Present:
HIS EXCELLENCY THE GOVERNOR-GENERAL IN COUNCIL
WHEREAS, pursuant to the Local Government Commission Act 1953, the Local Government Commission has approved as final a scheme bearing date the 28th day of July 1955 providing for the merger of the County of Eden in the City of Auckland:
And whereas, pursuant to that Act, the Local Government Commission has approved as final a scheme bearing date the 21st day of November 1955 providing for the inclusion of the areas described in the Schedule to the said scheme in the City of Auckland:
And whereas it is deemed expedient to give effect to the final schemes as hereinafter appearing:
Now, therefore, pursuant to the Local Government Commission Act 1953, His Excellency the Governor-General, acting by and with the advice and consent of the Executive Council, hereby declares:

That, as on and from the 1st day of April 1956, the County of Eden as described in the First Schedule hereto shall be merged in the City of Auckland.

That, as on and from the date aforesaid, the areas described in the Second Schedule hereto shall be included in the City of Auckland.

That the alteration of boundaries hereinbefore made shall be deemed to have been effected under the Municipal Corporations Act 1954.
FIRST SCHEDULE
COUNTY OF EDEN
ALL that area of approximately 220 acres bounded by a line commencing at a point on the north-eastern side of Park Road, being the south-eastern corner of Section 18, Suburbs of Auckland, and running in a north-easterly direction generally along the south-eastern boundaries of the aforesaid Section 18 to and along the south-eastern side of Stanley Street to the westernmost corner of Section 11, City of Auckland; thence south-easterly and north-easterly along the south-western and south-eastern boundaries of the aforesaid Section 11 and part of Section 96, Suburbs of Auckland, shown on plan numbered 23582 deposited in the office of the District Land Registrar at Auckland; to and along the southern end of Carlaw Park Avenue to railway land, being part of the Auckland-Newmarket railway; thence south-easterly generally along the south-western boundaries of the aforesaid railway land shown on plans numbered 22823, 22822, and 22648 respectively deposited as aforesaid, to and along the north-western side of Titoki Street to the boundary of the Borough of Newmarket; thence westerly generally along the northern boundary of the aforesaid borough as described in Gazette No. 45, of the 15th day of June 1939, page 1828, and the north-eastern side of Park Road to the point of commencement.
SECOND SCHEDULE
AREAS INCLUDED IN THE CITY OF AUCKLAND
ALL that area of approximately 5 acres in Block XVI, Waitemata Survey District, in the North Auckland Land District, bounded by a line commencing at a point on the north-western side of Meola Road, being the northernmost corner of the area of 1 rood and 29 perches reclaimed from the Auckland Harbour, and proclaimed street by Proclamation published in Gazette No. 4, of the 27th day of January 1955, at page 59, and running generally southerly, westerly, and then northerly, along the boundary of the City of Auckland as described in Gazette No. 50, of the 19th day of August 1954, at page 1337, being the eastern boundary of the aforementioned area of 1 rood and 29 perches, the line of mean high water along both banks of the Meola Creek, and the western boundary of the aforesaid area, to and north-easterly along the north-western side of Meola Road aforesaid, to the point of commencement.
Also all that area totalling 1 rood 11·5 perches, more or less, in Block XVI, Waitemata Survey District, in the North Auckland Land District, being the area of 36·5 perches reclaimed from the Auckland Harbour and proclaimed street by Proclamation published in Gazette No. 4, of the 27th day of January 1955, at page 59, and an adjoining area of 15 perches reclaimed from the Auckland Harbour, and shown on S.O. Plan 37979.
Also all that area of approximately 15 acres in Block XVI, Waitemata Survey District, in the North Auckland Land District, bounded by a line commencing at a point on the north-western side of Meola Road, being the north-western corner of the area of 26·2 perches reclaimed from the Auckland Harbour, and proclaimed street by Proclamation published in Gazette No. 4, of the 27th day of January 1955, at page 59, and running generally north-easterly along the north-western side of Meola Road aforesaid, to and along the line of mean high water along the western, north-western, and north-eastern boundaries of an area of Crown land, shown on S.O. Plan 37979, to and again along the north-western side
of Meola Road, to and along the line of mean high water along the north-western boundary of the reclamation adjoining the south-western boundary of Lot 1, deposited plan No. 29103, being part Allotments 10 and 11 of Section 9, Suburbs of Auckland, to the boundary of the City of Auckland; thence generally southerly and then westerly along the boundary of the City of Auckland aforesaid, as described in Gazette No. 50, of the 19th day of August 1954, at page 1337, to the point of commencement.

Boundaries of Borough of Tuakau and County of Franklin Altered

HIS EXCELLENCY THE GOVERNOR-GENERAL IN COUNCIL
WHEREAS, pursuant to the Local Government Commission Act 1953, the Local Government Commission has approved as final a scheme bearing date the 12th day of January 1956 providing for the areas described in the Schedule to the said scheme to be excluded from the Borough of Tuakau and included in the County of Franklin:
And whereas it is deemed expedient to give effect to the final scheme as hereinafter appearing:
Now, therefore, pursuant to the Local Government Commission Act 1953, His Excellency the Governor-General, acting by and with the advice and consent of the Executive Council, hereby declares that as on and from the 1st day of April 1956 the areas described in the Schedule hereto shall be excluded from the Borough of Tuakau and included in the County of Franklin; and with the like advice and consent, hereby also declares that the alteration of boundaries of the said borough and the said county hereinbefore made shall be deemed to have been effected under the Municipal Corporations Act 1954.
SCHEDULE
AREAS EXCLUDED FROM BOROUGH OF TUAKAU AND INCLUDED IN COUNTY OF FRANKLIN
ALL that area of approximately 70 acres in the North Auckland Land District bounded by a line commencing at a point in Block IV, Onewhero Survey District, being the intersection of the north-eastern boundary of that part of Allotment 15, Parish of Tuakau, comprised in certificate of title, Volume 586, folio 238 (Auckland Land Registry), with the south-eastern boundary of the Borough of Tuakau as described in Gazette No. 77 of the 9th day of December 1954, page 1993, and running generally northerly along the north-eastern boundary of the said part Allotment 15, along a right line, being that boundary produced to the middle of the stream, forming the north-western boundary of Allotment 15 aforesaid, and up the middle of that stream to a point in line with the northern boundary of Lot 1, D.P. 39571, being part of the said Allotment 15; thence easterly and then north-easterly along a right line to and along the northern and eastern boundaries of that lot, to and along the north-western boundary of Lot 2, D.P. 13796, being part of the said Allotment 15, and along a right line being that north-western boundary produced across Bollard Road to the north-eastern side of that road; thence along that side of the said road to and along the north-western boundary of Lot 4, D.P. 32049, being part Allotment 16 of the said parish, to the boundary of the Borough of Tuakau aforesaid, at the northern corner of the said Lot 4; thence south-easterly and then south-westerly along that borough boundary to the point of commencement.
Also all that area of approximately 104 acres in the North Auckland Land District bounded by a line commencing at a point on the northern side of the North Island Main Trunk Railway in Block IV, Onewhero Survey District, being a point on the boundary of the Borough of Tuakau as described in Gazette No. 77 of the 9th day of December 1954, page 1993, and running generally north-westerly along the north-eastern boundary of Allotment 18, Parish of Tuakau, and a right line being the production of that boundary to the middle of Dominion Road; thence westerly along the middle of that road to a point in line with the western boundary of the land shown on D.P. 6955, being part Allotments 61 and 61A of the said parish, and north-westerly along a right line to and along that boundary and along another right line being that boundary produced to the middle of the Whakapipi Stream; thence down the middle of that stream to a point in line with the north-eastern boundary of the land shown on D.P. 3971, being part Allotment 51 of the said parish, and along a right line to and along that north-eastern boundary to, and north-easterly along, a series of right lines parallel to, and 250 links distant from, the south-eastern side of Mill Road, to the boundary of the Borough of Tuakau aforesaid; thence generally easterly, southerly, and then westerly along that borough boundary to the point of commencement.
