ORDER IN COUNCIL
At the Government Buildings at Wellington this 22nd day of
May 1957.
Present:
THE RIGHT HON. S. G. HOLLAND PRESIDING IN COUNCIL
PURSUANT to section 439 of the Maori Affairs Act 1953, His
Excellency the Governor-General, acting by and with the
advice and consent of the Executive Council, hereby sets
apart the Maori freehold land described in the Schedule
hereto as a Maori reservation for the purposes of a place of
historical interest and a recreation ground for the common
use of the Maori people of New Zealand.
SCHEDULE
NORTH AUCKLAND LAND DISTRICT
ALL that area of land situated in Block IV, Kawakawa Survey
District, containing 6 acres 2 roods 36 perches, and being part
of the land known as Te Ti A; as is more particularly deline-
ated on the plan numbered M.A. 21/3/136 lodged in the Head
Office of the Department of Maori Affairs, Wellington, and
thereon edged red.

THE RIGHT HON. S. G. HOLLAND PRESIDING IN COUNCIL
PURSUANT to section 439 (5) of the Maori Affairs Act 1953,
His Excellency the Governor-General, acting by and with
the advice and consent of the Executive Council, hereby
revokes the Order in Council made on 30 November 1955,
and published in the Gazette, 8 December 1955, Volume III,
page 1879, and affecting the land described in the Schedule
hereto.

Authorising John Maxwell Dunphy, of Kopara Falls, Ahaura,
Farmer, to Use Water for the Purpose of Generating
Electricity and to Erect and Use Certain Electric Lines in
the County of Grey

ORDER IN COUNCIL

Present:
THE RIGHT HON. S. G. HOLLAND PRESIDING IN COUNCIL
PURSUANT to the Public Works Act 1928, His Excellency the
Governor-General, acting by and with the advice and consent
of the Executive Council, hereby grants to John Maxwell
Dunphy, of Kopara Falls, Ahaura, farmer (hereinafter referred
to as the licensee), a licence, subject to the conditions herein-
after set forth, to take and use from an unnamed stream
(hereinafter referred to as the said stream) situated in part R.
1609, Block I, Haupiri Survey District, in the County of Grey,
for the purpose hereinafter set forth, a stream of water not
exceeding 2 cubic feet per second at any one time, and to
lay, construct, put up, place, and use the electric lines here-
inafter described.
CONDITIONS
IMPLIED CONDITIONS

  1. The conditions directed to be implied in all licences by
    the Water Power Regulations 1934 and the Electrical Supply
    Regulations 1935 shall be incorporated in and shall form part
    of this licence, except in so far as the same may be inconsis-
    tent with the provisions hereof.
    LICENCE SUBJECT TO REGULATIONS
  2. This licence is issued under the Water Power Regulations
    1934, and is subject thereto, and to the Electrical Supply
    Regulations 1935, the Electrical Wiring Regulations 1935, the
    Radio Interference Regulations 1934, and to all regulations
    hereafter made in amendment thereof or in substitution
    therefor respectively.
    UTILISATION OF WATER AND LOCATION OF HEADWORKS
  3. Water shall be used under this licence solely for the
    purpose of generating electricity and shall be taken from
    the said stream at the point in part R. 1609, Block I, Haupiri
    Survey District, indicated on the plan marked S.H.D. 439
    deposited in the office of the State Hydro-electric Department
    at Wellington.
    GENERAL DESCRIPTION OF WORKS
  4. The licensee is hereby authorised, subject to the conditions
    hereof, to construct, maintain, and use the following works
    for the purpose of this licence, the positions of the said works
    being indicated on the said plan S.H.D. 439:
    (a) Headworks consisting of a weir and intake with a pipe-
    line leading to the powerhouse, hereinafter referred
    to, giving a static head of approximately 180 ft.
    (b) Water wheel and powerhouse with all necessary equip-
    ment for generating electricity, situated in Section
    2576, Block I, Haupiri Survey District.
    (c) Tail race leading from the said powerhouse back to
    the said stream.
    (d) Electric lines leading from the said powerhouse in a
    south-westerly direction across a stream and a road
    to a house situated in Section 3974, Block I, Haupiri
    Survey District, the said lines and buildings being
    more particularly shown on the said plan S.H.D. 439.
    PROTECTION OF STATE FOREST
  5. The licensee shall, in addition to a strict compliance
    with the provisions of the Forests Act 1949, the Forest and
    Rural Fires Act 1955, and the regulations in force thereunder,
    take all reasonable precautions to protect the forest growth
    in the aforesaid part R. 1609 from damage or destruction
    from fire, stock trespass, or otherwise and shall instruct all
    workmen in the licensee's employ in the vicinity of this
    condition. In the event of the bush on the said part R. 1609
    being destroyed by fire (whether such fire originated on such
    land or on land adjacent thereto in the possession or occupation
    of the licensee) the licensee shall be liable for payment of
    compensation to be assessed by the Conservator of Forests
    if such fire is a consequence of any negligence or disregard
    of these conditions by the licensee or by any agent, servant,
    workman, or invitee of the licensee.
    SYSTEM OF SUPPLY
  6. The system of supply shall be an alternating-current
    system as described in paragraphs (b) and (d) of regulation
    21-01 of the Electrical Supply Regulations 1935.
    DURATION OF LICENCE
  7. Unless sooner lawfully determined this licence shall
    continue in force until the 31st day of March 1978.
    RENTAL
  8. For the purpose of assessing the rental or annual sum
    payable in respect of this licence, the maximum generating
    capacity of the plant, at the commencement of this licence,
    is 15 kilowatts.
    NO RIGHT TO WATER CONFERRED
  9. Nothing in this licence shall of itself confer upon the
    licensee any right to water.

    to Use Water for the Purpose of Generating Electricity

    Present:
    THE RIGHT HON. S. G. HOLLAND PRESIDING IN COUNCIL
    PURSUANT to the Public Works Act 1928, His Excellency the
    Governor-General, acting by and with the advice and consent
    of the Executive Council, hereby grants to Lance Webb
    Anderson and Weldon Bruce Anderson, both of Mount
    Patriarch, Blenheim, farmers, trading together in partnership
    under the firm name of Anderson Brothers (hereinafter
    referred to as the licensees), a licence, subject to the conditions
    hereinafter set forth, to take and use from Birch Hill Creek
    (hereinafter referred to as the said stream), situated in S. G.
    Run 141, Patriarch Survey District, in the County of Marl-
    borough, for the purpose hereinafter set forth, a stream of
    water not exceeding 2 cubic feet per second at any one time.
