Licensing Lane and Sons, Limited, to Use and Occupy a Part of the Foreshore at Tametame, Whangaroa Harbour, as a Site for a Wharf

At the Government House at Wellington this 2nd day of August 1955

Present:

HIS EXCELLENCY THE GOVERNOR-GENERAL IN COUNCIL

PURSUANT to the Harbours Act 1950, His Excellency the Governor-General, acting by and with the advice and consent of the Executive Council, hereby licenses and permits Lane and Sons Limited, of Totara North (hereinafter called the company, which term shall include its successors or assigns, unless the context requires a different construction), to use and occupy a part of the foreshore and land below low-water mark at Tametame, Whangaroa Harbour, as shown on approved plan marked M.D. 674 and deposited in the office of the Marine Department at Wellington, for the purpose of maintaining thereon a wharf as shown on the said plan, such licence to be held and enjoyed by the company upon and subject to the terms and conditions set forth in the Schedule hereto.

SCHEDULE

(1) This licence is subject to the Foreshore Licence Regulations 1940, and the provisions of those regulations shall, so far as applicable, apply hereto.
(2) The term of the licence shall be fourteen years from the 24th day of July 1955.
(3) The premium payable by the company shall be two pounds (£2) and the annual sum so payable ten pounds (210).
(4) The master of every vessel discharging ballast at the said wharf shall deposit such ballast above high-water mark, or at such place as may be approved by the Minister or by any person appointed by the Minister for that purpose.

PURSUANT to the Public Works Act 1928, His Excellency the Governor-General, acting by and with the advice and consent of the Executive Council, hereby directs the sale of the land described in the Schedule hereto, the land being no longer required for the purpose for which it was acquired.

SCHEDULE

APPROXIMATE area of the piece of land directed to be sold: 2 roods 31 perches.

Being Lot 39, D.P. 1539, being part Section 13, Settlement of Eketahuna situated in the Borough of Eketahuna, and being the whole of the land comprised and described in certificate of title, Volume 222, folio 42, Wellington Land Registry.

Declaring Portions of Kokopu Farm Settlement Road in Block X, Purua Survey District, Whangarei County, to be County Road

PURSUANT to section 112 of the Public Works Act 1928, His Excellency the Governor-General, acting by and with the advice and consent of the Executive Council, hereby orders and declares that the portions of road described in the Schedule hereto shall, on and after the date of this Order in Council, become county road.

SCHEDULE

All those portions of road in the North Auckland Land District, Whangarei County, known as Kokopu Farm Settlement Road, commencing, firstly, from a public road at the western corner of Section 42, Block X, Purua Survey District, and proceeding thence in a south-easterly direction for a distance of approximately 88 chains and terminating at the southernmost corner of Section 47 of the aforesaid Block X, and

shown on the plan marked P.W.D. 147318 (S.O. 38387). Secondly, at the westernmost corner of Section 52, Block X, Purua Survey District, and proceeding thence in a south-easterly direction for a distance of approximately 33 chains and terminating at the southernmost corner of the aforesaid Section 52, and shown on the plan marked P.W.D. 147319 (S.O. 38385). Thirdly, at the westernmost corner of Section 55, Block X, Purua Survey District, and proceeding thence in a south-easterly direction for a distance of approximately 90 chains and terminating at the easternmost corner of Section 60 of the aforesaid Block X, and. shown on the plan marked P.W.D. 147320 (S.O. 38389).

As the same are more particularly delineated on the plans marked as above mentioned deposited in the office of the Minister of Works at Wellington, and thereon coloured red and marked A-B.

Authorising the Laying Off of Whitaker Place (Extension) in the City of Auckland, Subject to a Condition as to the Building Line

Present:

THE RIGHT HON. S. G. HOLLAND PRESIDING IN COUNCIL

PURSUANT to section 186 of the Municipal Corporations Act 1954, and section 125 of the Public Works Act 1928, His Excellency the Governor-General, acting by and with the advice and consent of the Executive Council, hereby authorizes the Auckland City Council to permit the laying off of the proposed street described in the Schedule hereto at a width of less than 66 ft., but not less than 40 ft., subject to the condition that no building or part of a building shall at any time be erected on the land shown edged green on the plan marked P.W.D. 147313 referred to in the Schedule hereto, within a distance of 33 ft. from the centre line of the said street.

SCHEDULE

That proposed street in the North Auckland Land District, City of Auckland, containing by admeasurement 10·2 perches, more or less, being part Allotment 6, Section 16, Suburbs of Auckland.

As the same is more particularly delineated on the plan marked P.W.D. 147313 deposited in the office of the Minister of Works at Wellington, and thereon coloured red.
