Appointing a Commission Under the Auckland Harbour Bridge Act 1950

To all to whom these presents shall come, and to:

Stanley Logan Paterson, Esquire, C.B.E., of Hamilton, Retired Stipendiary Magistrate; and
David Harvey Steen, Esquire, of Auckland, Public Accountant:

Greeting.

WHEREAS by the Auckland Harbour Bridge Act 1950 (hereinafter referred to as “the said Act”) provision was made for the constitution of the Auckland Harbour Bridge Authority (hereinafter referred to as “the Authority”) and for the construction, maintenance, management, and control by the Authority of a bridge across the Waitemata Harbour from Point Erin to Stokes Point:

And whereas by sections 66 and 69 of the said Act provision was made for the appointment of a Commission or Commissions to inquire into and assess any claim for compensation made by any employee of the Devonport Steam Ferry Company Limited (hereinafter referred to as “the company”) in respect of loss of employment caused by the curtailment on account of the opening of the bridge for public traffic of the harbour ferry service carried on by the company:

And whereas by subsection (3) of the said section 69 (as added by section 9 of the Auckland Harbour Bridge Amendment Act 1956) provision was made on application by the Devonport Ferry Company’s Employees’ Industrial Union of Workers with the written approval of the Company and of the Authority, for the appointment of a Commission under the said section 66 to inquire into and determine the matters set forth in paragraphs (a) and (b) of subsection (3) of the said section 69:

And whereas the Devonport Ferry Company’s Employees’ Industrial Union of Workers has made application accordingly and the Company and the Authority have submitted their written approval in support of such application:

And whereas by subsection (2) of section 66 of the said Act provision was made for the appointment of a public accountant to assist such Commission or Commissions:

Now, therefore, I, Lieutenant-General Sir Charles Wiloughby Moke Norrie, the Governor-General of New Zealand, in exercise of the powers conferred on me by the said Act and by the Commissions of Inquiry Act 1908 and of all other powers and authorities enabling me in this behalf, do hereby nominate, constitute, and appoint you, the said Stanley Logan Paterson, to be a Commission to inquire into and report upon the following matters being the matters referred to in paragraphs (a) and (b) of subsection (3) of section 69 of the said Act, namely:

(1) What classes of employees of the Company shall be entitled to receive compensation under paragraph (b) of subsection (1) of section 69 of the said Act;
and
(2) The formula to be adopted in each case when any such compensation is assessed:

And for the better enabling you the said Stanley Logan Paterson to carry these presents into effect you are hereby authorised and empowered to make and conduct any inquiry under these presents at such times and places as you deem expedient with power to adjourn from time to time and place to place as you think fit and so that these presents shall continue in force and the inquiry may at any time and place be resumed although not regularly adjourned from time to time or from place to place:

And I further direct you to consider whether in the circumstances any of the costs of your inquiry should be borne by any individuals and to make provision for citation of parties and to make orders for payment of costs accordingly pursuant to the powers conferred by the Commissions of Inquiry Act 1908:

And using all due diligence you are required to report to me in writing under your hand not later than the 30th day of September 1957 your findings and opinions on the matters hereby referred to you:

And I do also hereby appoint you, the said David Harvey Steen, to assist you, the said Stanley Logan Paterson, as such Commission as aforesaid:

And each of you, the said Stanley Logan Paterson and David Harvey Steen, is hereby strictly charged and directed that neither of you shall at any time publish or otherwise disclose save to me in pursuance of these presents or by my direction the contents of any report so made or to be made by you, the said Stanley Logan Paterson, or any evidence or information obtained by either of you in the exercise of the powers hereby conferred upon you except such evidence or information as is received in the course of a sitting open to the public.

Appointment

Special Duties Division

William Ian Axford, M.E., M.Sc. (568299), is granted a short-service commission in the Administrative and Supply Branch (Special Duties Division), Regular Air Force, for a period of five years, to be followed by four years in the Reserve of Air Force Officers. He is appointed to the rank of Flying Officer, with seniority from 6 May 1955, with effect from 6 May 1957.

AIR TRAINING CORPS

Appointment

James Wilkie McIvor, B.A., is granted a commission in the Air Training Corps with the rank of Pilot Officer, with effect from 7 May 1957.

RESERVE OF AIR FORCE OFFICERS

Appointment

David Russell Hay, M.B., Ch.B., M.R.C.P., M.R.A.C.P. (134059), is granted a commission in the Medical Branch, Reserve of Air Force Officers, for a period of four years. He is appointed to the rank of Flight Lieutenant, with effect from 6 May 1957.
