Authorising Gordon Ralph Havill and Roderick Hugh de Filippi, both of Rahu, Reefton, Garage Proprietors, to Use Water for the Purpose of Generating Electricity and to Erect Certain Electric Lines

ORDER IN COUNCIL

Present:
THE RIGHT HON. S. G. HOLLAND PRESIDING IN COUNCIL
PURSUANT to the Public Works Act 1928, His Excellency the Governor-General, acting by and with the advice and consent of the Executive Council, hereby grants to Gordon Ralph Havill and Roderick Hugh de Filippi, both of Rahu, Reefton, garage proprietors (hereinafter referred to as the licensees), a licence, subject to the conditions hereinafter set forth, to take and use from Black Creek (hereinafter referred to as the said stream), situated in part Section 9, Block III, Lewis Survey District, in the County of Inangahua, for the purpose hereinafter set forth, a stream of water not exceeding 2 cubic feet per second at any one time, and to lay, construct, put up, place, and use the electric lines hereinafter described.
CONDITIONS
IMPLIED CONDITIONS
- The conditions directed to be implied in all licences by the Water Power Regulations 1934 and the Electrical Supply Regulations 1935 shall be incorporated in and shall form part of this licence, except in so far as the same may be inconsistent with the provisions hereof.
LICENCE SUBJECT TO REGULATIONS
2. This licence is issued under the Water Power Regulations 1934, and is subject thereto, and to the Electrical Supply Regulations 1935, the Electrical Wiring Regulations 1935, the Radio Interference Regulations 1934, and to all regulations hereafter made in amendment thereof or in substitution therefor respectively.
UTILISATION OF WATER AND LOCATION OF HEADWORKS
3. Water shall be used under this licence solely for the purpose of generating electricity, and shall be taken from the said stream at the point in part Section 9, Block III, Lewis Survey District, indicated on the plan marked S.H.D. 407 deposited in the office of the State Hydro-electric Department at Wellington.
GENERAL DESCRIPTION OF WORKS
4. The licensees are hereby authorised, subject to the conditions hereof, to construct, maintain, and use the following works for the purpose of this licence, the positions of the said works being indicated on the said plan S.H.D. 407:
(1) Headworks consisting of an intake, water race, and pipeline leading to the powerhouse hereinafter referred to, giving a static head of approximately 30 ft.
(2) Pelton wheel and powerhouse with all necessary equipment for generating electricity, situated in part Section 15, Block III, Lewis Survey District.
(3) Tail race leading from the said powerhouse to Rahu Stream.
(4) Electric lines leading from the said powerhouse and proceeding as follows:
(a) In a south-westerly direction across a road to a house situated in part Section 9, Block III, Lewis Survey District.
(b) In an easterly direction to a pole situated in part Section 15, Block III, Lewis Survey District, and thence:
(i) In an easterly direction to a garage and service station situated in part Section 15 aforesaid.
(ii) In a northerly direction to a house and two huts situated in part Section 15 aforesaid.
The said lines and buildings being more particularly shown on the said plan S.H.D. 407.
SYSTEM OF SUPPLY
5. The system of supply shall be an alternating current system as described in paragraph (d) of regulation 21-01 of the Electrical Supply Regulations 1935.
DURATION OF LICENCE
6. Unless sooner lawfully determined this licence shall continue in force until the 31st day of March 1977.
RENTAL
7. For the purpose of assessing the rental or annual sum payable in respect of this licence, the licensees may install a suitable maximum-demand indicator to the satisfaction of the inspecting engineer of the State Hydro-electric Department, and failing such installation, the rental shall be assessed on the maximum generating capacity of the plant installed. The present plant is rated at 5 kilowatts.
NO RIGHT TO WATER CONFERRED
8. Nothing in this licence shall of itself confer upon the licensees any right to water.

Authorising the Central Hawke's Bay Electric Power Board to Erect and Use Electric Lines Within Part of the Dannevirke County

THE RIGHT HON. S. G. HOLLAND PRESIDING IN COUNCIL
PURSUANT to the Public Works Act 1928 and the Electric Power Boards Act 1925, His Excellency the Governor-General, acting by and with the advice and consent of the Executive Council, hereby authorises the Central Hawke's Bay Electric Power Board (hereinafter referred to as the licensee), subject to the conditions hereinafter set forth, to lay, construct, put up, place, and use electric lines within the area of supply described in the Schedule hereto; and further, for the purpose of section 76 of the Electric Power Boards Act 1925, subject to the said conditions, hereby authorises the licensee to construct electric works within the said area of supply.
CONDITIONS

The licence hereby conferred is subject to compliance by the licensee with the Electrical Supply Regulations 1935, the Electrical Wiring Regulations 1935, the Radio Interference Regulations 1934, and with all regulations hereafter made in amendment thereof or in substitution therefor respectively.
SYSTEMS OF SUPPLY
3. The systems of supply shall be as described in paragraphs (a), (c), (d), (e), and (f) of regulation 21-01 of the Electrical Supply Regulations 1935.
DURATION OF LICENCE
4. This licence shall, unless sooner lawfully determined, continue in force until the 4th day of August 1966.
SCHEDULE
AREA OF SUPPLY
ALL that portion of the Dannevirke County described in the First Schedule to the Proclamation dated the 27th day of July 1956, and published in the Gazette on the 2nd day of August 1956 at page 1031, altering the boundaries of the Central Hawke's Bay and Dannevirke Electric Power Districts.

Extending the Duration of Licences Authorising the Tauranga Borough Council to Use Water for the Purpose of Generating Electricity and to Erect and Use Electric Lines

THE RIGHT HON. S. G. HOLLAND PRESIDING IN COUNCIL
PURSUANT to the Public Works Act 1928, His Excellency the Governor-General, acting by and with the advice and consent of the Executive Council, hereby amends the Orders in Council specified in the Schedule hereto authorising the Tauranga Borough Council to use water for the purpose of generating electricity and to erect and use electric lines, by extending the duration of the said Orders in Council until the 1st day of December 1956.
