Altering the Boundaries of the Hauraki Catchment District

Present:

THE RIGHT HON. S. G. HOLLAND PRESIDING IN COUNCIL

PURSUANT to the Soil Conservation and Rivers Control Act 1941, His Excellency the Governor-General, acting by and with the advice and consent of the Executive Council, hereby alters the boundaries of the Hauraki Catchment District, as constituted by Order in Council dated the 13th day of February 1946, published in Gazette, 14 February 1946, Volume I, page 213, as amended by Order in Council dated the 24th day of April 1951, published in Gazette, 3 May 1951, Volume II, page 604, by excluding therefrom the areas described in the First Schedule hereto and by including therein the areas described in the Second Schedule hereto.

FIRST SCHEDULE

AREAS EXCLUDED FROM THE HAURAKI CATCHMENT DISTRICT

ALL that area in the South Auckland Land District, Matamata County, bounded by a line commencing at Trig. Station No. 146 (Te Weraiti), at the westernmost corner of Mangatotara No. 3B 2B Block in Block IV, Opoutihi Survey District, and running northerly along a right line between that trig. station and the easternmost corner of Lot 5, D.P. 5099, being part Whakamarama No. 2 Block in Block XI, Aongatete Survey District, to the boundary of the Hauraki Catchment District; thence south-easterly and then south-westerly along that boundary as described in the Order in Council dated the 13th day of February 1946, published in Gazette, 14 February 1946, Volume I, page 213, to the point of commencement.

Also all that area in the South Auckland Land District, Matamata County, bounded by a line commencing at Trig. Station No. 910 (Te Kauranga), on the western boundary of Section 125, Selwyn Settlement, in Block II, Tapapa East Survey District, and running north-westerly along a right line to Trig. Station No. 146 (Te Weraiti) at the westernmost corner of Mangatotara No. 3B 2B Block, in Block IV, Opoutihi Survey District; thence generally south-easterly and southerly along the boundary of the Hauraki Catchment District as described in the aforesaid Order in Council dated 13 February 1946, to the point of commencement.

Also all that area in the South Auckland Land District, Ohinemuri County, in Block IV, Aroha Survey District, bounded by a line commencing at a point on the generally eastern side of the Waihi–Tauranga Railway, on a right line between the northernmost corner of Section 44 and the southernmost corner of Section 46, both of Block IV aforesaid, and running north-easterly along that right line to the western boundary of Section 56 of the said Block IV, thence southerly, westerly, and then northerly along the boundary of the Hauraki Catchment District as described in the aforesaid Order in Council dated 13 February 1946, to the point of commencement.

Also all that area in the South Auckland Land District, Ohinemuri County, situated in Block VIII, Aroha Survey District, bounded by a line commencing at a point on the northern boundary of Section 1, Block XII, Katikati Survey District, on a right line between Trig. Station MC, at the easternmost corner of Section 1 of Block VIII aforesaid, and the northernmost corner of Section 44, Block IV, Aroha Survey District, and running north-easterly along the right line to the south-western boundary of Section 44 aforesaid; thence south-easterly and then westerly along the boundary of the Hauraki Catchment District as described in the aforesaid Order in Council dated 13 February 1946, to the point of commencement.

Also all that area in the South Auckland Land District, Ohinemuri County, being the whole of Sections 1 and 4, Block VIII, Aroha Survey District.

Also all that area in the South Auckland Land District, Waikato County, bounded by a line commencing at the northernmost corner of Lot 9, D.P. 7346, being part of the Loan and Mercantile Grant in Block XVI, Komakorau Survey District, and running generally south-easterly along the north-eastern boundary of that Lot 9 and along a right line, being that boundary produced to and along the eastern side of the Hamilton–Paeroa State Highway, to and along the northern and eastern boundaries of Lot 7, D.P. 9815, the north-western and north-eastern boundaries of Lot 2, D.P. 24118, and the eastern boundary of Lot 2, D.P. 24812, to and south-westerly along the north-western side of the public road forming the generally south-eastern boundaries of the last-mentioned Lot 2, of Lot 1, D.P. 24812 aforesaid, part Lot 2, D.P. 5178, and the land shown on D.P. 6744, the aforementioned lots and land all being parts of the Loan and Mercantile Grant aforesaid, to the boundary of the Hauraki Catchment District; thence north-westerly and then north-easterly along that boundary as described in the aforesaid Order in Council dated 13 February 1946, to the point of commencement.

SECOND SCHEDULE

AREAS INCLUDED IN THE HAURAKI CATCHMENT DISTRICT

ALL that area in the South Auckland Land District, Matamata County, bounded by a line commencing at Trig. Station No. 910 (Te Kauranga), on the western boundary of Section 125, Selwyn Settlement, in Block II, Tapapa East Survey District, and running south-easterly along a right line to the intersection of the north-eastern boundary of Whaiti Kuranui No. 5C 2 Block with the western boundary of Block III, Tapapa East Survey District; thence southerly along the western boundaries of the said Block III and of Block V, Tapapa East Survey District, to and westerly along the generally southern boundary of the No. 5C 2 Block aforesaid, to the boundary of the Hauraki Catchment District; thence northerly along that boundary as described in the Order in Council dated the 13th day of February 1946 published in Gazette, 14 February 1946, Volume I, page 213, to the point of commencement.

Also all that area in the South Auckland Land District, Matamata County, bounded by a line commencing at the intersection of the northern boundary of Block IV, Patetere North-East Survey District, with a right line between Trig. Station No. 910 (Te Kauranga) on the western boundary of Section 125, Selwyn Settlement, in Block II, Tapapa East Survey District, and the south-western corner of Section 46, Selwyn Settlement, in Block IV aforesaid, and running easterly along the northern boundary of that Block IV to its north-eastern corner; thence south-easterly along a right line to the intersection of the eastern boundary of Block X, Patetere North-East Survey District, with the generally northern side of the Hamilton–Rotorua State Highway; thence westerly and then northerly along the boundary of the Hauraki Catchment District as described in the aforesaid Order in Council dated 13 February 1946, to the point of commencement.

Also all that area in the South Auckland Land District, Ohinemuri County, bounded by a line commencing at a point on the southern side of the Waihi-Waihi Beach Main Highway, being the north-western corner of Section 5, Block I, Katikati North Survey District, and running southerly along a right line to the southernmost corner of Lot 6, D.P. 29817, being part Section 4, along the north-western and south-western boundaries of the part Section 5, containing an area of 672 acres and 36 perches, and along the north-western boundary of Lot 1, D.P. 32351, being part Sections 6 and 7, to the westernmost corner of that lot; thence westerly generally along a right line to the westernmost corner of Lot 4, D.P. 28257, being part Section 2, the said sections being of Block I aforesaid, along another right line to the angle in the generally south-eastern boundary of Section 46, Block IV, Aroha Survey District, and along that south-eastern boundary to the southernmost corner of that section; thence along a right line between that corner and the northernmost corner of Section 44 of the said Block IV, to the western boundary of Section 56 of Block IV aforesaid; thence generally north-easterly along the boundaries of the Hauraki Catchment District as described in the aforesaid Order in Council dated 13 February 1946, to the point of commencement.

Also all that area in the South Auckland Land District, Ohinemuri County, bounded by a line commencing at the northernmost corner of Section 44, Block IV, Aroha Survey District, and running south-westerly along a right line between that point and Trig. Station MC, at the easternmost corner of Section 1, Block VIII, Aroha Survey District, to the south-western boundary of the said Section 44; thence north-westerly and then north-easterly along the south-western and north-western boundaries of that section, being part of the boundary of the Hauraki Catchment District as described in the aforesaid Order in Council dated 13 February 1946, to the point of commencement.

Also all that area in the South Auckland Land District, Ohinemuri County, being the part Section 1, Block XII, Katikati Survey District, bounded by a line commencing at a point on the generally northern boundary of that section, on a right line between the northernmost corner of Section 44, Block IV, Aroha Survey District, and Trig. Station MC, at the easternmost corner of Section I, Block VIII, Aroha Survey District, and running south-westerly along that right line to Trig. Station MC aforesaid; thence westerly and then north-easterly along the generally north-western boundaries of the Section 1 of Block XII aforesaid, being part of the boundary of the Hauraki Catchment District as described in the aforesaid Order in Council dated 13 February 1946, to the point of commencement.

Also all that area in the South Auckland Land District, Tauranga County, bounded by a line commencing at the southernmost corner of Section 3, Block VIII, Aroha Survey District, and running generally southerly along the south-western boundary of Section 1, Block XII, Katikati Survey District, to and along the north-western and western boundaries of Section 28, Block IV, Katikati Survey District, to and along the western boundaries of Blocks IV and VIII, Katikati Survey District, to a point in line with the northern boundary of Block XII, Aroha Survey District; thence along a right line running due west between that last-described point and the said northern boundary, to the boundary of the Hauraki Catchment District; thence generally north-westerly and then north-easterly along the boundary of that district as described in the aforesaid Order in Council dated 13 February 1946, to the point of commencement.
