PURSUANT to section 29 of the Public Works Amendment Act 1948, I, Lieutenant-General Sir Charles Willoughby Moke Norrie, the Governor-General of New Zealand, hereby proclaim as street the land described in the Schedule hereto.

SCHEDULE

APPROXIMATE area of the piece of land proclaimed as street: 2 roods 39·2005 perches.

Being Lots 24, 25, and 26, D.P. 17799, being part Rural Sections 4906 and 6087.

Situated in the Borough of Ashburton, Canterbury R.D.

Given under the hand of His Excellency the Governor-General, and issued under the Seal of New Zealand, this 11th day of July 1955.

The Southern Side of Portion of an Unnamed Street, in the Borough of Lyttelton, Exempted from the Provisions of Section 128 of the Public Works Act 1928, Subject to a Condition as to the Building Line

ORDER IN COUNCIL

At the Government House at Wellington this 13th day of July 1955

Present:

HIS EXCELLENCY THE GOVERNOR-GENERAL IN COUNCIL

PURSUANT to section 128 of the Public Works Act 1928, His Excellency the Governor-General, acting by and with the advice and consent of the Executive Council, hereby approves of the resolution passed by the Lyttelton Borough Council on the 22nd day of November 1954 and set out in the First Schedule hereto, in so far as it affects the side and portion of street described in the Second Schedule hereto, subject to the condition that no building or part of a building shall at any time be erected on the land fronting the southern side of the portion of unnamed street (described in the Second Schedule hereto) within a distance of 19 ft. 6 in. from the centre line of the said portion of street.

FIRST SCHEDULE

THE Lyttelton Borough Council, being the local authority having control of the streets in the Borough of Lyttelton, by resolution declares that the provisions of section 128 of the Public Works Act 1928 shall not apply to the southern side of the blind street which forms an intersection with and extends westward from the junction of College Road and Brenchley Road adjoining the northern boundary of all that piece of land situated in the Borough of Lyttelton, comprising one rood eleven perches (1r. 11p.), more or less, being part of Rural Section 1, and being the whole of the land in certificate of title, Volume 364, folio 13, Canterbury Registry.

SECOND SCHEDULE

THE southern side of all that portion of unnamed street situated in the Canterbury Land District, Borough of Lyttelton, fronting part Rural Section 1, Borough of Lyttelton. As the same is more particularly delineated on the plan marked P.W.D. 147055 deposited in the office of the Minister of Works at Wellington, and thereon coloured red.
