Tongariro National Park By-laws

PURSUANT to the National Parks Act 1952, the National Park Board hereby makes the following by-laws:

INTERPRETATION

  1. In these by-laws, unless inconsistent with the context—

‘‘Authorized person’’ means a person authorized by the Board:

‘‘Board’’ means the Tongariro National Park Board having the control and management of the park by virtue of the said Act:

‘‘Camping-site’’ means any area that may from time to time be set aside under section 28 (1) (i) of the said Act:

‘‘Chairman’’ means the Chairman of the Board:

‘‘Commissioner’’ means the Commissioner of Crown Lands for the Land District of Wellington:

‘‘Park’’ means the Tongariro National Park, being a national park under and subject to the National Parks Act 1952:

‘‘Park Ranger’’ or ‘‘Park Warden’’ means any person appointed as such by the Board under the powers of section 27 of the said Act:

‘‘Secretary’’ means the Secretary of the Board.

CAMPING

  1. (a) Within the area of the park situated within half a mile of Bruce Road no person shall camp except in such areas as may be set aside by the Board from time to time as camping areas.

(b) Outside the area of the park mentioned in the last preceding clause, no person shall camp within half a mile of a camping area set aside by the Board and marked as a camping area.

(c) The following conditions shall be strictly observed in connection with camping areas set aside by the Board and marked as camping areas:

(i) Persons using camping areas shall camp in such parts of the camping areas as an authorized person shall direct.

(ii) Fees and charges prescribed by the Board shall be paid to the secretary or an authorized person.

(d) The following conditions shall be strictly observed by all persons camping within the park whether within the camping areas or not:

(i) Subject generally to the provisions of by-law No. 4 relating to fires, combustible rubbish must be burned on camp-fires, and all other garbage and refuse of all kinds, including broken glass, bottles, tin cans, etc., must be placed in garbage cans, if available, or otherwise must be buried not less than 1 ft. deep by the campers in a place hidden from sight.

(ii) Camp sites shall be left clean and tidy after use and any turf which has been removed shall be carefully replaced.

(e) No person, whether camping in the park or otherwise being therein, shall pollute in any manner the waters of the park nor bathe in any of the streams near the regularly travelled thoroughfares in the park without suitable bathing costumes.

(f) No person, whether camping in the park or otherwise being therein, shall take any wood for fuel except from dead trees or from trees which have been cut for that purpose by the Board’s employees.

(g) No person, whether camping in the park or otherwise being therein, shall remove, disturb, cut names, letters, words, figures, or devices on, or deface any building, gates, bridges, natural features, or trees, or any object natural or otherwise, within the limits of the park.

(h) No person, whether camping in the park or otherwise being therein, shall in any building in the park act or use the same otherwise than in a cleanly and decent manner.

USE OF BOARD’S HUTS

  1. (a) Any person desiring to use the huts of the Board, other than the Blyth Hut (to which clause (b) of this by-law refers), shall apply to the manager of the Chateau Tongariro or an authorized person, who may in his discretion grant such applicant usage of the hut as he would deem advisable either exclusively or together with any other person or persons.

(b) Any person desiring the use of the hut of the Board known as the Blyth Hut at the head of the track from Ohakune shall apply to the Board’s representative at Ohakune or Raetihi who may grant the applicant usage as aforesaid.

(c) The restrictions on and conditions of usage of any huts or buildings shall be as fixed by the Board by resolution from time to time.

(d) A Park Ranger, or other officer of the Board, is empowered to terminate any usage of any such hut or building where the user has departed from the terms and conditions upon which usage was granted or where the user acts in such a manner as in the opinion of the Park Ranger or other officer of the Board is likely to cause damage to the Board’s property or to give offence to other persons or to cause them annoyance.

(e) No person shall use the huts in the vicinity of the Chateau without obtaining permission under clause (a) of this by-law.

(f) If any person shall use any hut of the Board other than those in the vicinity of the Chateau he shall give way to any person who has written authority to use the hut signed by any authorized person.

USE OF BUILDINGS ERECTED BY APPROVED ORGANIZATIONS

3A. Should any organization be empowered to erect any buildings for accommodation of its members within the park it shall be subject to the condition that if such accommodation is not in the opinion of the Board being made reasonable use of by such members, then other persons may be authorized by the Board to make use of such accommodation under whatever conditions the Board may determine.

FIRES

  1. (a) No person shall light any fire within the area mentioned in clause (a) of by-law No. 2 except within a camping area set aside by the Board or in a fireplace erected by the Board.

(b) No person shall kindle a fire near trees or dead wood, moss, dry leaves, grass, tussock, forest mould, or other vegetation, but a fire may be lit in a specially prepared open place on rocks or earth. Should camps or picnic places be located in a locality where no such open place exists, or is provided, any dead wood, moss, dry leaves, grass, tussock, forest mould, or other vegetation must be scraped away down to the rock or earth over an area considerably larger than that required for the fire. Fires shall be lighted only when necessary, and when no longer needed shall be completely extinguished by covering all embers and the bed with earth and water so that there remains no possibility of the fire reviving.

(c) No person shall light a fire in any position where it is likely to present a fire hazard.

(d) Once a fire is lit, the person lighting the fire, or such other person as is detailed by him, shall remain in attendance on the fire until it is completely extinguished.

(e) No match (lighted or not lighted), cigarette, or other lighted matter shall be dropped, thrown, or otherwise placed in any grass or other inflammable material.

(f) Nothing in this by-law shall exempt an offender from liability under the National Parks Act 1952 or any other Act with respect to the lighting of fires.

TRADING AND INTOXICATING LIQUORS

  1. No person shall reside permanently, engage in any business, sell or offer for sale any article of food or merchandise, intoxicating liquor, or any kind of drink, or carry on any other pursuit or calling within the park without the written consent of the Board given subject to such terms and conditions as it deems fit.

MISBEHAVIOUR

  1. Within the park no person shall wilfully obstruct, disturb, or interfere with any other person in the use or enjoyment of the park, or use foul, abusive, indecent, or obscene language, or be intoxicated, noisy, or riotous, or in any way misbehave.

ANIMALS

  1. No person shall take any dog or cat into the park without the written permission of the Board, or abandon in the park any dog, cat, or animal.

NOTICES

  1. No person shall interfere with any placard, sign, or notice erected by the Board in or relating to the park.

AIRCRAFT

  1. Except on any licensed airfield, no person shall make use of any part of the park for the purpose of the landing thereon or flying therefrom of any aeroplane or of any kind of aircraft, or glider, except in case of emergency or in accordance with the prior written permission of the Board.

ENTRY INTO SPECIAL AREAS

  1. For the purpose of this by-law a special area means a special area set apart by the Governor-General under section 12 of the National Parks Act 1952.

No person shall enter a special area except with the written permission of the Board or the Commissioner as the case may require, given subject to such terms and conditions as are deemed fit. Every such permit shall include the following particulars and conditions.

  1. The duration of the permit shall be specifically stated therein.

  2. The names of all persons covered by the permit shall be set out.

  3. The area covered by the permit shall be specified therein.

  4. No permit shall include a right to camp or remain overnight, or light camp fires unless the permit so states.

  5. Each permit shall be revocable at the pleasure of the Board or Commissioner as the case may be.

GENERAL

  1. All previous by-laws made by the Board are hereby revoked.

Nothing in these by-laws shall be deemed to limit or prevent the taking of proceedings under any Act in respect of any offence committed within the park.

The foregoing by-laws were made by resolution of the Board at its meeting held at Chateau Tongariro on the 10th day of July 1954.
