Boundaries of Borough of Mount Eden and Borough of Mount Roskill Altered

At the Government Buildings at Wellington this 29th day of October 1956

Present:

THE RIGHT HON. S. G. HOLLAND PRESIDING IN COUNCIL

WHEREAS, pursuant to the Local Government Commission Act 1953, the Local Government Commission has approved as final a scheme bearing date the 28th day of June 1956 providing for the exclusion of the area described in the First Schedule to the said scheme from the Borough of Mount Eden and its inclusion in the Borough of Mount Roskill, and for the exclusion of the area described in the Second Schedule to the said scheme from the Borough of Mount Roskill and its inclusion in the Borough of Mount Eden:

And whereas it is deemed expedient to give effect to the final scheme as hereinafter appearing:

Now, therefore, pursuant to the Local Government Commission Act 1953, His Excellency the Governor-General, acting by and with the advice and consent of the Executive Council, hereby declares:

(1) That the area described in the First Schedule hereto shall be excluded from the Borough of Mount Eden and included in the Borough of Mount Roskill.

(2) That the area described in the Second Schedule hereto shall be excluded from the Borough of Mount Roskill and included in the Borough of Mount Eden.

(3) That the alteration of boundaries hereinbefore made shall be deemed to have been effected under the Municipal Corporations Act 1954.

FIRST SCHEDULE

AREA EXCLUDED FROM BOROUGH OF MOUNT EDEN AND INCLUDED IN BOROUGH OF MOUNT ROSKILL

ALL that area of approximately 2 acres in Block IV, Titirangi Survey District, in the North Auckland Land District, bounded by a line commencing at the north-eastern corner of Lot 169, D.P. 37709, being part Allotment 91 of Section 10, Suburbs of Auckland; and running north-easterly along the southern boundaries of Lots 3, 4, and 5, D.P. 41970, and Lots 2 and 1, D.P. 39849, the aforesaid lots all being parts of Allotment 92 of the said Section 10, to the boundary of the Borough of Mount Eden; thence southerly and westerly along the boundaries of the aforesaid borough as described in Gazette, No. 71, of the 15th day of October 1925, page 2912, to the point of commencement.

SECOND SCHEDULE

AREA EXCLUDED FROM BOROUGH OF MOUNT ROSKILL AND INCLUDED IN BOROUGH OF MOUNT EDEN

ALL that area of approximately 2 acres 2 roods in Block IV, Titirangi Survey District, in the North Auckland Land District, bounded by a line commencing at the easternmost corner of Lot 1, D.P. 39849, being part of Allotment 92 of Section 10, Suburbs of Auckland, and running northerly, easterly, and southerly generally along the boundary of the Borough of Mount Eden as described in Gazette, No. 71, of the 15th day of October 1925, page 2912, to the north-eastern side of Three Kings Road; thence north-westerly generally along the aforesaid north-eastern side to a point in line with the southern boundary of part Lot 2, D.P. 18660, being part of the aforesaid Allotment 92; thence along a right line across the aforesaid Three Kings Road to and along the southern boundary of the aforesaid part Lot 2 to the easternmost corner of Lot 1, D.P. 39849, the point of commencement.

Confering on Marlborough County Council Certain Powers of Borough Councils with Respect to Water Supply

PURSUANT to section 182 of the Counties Act 1920, His Excellency the Governor-General, acting by and with the advice and consent of the Executive Council, hereby confers on the Marlborough County Council all the powers with respect to the supply of water for domestic or industrial purposes exercisable by a duly constituted borough council under sections 95, 96, 98 to 100, and Part XVII (with the exception of sections 246, 248, and 249) and section 369 of the Municipal Corporations Act 1954.

Constituting Seddon Secondary Urban Fire District

THE RIGHT HON. S. G. HOLLAND PRESIDING IN COUNCIL

WHEREAS, pursuant to section 18 of the Fire Services Act 1949, the Awatere County Council requested that the Urban Area of Seddon be constituted a secondary urban fire district:

And whereas, pursuant to the said section 18 the Fire Service Council has certified that the appropriate standards for a secondary urban fire district have been complied with in respect of the said urban area:

And whereas, pursuant to the said section 18, the request has been referred to the Local Government Commission:

And whereas, pursuant to the Local Government Commission Act 1953, the Local Government Commission has recommended that action be taken under the Fire Services Act 1949 to constitute the said urban area a secondary urban fire district:

Now, therefore, pursuant to section 18 of the Fire Services Act 1949, His Excellency the Governor-General, acting by and with the advice and consent of the Executive Council, hereby declares the Urban Area of Seddon to be a secondary urban fire district by the name of the Seddon Secondary Urban Fire District.

Now, therefore, pursuant to section 7 of the Local Government Commission Act 1953, His Excellency the Governor-General, acting by and with the advice and consent of the Executive Council and on the recommendation of the Minister of Internal Affairs, hereby appoints

Neil Buchanan Hunt, of Rotorua,

to be a deputy to act for the said George Alexander Monk on the Local Government Commission for a period of fourteen days as on and from the date of this Order in Council.
