Consenting to Raising of Loans by Certain Local Authorities

PURSUANT to the Local Government Loans Board Act 1926, His Excellency the Governor-General, acting by and with the advice and consent of the Executive Council, hereby consents to the borrowing by the local authorities mentioned in the Schedule hereto by way of loan of the whole or any part of the respective amounts specified in that Schedule.

Authorizing the Borrowing by the Mount Albert Borough Council by Way of Hypothecation of Debentures Issued in Respect of a Loan of Β£250,000

HIS EXCELLENCY THE GOVERNOR-GENERAL IN COUNCIL
WHEREAS by Order in Council made on the 25th day of January 1955, consent was given to the raising by the Mount Albert Borough Council (hereinafter called the said local authority) of an amount of fifty thousand pounds being portion of a loan of two hundred and fifty thousand pounds known as "Road Works and General Development Loan 1952":
And whereas the said local authority, pending the raising of the said amount of fifty thousand pounds, is desirous of borrowing the sum of fourteen thousand five hundred and forty pounds (hereinafter called the said sum) by hypothecation or mortgage pursuant to section 34 of the Local Bodies' Loans Act 1926 of the debentures authorized to be issued in respect of the said amount of fifty thousand pounds:
Now, therefore, pursuant to section 7 of the Local Authorities Interest Reduction and Loans Conversion Act 1932-33 and section 8 of the Local Authorities Interest Reduction and Loans Conversion Amendment Act 1933, His Excellency the Governor-General, acting by and with the advice and consent of the Executive Council, hereby consents to the said local authority borrowing the said sum or any part thereof by the hypothecation or mortgage of the said debentures to the State Advances Corporation of New Zealand at a rate of interest not exceeding four per cent per annum, such interest to be computed on the daily-debtor balances in the accounts of the Corporation, repayable on demand, but so that the term shall not exceed one year and hereby prescribes that the money borrowed by the hypothecation or mortgage of the said debentures shall, pending the raising of the said amount of fifty thousand pounds, be repaid by the annual or half-yearly instalment equivalent to the instalments of principal which would have been repaid if on the first day on which any money is borrowed by such hypothecation or mortgage the whole of the amount hereby authorized to be hypothecated or mortgaged had been raised on the conditions already determined under the Local Government Loans Board Act 1926.

FIRST SCHEDULE
THE Riccarton Borough Council, being the local authority having control of the streets in the Borough of Riccarton, by resolution declares that the provisions of section 128 of the Public Works Act 1928 shall not apply to the north-eastern side of Wise Street adjoining part Rural Section 113, situated in the Borough of Riccarton, and being all the land in certificate of title, Volume 140, folio 217, Canterbury Registry.

SECOND SCHEDULE
THE north-eastern side of all that street in the Canterbury Land District, Borough of Riccarton, known as Wise Street, fronting part Rural Section 113. As the same is more particularly delineated on the plan marked P.W.D. 147472 deposited in the office of the Minister of Works at Wellington, and thereon coloured red.

Declaring the Maihiihi Farm Settlement Road in the Otorohanga County to be County Road

ORDER IN COUNCIL
At the Government House at Wellington this 24th day of August 1955
Present:
HIS EXCELLENCY THE GOVERNOR-GENERAL IN COUNCIL
PURSUANT to section 112 of the Public Works Act 1928, His Excellency the Governor-General, acting by and with the advice and consent of the Executive Council, hereby orders and declares that the portion of road described in the Schedule hereto shall, on and after the date of this Order in Council, become county road.

SCHEDULE
ALL that portion of road in the South Auckland Land District, Otorohanga County, known as the Maihiihi Farm Settlement Road, situated in Block XII, Mangaorongo Survey District, commencing approximately 20 chains south of the western-most corner of Section 30 of the aforesaid Block XII, and proceeding thence in a south-easterly direction generally for a distance of approximately 61 chains and terminating at the southernmost corner of the aforesaid Section 30. (S.O. 37232.)
As the same is more particularly delineated on the plan marked P.W.D. 147554 deposited in the office of the Minister of Works at Wellington, and thereon coloured red and marked A-B.
