Consenting to Raising of Loans by Certain Local Authorities

Present:

THE RIGHT HON. S. G. HOLLAND PRESIDING IN COUNCIL

PURSUANT to the Local Government Loans Board Act 1926, His Excellency the Governor-General, acting by and with the advice and consent of the Executive Council, hereby consents to the borrowing by the local authorities mentioned in the Schedule hereto by way of loan of the whole or any part of the respective amounts specified in that Schedule.

PURSUANT to section 182 of the Counties Act 1920, His Excellency the Governor-General, acting by and with the advice and consent of the Executive Council, hereby confers on the Manukau County Council all the powers with respect to drainage and sanitation exercisable by a duly constituted Borough Council under section 103, Part XVI, and section 369 of the Municipal Corporations Act 1954, the said powers to be exercisable over the whole of the Manukau County.

Consenting to the Deposit of Moneys by Mount Albert Borough Council in Terms of Section 89 of the Municipal Corporations Act 1954

PURSUANT to section 89 of the Municipal Corporations Act 1954, His Excellency the Governor-General, acting by and with the advice and consent of the Executive Council, hereby authorizes the Mount Albert Borough Council to deposit moneys with the Auckland City Council, the Auckland Transport Board, the Auckland Metropolitan Fire Board, the Auckland Electric Power Board, and the Auckland Metropolitan Drainage Board, for any period or periods ending not later than the 31st day of March 1958.

Commission to Inquire into Accident on Board H.M.N.Z.S. Black Prince

To all to whom these presents shall come, and to LEONARD GEORGE HERSTON SINCLAIR, Esquire, Stipendiary Magistrate:

Greeting.

WHEREAS it is deemed expedient to appoint a Commission to inquire into the accident that happened on board Her Majesty’s New Zealand Ship Black Prince in Queen Charlotte Sound on the 23rd day of March 1955 and resulted in the deaths of two ratings in the ship, namely, Petty Officer Reginald Harry Tyler and Leading Seaman Raymond Joseph Currey, and also to inquire into the question whether proper steps were taken to inform all interested persons of the date, time, and place of the inquest into the deaths:

Now, therefore, pursuant to the Commissions of Inquiry Act 1908, I, Lieutenant-General Sir Charles Willoughby Moke Norrie, the Governor-General of New Zealand, acting by and with the advice and consent of the Executive Council, hereby appoint you, the said Leonard George Herston Sinclair, to be a Commission to inquire into and report upon—

(a) The cause of the accident;

(b) Whether any officer or rating of the Naval Forces, or any other person in the public service, at any time failed to exercise reasonable care, or to carry out any orders or instructions or procedure, or to fulfil any duty or responsibility according to the standard reasonably to be expected, or was guilty of any breach of discipline or other improper conduct, in relation to the accident or to the circumstances leading up to it;

(c) Whether the methods of disposing of demolition charges in operation on board the ship at the time of and before the accident were proper and reasonable for the work being undertaken;

(d) Whether the instructions given or in force and the preparation made were proper and sufficient for the work intended to be done;

(e) Whether a proper standard of order, control, and discipline was at all material times exercised over the company of the ship and over any other persons on board the ship in all matters relating to the accident;

(f) Whether the deaths of the said ratings or the death of either of them might or could have been prevented by the exercise of reasonable care by, or the carrying out of any orders or instructions or procedure by, or the fulfilling of any duty or responsibility resting upon, any officer or rating of the Naval Forces or any other person in the public service;

(g) Whether the work intended to be done by the said ratings was suitable having regard to their knowledge and experience, and whether there was sufficient supervision of their actions; and

(h) Whether proper steps were taken to inform all interested persons of the date, time, and place of the inquest,—and generally to inquire into and report upon such other
