Authorising the New Plymouth City Council to Erect and Use Electric Lines Within the City of New Plymouth and Part of the Taranaki County

At the Government House at Wellington this 23rd day of July 1957
Present:
HIS EXCELLENCY THE GOVERNOR-GENERAL IN COUNCIL PURSUANT to the Public Works Act 1928, His Excellency the Governor-General, acting by and with the advice and consent of the Executive Council, hereby authorises the New Plymouth City Council (hereinafter referred to as the licensee), subject to the conditions hereinafter set forth, to lay, construct, put up, place, and use electric lines within the area of supply described in the Schedule hereto.
CONDITIONS
IMPLIED CONDITIONS
- The conditions directed to be implied in all licences by the Electrical Supply Regulations 1935 and the Electrical Wiring Regulations 1935 shall be incorporated in and shall form part of this licence, except in so far as the same may be inconsistent with the provisions hereof.
LICENCE SUBJECT TO REGULATIONS
- The licence hereby conferred is subject to compliance by the licensee with the Electrical Supply Regulations 1935, the Electrical Wiring Regulations 1935, the Radio Interference Regulations 1934, and with all regulations hereafter made in amendment thereof or in substitution therefor respectively.
SYSTEMS OF SUPPLY
- The systems of supply shall be as described in paragraphs (a), (f), and (j) of regulation 21-01 of the Electrical Supply Regulations 1935. The system of supply authorised under paragraph (j) aforesaid shall be a two-wire direct-current system at a normal rated pressure of 550 volts for supply to the licensee's trackless trolley omnibuses.
DURATION OF LICENCE
- This licence shall, unless sooner lawfully determined, continue in force until the 19th day of July 1962.
SCHEDULE
AREA OF SUPPLY
ALL that area in the Taranaki Land District comprising the City of New Plymouth as constituted at the date hereof and portion of the County of Taranaki, the said area being situated in Blocks II, IV, V, IX, and X, Paritutu Survey District; as the said area is more particularly shown outlined in green on the plan marked S.H.D. 426 deposited in the office of the State Hydro-electric Department at Wellington.

Authorising Rui Raymond Key, of Queenstown, Farmer, to Use Water for the Purpose of Generating Electricity

HIS EXCELLENCY THE GOVERNOR-GENERAL IN COUNCIL PURSUANT to the Public Works Act 1928, His Excellency the Governor-General, acting by and with the advice and consent of the Executive Council, hereby grants to Rui Raymond Key, of Queenstown, farmer (hereinafter referred to as the licensee), a licence, subject to the conditions hereinafter set forth, to take and use from Lake Dispute (hereinafter referred to as the said lake), situated in part Block IV, Mid-Wakatipu Survey District, in the County of Lake, for the purpose hereinafter set forth, a stream of water not exceeding 1 cubic foot per second at any one time.
CONDITIONS

- This licence is issued under the Water Power Regulations 1934, and is subject thereto, and to the Electrical Supply Regulations 1935, the Electrical Wiring Regulations 1935, the Radio Interference Regulations 1934, and to all regulations hereafter made in amendment thereof or in substitution therefor respectively.
Utilisation of Water and Location of Headworks
- Water shall be used under this licence solely for the purpose of generating electricity and shall be taken from the said lake at the point in part Block IV, Mid-Wakatipu Survey District, indicated on the plan marked S.H.D. 438 deposited in the office of the State Hydro-electric Department at Wellington.
GENERAL DESCRIPTION OF WORKS
- The licensee is hereby authorised, subject to the conditions hereof, to construct, maintain, and use the following works for the purpose of this licence, the positions of the said works being indicated on the said plan S.H.D. 438.
(a) Headworks consisting of an intake with water race and pipeline leading to the powerhouse hereinafter referred to, giving a static head of approximately 240 ft.
(b) Pelton wheel and powerhouse with all necessary equipment for generating electricity, situated in Section 14, Block IV, Mid-Wakatipu Survey District.
(c) Tail race leading from the said powerhouse to Lake Wakatipu.
SYSTEM OF SUPPLY
- The system of supply shall be an alternating-current system as described in paragraph (d) of regulation 21–01 of the Electrical Supply Regulations 1935.
DURATION OF LICENCE
- Unless sooner lawfully determined, this licence shall continue in force until the 31st day of March 1978.
RENTAL
- For the purpose of assessing the rental or annual sum payable in respect of this licence, the maximum generating capacity of the plant at the commencement of this licence is 8 kilowatts.
NO RIGHT TO WATER CONFERRED
- Nothing in this licence shall of itself confer upon the licensee any right to water.

Taking Land for Public Purposes at Alofi (Niue)

HIS EXCELLENCY THE GOVERNOR-GENERAL IN COUNCIL PURSUANT to section 357 of the Cook Islands Act 1915, His Excellency the Governor-General, acting by and with the advice and consent of the Executive Council, hereby takes the land described in the Schedule hereto for the following public purpose, namely, education.
SCHEDULE
ALL that parcel of land containing 2 acres 1 rood 30 perches, more or less, situated in the district of Alofi in the Island of Niue, Cook Islands, being the whole of the land known as Halamahaga Section 1, Alofi District, and all that parcel of land containing 2 roods 6·4 perches, more or less, situated in the said district, and being the whole of the land known as Halamahaga Section 2, Alofi District, as the same are delineated on the plan signed by the Resident Commissioner of Niue and deposited in the office of the Registrar, Native Land Court, Niue, under No. 7/1/2.

Varying a Condition as to Setting Back the Building Line of Portion of Ann Street in the City of Hamilton, Imposed by Order in Council, Under Section 125 of the Public Works Act 1928 and Section 31 of the Municipal Corporations Amendment Act 1948

HIS EXCELLENCY THE GOVERNOR-GENERAL IN COUNCIL PURSUANT to section 131 of the Public Works Act 1928, His Excellency the Governor-General, acting by and with the advice and consent of the Executive Council, hereby amends the Order in Council dated the 17th day of March 1953, published in Gazette, 19 March 1953, Volume I, page 466, and deposited in the Land Registry Office at Auckland as No. S. 47331, authorising the laying off of the street described in the Schedule of the said Order in Council subject to a condition as to the building line, by varying the condition with regard to the building line imposed by the said Order in Council so that no building or part of a building shall at any time be erected on Lot 17, D.P. S. 1036, within a distance of 36½ ft. from the centre line of the said street.
