Authorizing Clarks Milling Company Limited to Use Water for the Purpose of Generating Electricity

HIS EXCELLENCY THE GOVERNOR-GENERAL IN COUNCIL
PURSUANT to the Public Works Act 1928, His Excellency the Governor-General, acting by and with the advice and consent of the Executive Council, hereby grants to Clarks Milling Company Limited, a duly incorporated company having its registered office at Oamaru (hereinafter referred to as the licensee), a licence, subject to the conditions hereinafter set forth, to take and use from the Kakanui River (hereinafter referred to as the said stream), situated opposite Lot 2 of Section 19, Block VII, Oamaru Survey District, in the County of Waitaki, for the purpose hereinafter set forth, a stream of water not exceeding 3 cubic feet per second at any one time.
CONDITIONS
IMPLIED CONDITIONS
- The conditions directed to be implied in all licences by the Water Power Regulations 1934 and the Electrical Supply Regulations 1935 shall be incorporated in and shall form part of this licence, except in so far as the same may be inconsistent with the provisions hereof.
LICENCE SUBJECT TO REGULATIONS
- This licence is issued under the Water Power Regulations 1934, and is subject thereto and to the Electrical Supply Regulations 1935, the Electrical Wiring Regulations 1935, the Radio Interference Regulations 1934, and to all regulations hereafter made in amendment thereof or in substitution therefor respectively.
UTILIZATION OF WATER AND LOCATION OF HEADWORKS
- Water shall be used under this licence solely for the purpose of generating electricity and shall be taken from the said stream at the point opposite Lot 2 of Section 19, Block VII, Oamaru Survey District, indicated on plan marked S.H.D. 322 deposited in the office of the State Hydro-electric Department at Wellington. The said water shall comprise a portion of the quantity of water that the licensee is authorized to take from the said stream pursuant to the Grant dated the 7th day of July 1955 issued to the licensee under section 308 of the Public Works Act 1928.
GENERAL DESCRIPTION OF WORKS
- The licence is hereby authorized, subject to the conditions hereof, to construct, maintain, and use the following works for the purpose of this licence, the positions of the said works being indicated on the said plan S.H.D. 322:
(a) Headworks consisting of a dam, intake, and water race leading to the turbines hereinafter referred to, giving a static head of approximately 16 ft.
(b) Turbines and generator with all necessary equipment for generating electricity, situated in Lot 1 of Section 21, Block VII, Oamaru Survey District.
(c) Tail race leading from the said turbines back to the said stream.
SYSTEM OF SUPPLY
- The system of supply shall be classified under paragraph (j) of regulation 21-01 of the Electrical Supply Regulations 1935, and shall be a direct current system of 110 volts.
DURATION OF LICENCE
- Unless sooner lawfully determined, this licence shall continue in force until the 31st day of March 1976.
RENTAL
- For the purpose of assessing the rental or annual sum payable in respect of this licence, the licensee may install a maximum-demand indicator to the satisfaction of the Inspecting Engineer of the State Hydro-electric Department, and failing such installation the rental shall be assessed on the maximum generating capacity of the plant installed, provided that payment by due date of rental under the said Grant dated the 7th day of July 1955 shall be deemed to constitute payment of rental under this licence. The present plant is rated at 2·5 kilowatts.
NO RIGHT TO WATER CONFERRED
- Nothing in this licence shall of itself confer upon the licensee any right to water.

Exempting Land in the Taranaki Land District from the Operation of Part III of the Coal Mines Act 1925

PURSUANT to the Coal Mines Act 1925, His Excellency the Governor-General hereby gives the following notice.
NOTICE
THE land described in the Schedule hereto is hereby exempted from the operation of Part III of the Coal Mines Act 1925.
SCHEDULE
ALL that parcel of land in the Taranaki Land District containing 1 rood 38 perches, more or less, being Lots 2 and 3 on a plan filed in the Head Office of the Mines Department at Wellington under File No. 6/6/34, being part of Section 16, Block X, Mapara Survey District, and part of the Rangitoto-Tuhua 70c No. 1 Block, and being part of the land in certificates of title, Volume 150, folio 83, and Volume 102, folio 235, Taranaki Registry, excepting thereout all coal on or under the surface of the land.
As witness the hand of His Excellency the Governor-General this 18th day of July 1955.
