of title, Volume 276, folio 204, Otago Land Registry, within a distance of 5 ft. from the side line of the said street.

HIS EXCELLENCY THE GOVERNOR-GENERAL IN COUNCIL
PURSUANT to section 11 of the Housing Act 1955, His Excellency the Governor-General, acting by and with the advice and consent of the Executive Council, hereby orders and declares that the access way described in the First Schedule hereto and the service lane described in the Second Schedule hereto shall, on and after the date of this Order in Council, vest in the Mayor, Councillors, and Citizens of the Borough of Kaitaia, and be under the control and management of the Kaitaia Borough Council.
FIRST SCHEDULE
ALL that access way in the North Auckland Land District containing 4·6 perches, situated in Block V, Takahue Survey District, Borough of Kaitaia, Auckland R.D., and being Lot 38, D.P. 42009. Part certificate of title, Volume 1190, folio 96, Auckland Land Registry.
SECOND SCHEDULE
ALL that service lane in the North Auckland Land District containing 22·9 perches, situated in Block V, Takahue Survey District, Borough of Kaitaia, Auckland R.D., and being Lot 33, D.P. 42009. Part certificate of title, Volume 1190, folio 96, Auckland Land Registry.

PURSUANT to section 112 of the Public Works Act 1928, His Excellency the Governor-General, acting by and with the advice and consent of the Executive Council, hereby orders and declares that the portions of road described in the Schedule hereto shall, on and after the date of this Order in Council, become County road.
SCHEDULE
ALL that portion of road in the South Auckland Land District, situated in Blocks VI and X, Whakamaru Survey District, Taupo County, commencing at the northernmost corner of Section 3, Block X aforesaid, and proceeding thence in a south-westerly direction generally for a distance of approximately 150 chains and terminating at the westernmost corner of Section 14, Block X aforesaid.
Also all that portion of road in the South Auckland Land District, situated in Block X, Whakamaru Survey District, Taupo County, commencing at the westernmost corner of Section 28, Block X aforesaid, and proceeding thence in a south-easterly direction generally for a distance of approximately 47 chains and terminating at the southernmost corner of Section 28, Block X aforesaid (S.O. 36204).
As the same are more particularly delineated on the plan marked P.W.D. 155072 deposited in the office of the Minister of Works at Wellington, and thereon coloured red and marked A-B and C-D.
All that portion of road in the South Auckland Land District, situated in Block VI, Whakamaru Survey District, Taupo County, commencing at the northernmost corner of Section 3, Block VI aforesaid, and proceeding thence in a south-westerly direction generally for a distance of approximately 133 chains and terminating at the westernmost corner of Section 11, Block VI aforesaid (S.O. 36206).
As the same is more particularly delineated on the plan marked P.W.D. 155073 deposited in the office of the Minister of Works at Wellington, and thereon coloured red and marked A-B.
All that portion of road in the South Auckland Land District, situated in Blocks X and XIV, Whakamaru Survey District, Taupo County, commencing at the easternmost corner of Section 32, Block X aforesaid, and proceeding thence in a south-easterly direction generally for approximately 92 chains and terminating at a point 795 links north-west of the southernmost corner of Section 35 (S.O. 37288).
As the same is more particularly delineated on the plan marked P.W.D. 155074 deposited in the office of the Minister of Works at Wellington, and thereon coloured red and marked A-B.
All that portion of road in the South Auckland Land District, situated in Block IX, Whakamaru Survey District, Taupo County, commencing at the northernmost corner of Section 18, Block X, Whakamaru Survey District, and proceeding thence in a southerly direction generally for a distance of approximately 198 chains and terminating at the south-western corner of Section 10, Block IX aforesaid.
Also all that portion of road in the South Auckland Land District, situated in Blocks IX and X, Whakamaru Survey District, Taupo County, commencing at the south-western corner of Section 10, Block IX aforesaid, and proceeding thence in a north-easterly direction generally for a distance of approximately 154 chains and terminating at the northern-most corner of Section 21, Block X aforesaid.
Also all that portion of road in the South Auckland Land District, situated in Block X, Whakamaru Survey District, Taupo County, commencing at the westernmost corner of Section 29 of the aforesaid Block X, and proceeding thence in a south-easterly direction generally for a distance of approximately 19·5 chains and terminating at the southern-most corner of the aforesaid Section 29 (S.O. 37290).
As the same are more particularly delineated on the plan marked P.W.D. 155075 deposited in the office of the Minister of Works at Wellington, and thereon coloured red and marked A-B, B-C, and D-E.
