  1. Subject to the conditions set out in the Schedule hereto, the following provisions are hereby suspended in so far as they relate to work done or business conducted or services rendered in the said premises during the period of the exhibition by or on behalf of the bodies conducting the exhibition, or by or on behalf of any exhibitor at the exhibition, or by any person employed in or about the exhibition—namely, such of the provisions of—

(a) The Industrial Conciliation and Arbitration Act 1954, and all awards and industrial agreements in force thereunder;

(b) The Shops and Offices Act 1921-22; and

(c) The Factories Act 1946,—

as relate to the hours of commencing or ceasing work, or to the issue of permits for overtime or extended hours, or to holidays and half-holidays, or to the closing of shops.

SCHEDULE

  1. Eight hours shall constitute a day’s work in or about the exhibition, and, with the exception set out in clause 2 hereof, the hours shall be worked consecutively.

  2. No person shall be employed in or about the exhibition for more than four hours without an interval of at least three-quarters of an hour for a meal.

  3. Any person employed during any day in or about the exhibition who is employed on that day for more than eight hours, or before the hour of 8 a.m., or after the hour of 10.30 p.m. (whether the excess employment is in or about the exhibition or otherwise) shall be paid for the excess employment at not less than half as much again as the ordinary rate for the first two hours and at not less than twice the ordinary rate thereafter, and any person employed in or about the exhibition on any day that would, but for the provisions of this order, have been a whole holiday for that person by virtue of any Act or of any award or industrial agreement shall be paid for all work done on that day at not less than twice the ordinary rate, whether the work is performed wholly in or about the exhibition or otherwise.

  4. No male under eighteen years of age and no female shall be employed in or about the exhibition after the hour of 10.30 p.m.

  5. For the purposes of the enforcement of an award or industrial agreement any provision of which has been suspended by this order, any officer of the industrial union or association concerned who is authorized in writing in that behalf by the union or association shall be entitled to interview at his place of employment any person employed in or about the exhibition under that award or industrial agreement at such time or times as may be agreed upon between the officer and the employer of that person, and for this purpose any such officer shall be entitled at any time to have access to the Register of Passes issued by Wanganui Industrial Fairs Limited.

  6. Nothing in this order shall be deemed to affect any provisions in an award or industrial agreement requiring workers subject to the award or industrial agreement to be members of a union.

ORDER IN COUNCIL

PURSUANT to the Public Works Act 1928, His Excellency the Governor-General, acting by and with the advice and consent of the Executive Council, hereby makes the following order:

LICENCE

  1. This order may be cited as the Ohakune Borough Council Water Power and Electric Lines Licence 1955.

  2. Subject to the conditions hereinafter set forth, the Ohakune Borough Council (hereinafter referred to as the licensee) is hereby granted a licence to obstruct, impound, or divert the waters of the Mangawhero River (hereinafter referred to as the said stream), situated in the County of Waimarino, and to take and use therefrom for the purpose hereinafter set forth, a stream of water not exceeding 93 cubic feet per second, and to lay, construct, put up, place, and use the electric lines described in the First Schedule hereto.

  3. The conditions directed to be implied in all licences by the Water Power Regulations 1934 and the Electrical Supply Regulations 1935 shall be incorporated herein and shall form part of this licence, except in so far as they may be inconsistent with the provisions of this licence.

  4. This licence is issued under the Water Power Regulations 1934, and is subject thereto and to the Electrical Supply Regulations 1935, the Electrical Wiring Regulations 1935, the Radio Interference Regulations 1934, and to all regulations made in amendment thereof or in substitution therefor, except in so far as they may be inconsistent with the provisions of this licence.

  5. Water shall be used under this licence solely for the purpose of generating electricity, and shall be taken from the said stream at a point approximately 5 chains downstream from the railway bridge over the said stream in the Borough of Ohakune, the said point being more particularly indicated on the plan marked S.H.D. 320, deposited in the office of the State Hydro-electric Department at Wellington.

  6. The licensee is hereby authorized, subject to the conditions hereof, to construct, maintain, and use the works described in the Second Schedule hereto for the purpose of this licence, the positions of the said works being indicated on the said plan S.H.D. 320.

  7. The systems of supply shall be as described in paragraphs (a) and (f) of regulation 21-01 of the Electrical Supply Regulations 1935.

  8. For the purpose of assessing the rental or annual sum payable in respect of this licence, the licensee may install a suitable maximum-demand indicator to the satisfaction of the Inspecting Engineer of the State Hydro-electric Department, and failing such installation the rental shall be determined on the maximum capacity of the generating plant installed. The present plant is rated at 120 kilovolt-amperes.

  9. Nothing in this licence shall of itself be deemed to confer upon the licensee any right to water.

  10. This licence shall, unless sooner lawfully determined, continue in force until the 31st day of March 1975, provided that in so far as this licence operates as a licence to lay, construct, put up, place, and use electric lines within that part of Raetihi 3A Block, Block III, Makotuku Survey District, which is situated south-west of Tohanga Road, it shall continue in force until the date aforesaid or until a supply of electricity is available to the licensee’s consumers situated within the said part of Raetihi 3A Block from the Raetihi Borough Council, whichever is the earlier.

  11. The Orders in Council specified in the Third Schedule hereto authorizing the licensee to use water for the purpose of generating electricity and to erect and use certain electric lines are hereby revoked.

FIRST SCHEDULE

AREA OF SUPPLY

(a) Electric lines for the supply of electrical energy by the systems of supply hereinbefore described within the Borough of Ohakune, as at present constituted, and part of the County of Waimarino, being portions of Blocks 4, 8, and 12, Makotuku Survey District, and Blocks 5, 6, 9, 10, 11, 12, 13, 14, 15, and 16, and portion of Block 7, Karioi Survey District, the whole area being more particularly shown edged blue on the plan marked S.H.D. 294 deposited in the office of the State Hydro-electric Department at Wellington.

(b) Electric lines for the supply of electrical energy by the systems of supply hereinbefore described within part of the County of Waimarino being portions of Blocks 3 and 4, Makotuku Survey District, and Blocks 1, 2, 3, 4, and 8, and portion of Block 7, Karioi Survey District, the whole area being more particularly shown edged green on the said plan S.H.D. 294.

SECOND SCHEDULE

GENERAL DESCRIPTION OF GENERATING WORKS

(a) Headworks consisting of a dam and intake giving a static head of approximately 42 ft.

(b) A water race leading in a southerly direction from the intake aforesaid for a distance of approximately 32 chains to the powerhouse hereinafter referred to.

(c) Water turbines and a powerhouse with all necessary equipment for generating electricity situated on the left bank of the said stream.

(d) A tail race leading from the powerhouse aforesaid to the said stream.
