Consenting to Raising of Loans by Certain Local Authorities

At the Government House at Wellington this 19th day of October 1955

Present:

HIS EXCELLENCY THE GOVERNOR-GENERAL IN COUNCIL

PURSUANT to the Local Government Loans Board Act 1926, His Excellency the Governor-General, acting by and with the advice and consent of the Executive Council, hereby consents to the borrowing by the local authorities mentioned in the Schedule hereto by way of loan of the whole or any part of the respective amounts specified in that Schedule.

PURSUANT to the Local Government Loans Board Act 1926, His Excellency the Governor-General, acting by and with the advice and consent of the Executive Council, hereby consents to the borrowing by the local authorities mentioned in the Schedule hereto by way of loan of the whole or any part of the respective amounts specified in that Schedule.

Validating Proceedings in Connection with the Waitotara County Council’s Loan of £9,000

ORDER IN COUNCIL

At the Government House at Wellington this 19th day of October 1955

Present:

HIS EXCELLENCY THE GOVERNOR-GENERAL IN COUNCIL

WHEREAS the Waitotara County Council lately proceeded by way of Special Order to raise a loan of nine thousand pounds, to be known as ‘‘Workers’ Dwellings Loan 1955’’ (hereinafter called the said loan):

And whereas the proceedings in connection with the said loan were irregular or defective in that the public notices of the subsequent meeting confirming the resolution, as required by paragraph (c) of section 99 of the Counties Act 1920, as set out in section 13 of the Counties Amendment Act 1949, although given twice with an interval of not less than fourteen days between each, were not given within a period of twenty-eight days immediately preceding the date of such subsequent meeting:

And whereas it appears that the ratepayers of the district have not been misled by such irregularity or defect as aforesaid and it is expedient to validate the same:

Now, therefore, pursuant to section 122 of the Local Bodies’ Loans Act 1926, His Excellency the Governor-General, acting by and with the advice and consent of the Executive Council, hereby orders and declares that the proceedings in connection with the said loan shall be valid to all intents and purposes as though the public notices had been given within a period of twenty-eight days immediately preceding the date of the subsequent meeting, and that the validity of the proceedings in connection with the said loan, or of the security for the said loan, shall not be called in question by reason only of the irregularity or defect aforesaid.

Validating Proceedings in Connection With the Hokianga County Council’s Loan of £3,500

At the Government House at Wellington this 19th day of October 1955

Present:

HIS EXCELLENCY THE GOVERNOR-GENERAL IN COUNCIL

WHEREAS the Hokianga County Council lately proceeded by way of Special Order to raise a loan of three thousand five hundred pounds to be known as ‘‘Staff Housing Loan 1955’’ (hereinafter called the said loan):

And whereas the proceedings in connection with the said loan were irregular or defective in that the public notices of the subsequent meeting confirming the resolution, as required by paragraph (c) of section 99 of the Counties Act 1920, as set out in section 13 of the Counties Amendment Act 1949, although given twice, were not given with an interval of not less than fourteen days between each nor within a period of twenty-eight days immediately preceding the date of such subsequent meeting:

And whereas it appears that the ratepayers of the district have not been misled by such irregularities or defects as aforesaid and it is expedient to validate the same:

Authorizing the Laying Off of a Street Off Weymouth Road in the Borough of Manurewa, Subject to Conditions as to the Building Line

At the Government House at Wellington this 26th day of October 1955

Present:

HIS EXCELLENCY THE GOVERNOR-GENERAL IN COUNCIL

PURSUANT to section 186 of the Municipal Corporations Act 1954 and section 125 of the Public Works Act 1928, His Excellency the Governor-General, acting by and with the advice and consent of the Executive Council, hereby authorizes the Manurewa Borough Council to permit the laying off of the proposed street described in the Schedule hereto at a width for part of its length of less than 66 ft., but not less than 56 ft., subject to the condition that no building or part of a building shall at any time be erected on Lot 37 of a subdivision of the land shown edged green on the plan marked P.W.D. 148313 referred to in the Schedule hereto, or on Lots 12, 20, 23, 24, 25, 26, 27, 28, 29, 30, 31, 32, 33, and 34 of the subdivision of the land shown edged green on the said plan within a distance of 50 ft. from the centre line of the said street.
