Allocating Land Taken for a Railway to the Purposes of a Street

A PROCLAMATION

Pursuant to section 226 of the Public Works Act 1928, I, Lieutenant-General Sir Charles Willoughby Moke Norrie, the Governor-General of New Zealand, hereby proclaim and declare that the land described in the Schedule hereto shall, upon the publication hereof in the New Zealand Gazette, become a street; and that the said street shall be under the control of the Palmerston North City Council and shall be maintained by the said Council in like manner as other public highways are controlled and maintained by the said Council.

SCHEDULE

Approximate area of the piece of land: 35·85 perches.
Being railway land. Situated in Block XI, Kairanga Survey District; City of Palmerston North. (S.O. 23393.)
In the Wellington Land District; as the same is more particularly delineated on the plan marked L.O. 13642 deposited in the office of the New Zealand Railways Commission at Wellington, and thereon coloured orange.

Given under the hand of His Excellency the Governor-General, and issued under the Seal of New Zealand, this 31st day of August 1955.

Pursuant to the Public Works Act 1928, I, Lieutenant-General Sir Charles Willoughby Moke Norrie, the Governor-General of New Zealand, hereby proclaim and declare that the additional land described in the Schedule hereto is hereby taken for the purposes of the Kaipara-Waikato Railway.

Authorizing the Laying Off of a Street Off McLeod Road in the Borough of Henderson, Subject to a Condition as to the Building Line

Pursuant to section 186 of the Municipal Corporations Act 1954 and section 125 of the Public Works Act 1928, His Excellency the Governor-General, acting by and with the advice and consent of the Executive Council, hereby authorizes the Henderson Borough Council to permit the laying off of the proposed street described in the Schedule hereto at a width for part of its length of less than 66 ft., but not less than 40 ft., subject to the condition that no building or part of a building shall at any time be erected on the land shown edged green on the plan marked P.W.D. 147742 referred to in the Schedule hereto within a distance of 15 ft. from the side line of the said street.

SCHEDULE

That proposed street in the North Auckland Land District, Borough of Henderson, containing by admeasurement 1 road 14·1 perches, more or less, being part Lot 1, D.P. 26261, being part Allotment 90, Parish of Waikomiti.
As the same is more particularly delineated on the plan marked P.W.D. 147742 deposited in the office of the Minister of Works at Wellington, and thereon coloured red.

Varying a Condition as to Setting Back the Building Line of Portion of Broadmore Street in the City of New Plymouth, Imposed by Order in Council Under the Municipal Corporations Amendment Act 1948 and the Public Works Act 1928

Pursuant to section 27 of the Public Works Amendment Act 1948, His Excellency the Governor-General, acting by and with the advice and consent of the Executive Council, hereby amends the Order in Council dated 21 January 1952, and published in Gazette, 24 January 1952, Vol. I, page 60, and registered in the Land Registry Office at New Plymouth under No. 1888, authorizing the laying off of streets (extensions of Broadmore Street) in the City of New Plymouth, subject to conditions as to the building lines, by varying the conditions as to the building lines imposed by the said Order in Council so that no building or part of a building shall at any time be erected on Lot 1, D.P. 7072, being part Section 67, Grey District, Block V, Paritutu Survey District, within a distance of 40 ft. from the centre lines of the said streets.

The Southern Side of Alfred Street, in the City of Christchurch, Exempted from the Provisions of Section 128 of the Public Works Act 1928

His Excellency the Governor-General in Council

Pursuant to section 128 of the Public Works Act 1928, His Excellency the Governor-General, acting by and with the advice and consent of the Executive Council, hereby approves of the resolution passed by the Christchurch City Council on the 8th day of August 1955, and set out in the First Schedule hereto, in so far as it affects the side of street described in the Second Schedule hereto.

FIRST SCHEDULE

The Christchurch City Council, being the local authority having control of the streets in the City of Christchurch, by resolution declares that the provisions of section 128, of the Public Works Act 1928, shall not apply to the southern side of Alfred Street adjoining part Town Reserve 66; being the whole of the land contained in certificates of title, Volume 62, folio 168, Volume 101, folio 233, Volume 83, folio 291, Volume 107, folio 59, Volume 105, folio 275.

SECOND SCHEDULE

The southern side of all that street in the Canterbury Land District, City of Christchurch, known as Alfred Street, fronting Lot 2, D.P. 17710, being part Town Reserves 66 and 14. As the same is more particularly delineated on the plan marked P.W.D. 147770 deposited in the office of the Minister of Works at Wellington, and thereon coloured red.
