Cancelling Conditions as to Setting Back the Building Line
of Portion of Water Lane in the City of New Plymouth,
Imposed by Order in Council and Memorandum of Acceptance
Under Section 128 of the Public Works Act 1928

THE RIGHT HON. K. J. HOLYOAKE PRESIDING IN COUNCIL

Pursuant to section 27 of the Public Works Amendment
Act 1948, His Excellency the Governor-General, acting by
and with the advice and consent of the Executive Council,
hereby amends the Order in Council dated 28 August 1946 and
published in the Gazette, 29 August 1946, Vol. II, page 1194,
and registered in the Land Registry Office at New Plymouth
under No. 1651, exempting, inter alia, the eastern side of
portion of Water Lane in the City of New Plymouth from the
provisions of section 128 of the Public Works Act 1928, subject
to a condition as to the building line, and also hereby amends
the memorandum of acceptance registered in the Land Registry
Office at New Plymouth under No. W. 6389, exempting, inter
alia, the eastern side of portion of Water Lane in the City of
New Plymouth from the provisions of section 128 of the
Public Works Act 1928, subject to a condition as to the
building line, by cancelling the conditions as to the building
line imposed by the said Order in Council and memorandum of
acceptance, in so far as they affect Lot 1, D.P. 6329, part
Section 177, Town of New Plymouth, being the whole of the
land comprised and described in certificate of title, Volume 157,
folio 94, and Lot 2, D.P. 6677, part Section 175, Town of New
Plymouth, being the whole of the land comprised and described
in certificate of title, Volume 164, folio 163, Taranaki Land
Registry.

The Northern and Western Sides of Portions of Water Lane
in the City of New Plymouth Exempted from the Provisions
of Section 128 of the Public Works Act 1928

ORDER IN COUNCIL

At the Government Buildings at Wellington this 15th day of
February 1955

Present:

THE RIGHT HON. K. J. HOLYOAKE PRESIDING IN COUNCIL

Pursuant to section 128 of the Public Works Act 1928,
His Excellency the Governor-General, acting by and with
the advice and consent of the Executive Council, hereby
approves of the resolution passed by the New Plymouth City
Council on the 20th day of September 1954, and set out in the
First Schedule hereto, in so far as it affects the sides and
portions of street described in the Second Schedule hereto.

FIRST SCHEDULE

THE New Plymouth City Council, being the local authority
having control of the streets in the City of New Plymouth, by
resolution declares that the provisions of section 128 of the
Public Works Act 1928 shall not apply:

(a) To the western side of the portion of Water Lane
adjoining Sections 174, 176, 178, and 180, Town of
New Plymouth, being all of the land in certificates of
title, Volume 104, folio 99, Volume 109, folio 244,
and Volume 110, folio 219, Taranaki Registry; nor

(b) To the northern side of the portion of Water Lane
adjoining Section 180, Town of New Plymouth.

SECOND SCHEDULE

THE northern side of all that portion of street situated in the
Taranaki Land District, City of New Plymouth, known as
Water Lane, fronting Section 180, Town of New Plymouth.

Also the western side of all that portion of the said street
in the said land district and city fronting Sections 174, 176,
178, and 180, Town of New Plymouth.

As the same are more particularly delineated on the plan
marked P.W.D. 145689 deposited in the office of the Minister
of Works at Wellington, and thereon coloured red.

Pursuant to the Public Works Act 1928, His Excellency
the Governor-General, acting by and with the advice
and consent of the Executive Council, hereby directs the sale
of the land described in the First and Second Schedules
hereto, together with the right of way appurtenant to the
land decribed in the Second Schedule hereto, over the part
shown as ‘‘right of way’’ on D.P. 1608, created by Memo-
randum of Transfer No. 53405, Wellington Land Registry,
the land and right of way being no longer required for the
purpose for which they were acquired.

APPROXIMATE area of the piece of land directed to be sold:
0·32 perches.

Being Lot 3, D.P. 17614, being part Lot 106B, D.P. 305,
and being part Section 20, Block VIII, Mangahao Survey
District.

Situated in the Borough of Pahiatua, and being part of the
land comprised and described in certificate of title, Volume
95, folio 240, Wellington Land Registry.

APPROXIMATE area of the piece of land directed to be sold:
15·87 perches.

Being Lot 2, D.P. 17643, being part Lot 1, D.P. 1608, and
being part Section 24 and part of a closed road, Eketahuna
Settlement.

Situated in the Borough of Eketahuna and being part of
the land comprised and described in certificate of title, Volume
150, folio 150, Wellington Land Registry.

Lieutenant E. W. Burtt, from the Reserve of Officers,
General List, The Royal N.Z. Artillery, to be Lieutenant,
