Present:
THE RIGHT HON. S. G. HOLLAND PRESIDING IN COUNCIL
Pursuant to the Local Government Loans Board Act 1926, His Excellency the Governor-General, acting by and with the advice
and consent of the Executive Council, hereby consents to the borrowing by the local authorities mentioned in the Schedule hereto
by way of loan of the whole or any part of the respective amounts specified in that Schedule.

City of Dunedin Exempted from the Provisions of Section
128 of the Public Works Act 1928

Pursuant to section 128 of the Public Works Act 1928,
His Excellency the Governor-General, acting by and
with the advice and consent of the Executive Council, hereby
approves of the resolution passed by the Dunedin City Council
on the 19th day of December 1955, and set out in the First
Schedule hereto, in so far as it affects the side and portion
of street described in the Second Schedule hereto.
FIRST SCHEDULE
The Dunedin City Council, being the local authority having
control of the streets in the City of Dunedin, hereby declares
that the provisions of section 128 of the Public Works Act
1928 shall not apply to the south-eastern side of the portion
of Portobello Road fronting the subdivision of part Section
72, Block VII, Town District, being all the land in certificate
of title, Volume 139, folio 15, Otago Land Registry.
SECOND SCHEDULE
The south-eastern side of all that portion of Portobello Road
situated in the Otago Land District, City of Dunedin, front-
ing a subdivision of part Section 72, Block VII, Town
District.
As the same is more particularly delineated on the plan
marked P.W.D. 149319 deposited in the office of the Minister
of Works at Wellington, and thereon edged red.

Varying a Condition as to Setting Back the Building Line of
Portion of the South-eastern Side of Easter Crescent and
Portion of the North-western Side of Sea View Terrace in
the City of Dunedin, Imposed by Order in Council under
Section 31 of the Municipal Corporations Amendment Act
1948 and Section 125 of the Public Works Act 1928

THE RIGHT HON. S. G. HOLLAND PRESIDING IN COUNCIL
Pursuant to section 131 of the Public Works Act 1928,
His Excellency the Governor-General, acting by and
with the advice and consent of the Executive Council, hereby
amends the Order in Council dated the 4th day of April 1950,
published in Gazette 5 April 1950, Volume I, page 370, and
deposited in the Land Registry Office at Dunedin as No.
5908, authorising the laying off of the streets described in the
Schedule of the said Order in Council subject to a condition
as to the building line, by varying the condition with regard
to the building line imposed by the said Order in Council so
that no building or part of a building shall at any time be
erected on Lot 23, D.P. 7143, being part Section 10, Ocean
Beach District, within a distance of 15 ft. from the side lines
of the said streets.

Authorising the Laying Off of Alton Place in the City of
Palmerston North, Subject to a Condition as to the Building
Line

ORDER IN COUNCIL

THE RIGHT HON. S. G. HOLLAND PRESIDING IN COUNCIL
Pursuant to section 186 of the Municipal Corporations
Act 1954 and section 125 of the Public Works Act 1928,
His Excellency the Governor-General, acting by and with the
advice and consent of the Executive Council, hereby authorises
the Palmerston North City Council to permit the laying off
of the proposed street described in the Schedule hereto at a
width for part of its length of less than 66 ft., but not less
than 40 ft., subject to the condition that no building or part
of a building shall at any time be erected on Lots 3, 4, 7, 8,
9, and 10 of a subdivision of the land shown edged green on
the plan marked P.W.D. 149324, referred to in the said
Schedule, within a distance of 35 ft. from the centre line of
the said street.
SCHEDULE
That proposed street in the Wellington Land District, City of
Palmerston, containing by admeasurement 1 rood 13: 22
perches, more or less, being part Lots 164 and 165, D.P. 791,
being part Block 4, Hokowhitu Maori Reserve.
As the same is more particularly delineated on the plan
marked P.W.D. 149324 deposited in the office of the Minister
of Works at Wellington, and thereon coloured red.

Revoking the Vesting of Land in the Alexandra Borough Council
for Tree-planting Purposes

ORDER IN COUNCIL
At the Government Buildings at Wellington this 31st day of
January 1956
Present:
THE RIGHT HON. S. G. HOLLAND PRESIDING IN COUNCIL
Whereas by an Order in Council dated the 29th day of
January 1929, and published in Gazette, 7 February 1929,
Vol. I, page 352, an area of Crown land was vested, subject to the
conditions set forth in the said Order in Council, in the Mayor,
Councillors, and Citizens of the Borough of Alexandra for tree-
planting purposes, pursuant to section 20 of the Land Laws Amend-
ment Act 1926:
And whereas it is expedient that the aforesaid Order in Council
should be revoked in so far as it relates to the land described in
the Schedule hereto:
And whereas the said Alexandra Borough Council has duly
consented to such revocation:
Now, therefore, pursuant to subsection 2 of section 20 of the
Land Laws Amendment Act 1926, and of every other power and
authority enabling him in this behalf, His Excellency the Governor-
General, acting by and with the advice and consent of the Execu-
tive Council, hereby revokes the aforesaid Order in Council,
dated the 29th day of January 1929, in so far as it relates to the
land described in the Schedule hereto.
SCHEDULE
Otago Land District
Section 106 (formerly part Section 88), Block VII, Leaning Rock
Survey District: Area, 7 acres 2 roods 32:3 perches, more or less.
