Consenting to Raising of Loans by Certain Local Authorities

Present:
HIS EXCELLENCY THE GOVERNOR-GENERAL IN COUNCIL
PURSUANT to the Local Government Loans Board Act 1926, His Excellency the Governor-General, acting by and with the advice and consent of the Executive Council, hereby consents to the borrowing by the local authorities mentioned in the Schedule hereto by way of loan of the whole or any part of the respective amounts specified in that Schedule.

HIS EXCELLENCY THE GOVERNOR-GENERAL IN COUNCIL
WHEREAS, pursuant to the Local Government Commission Act 1953, the Local Government Commission has approved as final a scheme bearing date the 6th day of April 1955 providing for the areas described in the First Schedule to the said scheme to be excluded from the County of Peninsula and included in the City of Dunedin, and providing also for the areas described in the Second Schedule to the said scheme to be included in the City of Dunedin:
And whereas at a poll of electors of those areas of the County of Peninsula proposed to be included in the City of Dunedin taken pursuant to section 22 of the said Act the valid votes recorded against the proposal to include the said areas in the said City were less than 60 per cent of the valid votes recorded at that poll:
And whereas it is deemed expedient to give effect to the final scheme as hereinafter appearing:
Now, therefore, pursuant to the Local Government Commission Act 1954, His Excellency the Governor-General, acting by and with the advice and consent of the Executive Council, hereby declares:
(1) That as on and from the 1st day of October 1955 the areas described in the First Schedule hereto shall be excluded from the County of Peninsula and included in the City of Dunedin.
(2) That as on and from the date aforesaid the areas described in the Second Schedule hereto shall be included in the City of Dunedin.
(3) That the said alteration of boundaries hereinbefore made shall be deemed to have been effected under the Municipal Corporations Act 1954.
FIRST SCHEDULE
AREAS EXCLUDED FROM COUNTY OF PENINSULA AND INCLUDED IN CITY OF DUNEDIN
ALL that area in the Otago Land District, the Peninsula County, and the Ridings of Highcliff and North East Harbour, containing 206 acres, more or less, bounded by a line commencing at a point on the northern shore of Andersons Bay Inlet, in line with the north-western boundary of original Section 12, Block V, Andersons Bay Survey District; thence north-easterly and south-easterly along the boundary of the Dunedin City as described in N.Z. Gazette 1949, page 1724, to the centre of Highcliff Road; thence north-easterly along the centre of Highcliff Road to a point 1400 links distant from and measured at right angles to the south-western boundary of Section 5, Block VIII, Andersons Bay Survey District; thence north-westerly along a straight line parallel to and 1400 links distant from the south-western boundaries of Sections 5, 4, 3, and 2 to the north-western boundary of Section 2; thence northerly along a straight line to the north-eastern corner of Section 1260R; thence north-westerly along a straight line to a point on the north-western boundary of Section 12, Block VIII, Andersons Bay Survey District, 1400 links distant from the south-western corner of that Section 12; thence north-westerly along a straight line to a point on the south-eastern boundary of Lot 10, D.P. 4717, distant 250 links from Doon Road; thence north-westerly along a straight line to the north-western corner of D.P. 6744; thence south-westerly along a straight line to the northern corner of Lot 2, D.P. 1863; thence south-westerly along the south-eastern boundary of Lot 1, D.P. 1863, and its production to and across Scobie Road; thence north-westerly along the south-western boundary of Scobie Road and its production to the mean high-water mark of the Otago Harbour; thence south-westerly along the mean high-water mark to the causeway road across Andersons Bay Inlet; thence generally easterly across that road and along the mean high-water mark of Andersons Bay Inlet to the point of commencement.
Also all that area in the Otago Land District, the Peninsula County, and the Highcliff Riding, containing 10 acres, more or less, bounded by a line commencing at the north-eastern corner of Lot 15, D.P. 6499; thence south-easterly along the north-eastern boundary of that Lot; thence south-westerly along the south-eastern boundaries of Lots 15, 14, 13, 12, 11, and 10, and along a straight line to the south-eastern corner of Lot 9 and along the south-eastern boundaries of Lots 9, 8, 7, 6, 5, 4, 3, 2, and 1, D.P. 6499, across a road and along the south-eastern boundaries of Lots 11, 10, 9, 8, 7, 6, 5, 4, 3, 2, and 1, D.P. 6469, the south-eastern boundary of Lot 1, D.P. 6879, and continuing along a line parallel to and 250 links distant from the south-eastern and eastern side of Highcliff Road to the north-eastern boundary of Lot 1, D.P. 6936; thence north-westerly along that boundary and the north-eastern boundary of Lot 2, D.P. 7448, and its production to the centre of Highcliff Road; thence generally northerly and north-easterly along the centre of Highcliff Road to a point in line with the north-eastern boundary of Lot 15, D.P. 6499; thence south-easterly to the point of commencement.
SECOND SCHEDULE
AREAS INCLUDED IN CITY OF DUNEDIN
ALL that area in the Otago Land District, situated in the Otago Harbour, containing 61 acres, more or less, being the whole of Tainui Inlet and the whole of Andersons Bay Inlet and the causeway road on its north-western side and bounded on the north-west by a line parallel to and 1 chain north-west from the centre of that causeway road.
Also all that area in the Otago Land District, formerly part of the Otago Harbour, containing 10 acres, more or less, bounded by a line commencing at the easternmost corner of Lot 8, D.P. 565; thence north-easterly along the boundary of the City of Dunedin a distance of approximately 3500 links, more or less, to a point 10 ft. on the north-eastern side of the centre of the retaining wall; thence south-easterly along a line parallel to and 10 ft. north-east from the centre of the retaining wall to Portobello Road; thence south-westerly along the north-western side of Portobello Road to the point of commencement.
Also all that area in the Otago Land District, formerly part of the Otago Harbour, containing 38 acres, more or less, bounded by a line commencing at a point distant 379 links on a bearing of 158 degrees from the southern corner of Section 34 on D.P. 1992, Block LXI, Town of Dunedin; thence south-easterly along a line parallel to and 10 links on the seaward side of the centre of the retaining wall at the south-western end of the Otago Harbour to a point in line with the north-western side of Hillside Road; thence south-westerly, north-westerly, north-easterly, northerly, and north-easterly along the boundary of the City of Dunedin as described in N.Z. Gazette 1949, page 1724, to a point due north of the point of commencement; thence southerly to the point of commencement.
Also all that area in the Otago Land District being part of the Otago Harbour containing 60 acres, more or less, bounded by a line commencing at a point distant 360 links on a bearing of 163 degrees 21 minutes 46 seconds from Trig. Station EE at Black Jacks Point; thence south-westerly along a straight line to a point distant 530 links on a bearing of 133 degrees 48 minutes 10 seconds from the easternmost corner of Section 35, Block LXXV, Town of Dunedin; thence south-westerly along a straight line to a point distant 379 links on a bearing of 158 degrees from the southern corner of Section 34, D.P. 1992, Block LXI, Town of Dunedin; thence northerly to and north-easterly, northerly, and easterly along the boundary of the City of Dunedin as described in N.Z. Gazette 1949, page 1724, to the point of commencement.
