Pursuant to the Public Works Act 1928, His Excellency the
Governor-General, acting by and with the advice and consent
of the Executive Council, hereby consents to the land described
in the Schedule hereto being taken for road.
SCHEDULE
All those pieces of land in the South Auckland Land District,
situated in Block IX, Tauranga Survey District, Auckland
R.D., describe as follows:

Authorising the Laying Off of a Street Off Clifton Road in
the City of Auckland Subject to a Condition as to the
Building Line

HIS EXCELLENCY THE GOVERNOR-GENERAL IN COUNCIL
Pursuant to section 186 of the Municipal Corporations Act
1954 and section 125 of the Public Works Act 1928, His
Excellency the Governor-General, acting by and with the
advice and consent of the Executive Council, hereby authorises
the Auckland City Council to permit the laying off of the
proposed street described in the Schedule hereto at a width
for part of its length of less than 66ft., but not less than
40 ft., subject to the condition that no building or part of a
building shall at any time be erected on a subdivision of the
land shown edged green on the plan marked P.W.D. 154499
referred to in the said Schedule within a distance of 15 ft. from
the side line of the said street.
SCHEDULE
THAT proposed street in the North Auckland Land District,
situated in the City of Auckland, containing by admeasurement 1 rood 15 perches, more or less, being part Lot 5, D.P.
15552, being part Allotments 4 and 6 of Section 8, Suburbs of
Auckland; as the same is more particularly delineated on the

Cancelling a Condition as to Setting Back the Building Line
of a Proposed Street Off Otaki Street, in the Borough of
Kaiapoi, Imposed by Special Order Under Section 186 of
the Municipal Corporations Act 1954

HIS EXCELLENCY THE GOVERNOR-GENERAL IN COUNCIL
Pursuant to section 131 of the Public Works Act 1928, His
Excellency the Governor-General, acting by and with the
advice and consent of the Executive Council, hereby amends
the special order of the Kaiapoi Borough Council registered
in the Land Registry Office at Christchurch under No. 425539,
permitting the laying off of a street off Otaki Street in the
Borough of Kaiapoi, subject to a condition as to the building
line, by cancelling the condition as to the building line im-
posed by the said special order.

Wellington, Exempted From the Provisions of Section 128
of the Public Works Act 1928, Subject to a Condition as to
the Building Line

At the Government House at Wellington this 9th day of

HIS EXCELLENCY THE GOVERNOR-GENERAL IN COUNCIL
Pursuant to section 128 of the Public Works Act 1928, His
Excellency the Governor-General, acting by and with the
advice and consent of the Executive Council, hereby approves
of the resolution passed by the Wellington City Council on
the 17th day of December 1956 and set out in the First
Schedule hereto, in so far as it affects the side and portion of
Street described in the Second Schedule hereto, subject to
the condition that no building or part of a building shall at
any time be erected on the land fronting the southern side of
the portion of Tapiri Street (described in the Second Schedule
hereto) within a distance of 25 ft. from the centre line of the
said portion of street.
FIRST SCHEDULE
THE Wellington City Council, being the local authority having
control of the streets in Wellington City, by resolution declares
that the provisions of section 128 of the Public Works Act
1928, shall not apply to the southern side of the portion of
Tapiri Street, adjoining part Lot 82, D.P. 168, being all (or
part) of the land in certificate of title, Volume 88, folio 203,
Wellington Registry, as is more particularly shown on the
plan annexed hereto, subject to the condition that no building
or part of a building shall at any time be erected on the said
land within a distance of 25 ft. from the centre line of the
said portion of the said street.
SECOND SCHEDULE
THE southern side of all that portion of street situated in the
Wellington Land District, City of Wellington, known as
Tapiri Street, fronting part Lot 82, D.P. 168, being part Section 4, Evans Bay District; as the same is more particularly
delineated on the plan marked P.W.D. 153699 deposited in
the office of the Minister of Works at Wellington, and
thereon coloured red.

Authorising the Egmont National Park Board to Use Water
for the Purpose of Generating Electricity

ORDER IN COUNCIL
At the Government House at Wellington this 9th day of
October 1957
Present:
HIS EXCELLENCY THE GOVERNOR-GENERAL IN COUNCIL
Pursuant to the Public Works Act 1928, His Excellency the
Governor-General, acting by and with the advice and consent
of the Executive Council, hereby grants to the Egmont
National Park Board (hereinafter referred to as the licensee),
a licence, subject to the conditions hereinafter set forth, to take
and use from the Kapuni Stream (hereinafter referred to as
the said stream), situated near Dawson Falls Hostel in the
Egmont National Park, Kaupokonui Survey District, in the
County of Stratford, for the purpose hereinafter set forth, a
stream of water not exceeding three cubic feet per second
at any one time.
CONDITIONS
IMPLIED CONDITIONS
- The conditions directed to be implied in all licences by
the Water Power Regulations 1934 and the Electrical Supply
Regulations 1935 shall be incorporated in and shall form part
of this licence except in so far as the same may be inconsistent with the provisions hereof.
LICENCE SUBJECT TO REGULATIONS
- This licence is issued under the Water Power Regulations
1934, and is subject thereto, and to the Electrical Supply
Regulations 1935, the Electrical Wiring Regulations 1935, the
Radio Interference Regulations 1934, and to all regulations
hereafter made in amendment thereof or in substitution
therefor respectively.
UTILISATION OF WATER AND LOCATION OF HEADWORKS
- Water shall be used under this licence solely for the purpose of generating electricity and shall be taken from the said
stream at a point near Dawson Falls Hostel in the Egmont
National Park, Kaupokonui Survey District.
