Adding Land to the Fiordland National Park

ORDER IN COUNCIL

At the Government Buildings at Wellington this 23rd day of October 1956

Present:

THE RIGHT HON. S. G. HOLLAND PRESIDING IN COUNCIL

PURSUANT to section 10 of the National Parks Act 1952, His Excellency the Governor-General, acting by and with the advice and consent of the Executive Council, hereby declares that the land described in the Schedule hereto, being Crown land subject to the provisions of the Land Act 1948, shall as from the date hereof be added to and form part of the Fiordland National Park, and such land shall hereafter be subject to the provisions of the first-mentioned Act.

SCHEDULE

SOUTHLAND LAND DISTRICT

ALL that area in Eglinton and Swinton Survey Districts containing by estimation 2,900 acres, more or less, and bounded as follows:

Commencing at a point on the right bank of the Eglinton River at its mouth; thence north-easterly, south-easterly, and south-westerly generally, along the boundary of Fiordland National Park, as described in the Fifth Schedule to the National Parks Act 1952, to the northernmost point of Run 394 in Block VI, Eglinton Survey District, as shown on plan numbered 6251 lodged in the office of the Chief Surveyor at Invercargill; thence south-westerly generally along the north-western and western boundaries of the said Run 394, to the northern boundary of P.R.A. Block III, Eglinton Survey District; thence westerly, southerly, and easterly along the northern, western, and southern boundaries of P.R.A. aforesaid to the western boundary of the said Run 394; thence in a southerly direction along the western boundary of the said Run 394 to the western side of the Lumsden–Te Anau–Milford Sound Main Highway; thence in a southerly direction along the western side of the said highway to its intersection with the western boundary of the said Run 394; thence again southerly along the western boundary of the said Run 394 to the north-eastern boundary of Section 1, Block III, Eglinton Survey District; thence north-westerly along the north-eastern boundary of the said Section 1 to Lake Te Anau; thence northerly generally along the eastern shore of Lake Te Anau to and across the mouth of the Eglinton River to the point of commencement, and including the bed and waters of the Eglinton River, but excluding all public roads.

As shown on the plans marked L. and S. 8/10/11 A and B deposited in the Head Office, Department of Lands and Survey, at Wellington, and thereon coloured red.

Authorising the Laying Off of an Extension of Thurso Street in the City of Invercargill Subject to a Condition as to the Building Line

At the Government Buildings at Wellington this 29th day of October 1956

Present:

THE RIGHT HON. S. G. HOLLAND PRESIDING IN COUNCIL

PURSUANT to section 186 of the Municipal Corporations Act 1954 and section 125 of the Public Works Act 1928, His Excellency the Governor-General, acting by and with the advice and consent of the Executive Council, hereby authorises the Invercargill City Council to lay off the proposed street described in the Schedule hereto at a width for the whole of its length of less than 66 ft. but not less than 52·8 ft., subject to a condition that no building or part of a building shall at any time be erected on Lots 2, 4, 5, and 6, D.P. 4461, Lots 1, 2, 3, 4, and 5, D.P. 4965, Lots 5, 6, 7, and 8, D.P. 5014, and Lots 11 and 12, D.P. 5013, adjoining the said street (as shown on the plan marked P.W.D. 151595 referred to in the Schedule hereto) within a distance of 42 ft. from the centre line of the said street.

THAT proposed street in the Southland Land District, City of Invercargill, being an extension of Thurso Street, containing by admeasurement 2 roods 7·6 perches, being Lot 9, D.P. 4461, Lot 11, D.P. 4965, Lot 14, D.P. 5013, and Lot 9, D.P. 5014, being part Section 35, Block I, Invercargill Hundred.

As the same is more particularly delineated on the plan marked P.W.D. 151595 deposited in the office of the Minister of Works at Wellington, and thereon coloured red.

Declaring an Access Way to be Vested in the Corporation of the Borough of New Lynn and to be Under the Control and Management of the New Lynn Borough Council

Present:

THE RIGHT HON. S. G. HOLLAND PRESIDING IN COUNCIL

PURSUANT to section 11 of the Housing Act 1955, His Excellency the Governor-General, acting by and with the advice and consent of the Executive Council, hereby orders and declares that the access way described in the Schedule hereto shall, on and after the date of this Order in Council, vest in the Mayor, Councillors, and Citizens of the Borough of New Lynn and be under the control and management of the New Lynn Borough Council.

APPROXIMATE area of the access way dealt with: 7·7 perches. Being Lot 38, D.P. 43834. Part certificate of title, Volume 752, folio 196, Auckland Land Registry.

Revocation of Order in Council Prohibiting All Alienations of Certain Maori Land Other Than Alienations by Way of Will

Present:

THE RIGHT HON. S. G. HOLLAND PRESIDING IN COUNCIL

PURSUANT to all powers in that behalf him enabling, His Excellency the Governor-General, acting by and with the advice and consent of the Executive Council, hereby revokes an Order in Council made on 16 May 1934, and published in the Gazette, 24 May 1934, Volume II, page 1523, declaring the land mentioned in the Schedule hereto to be excepted from the operation of Part XIX of the Maori Land Act 1931 and to be absolutely inalienable except by will.
