Boundaries of Borough of Ashburton and County of Ashburton Altered

ORDER IN COUNCIL

At the Government Buildings at Wellington this 11th day of November 1954

Present:

THE HON. W. J. BROADFOOT PRESIDING IN COUNCIL

WHEREAS, pursuant to section 136 of the Municipal Corporations Act 1933, a petition was presented to the Governor-General praying that a certain area of land be excluded from the County of Ashburton and included in the Borough of Ashburton:

And whereas, pursuant to section 24 of the Local Government Commission Act 1946, the said petition was referred to the Local Government Commission:

And whereas, pursuant to the Local Government Commission Act 1953, the Local Government Commission has made inquiry into the proposal and has approved as final a scheme bearing date the 13th day of July 1954 providing for the exclusion of the area described in the Schedule to the said scheme from the County of Ashburton and the inclusion of that area in the Borough of Ashburton:

And whereas it is deemed expedient to give effect to the final scheme as hereinafter appearing:

Now, therefore, pursuant to the Local Government Commission Act 1953, His Excellency the Governor-General, acting by and with the advice and consent of the Executive Council, hereby declares that as on and from the 1st day of April 1955 the area described in the Schedule hereto shall be excluded from the County of Ashburton and included in the Borough of Ashburton, and, with the like advice and consent, hereby also declares that the alteration of boundaries of the said county and the said borough hereinbefore made shall be deemed to have been effected under the Municipal Corporations Act 1954.

SCHEDULE

ALL that area in the Wakanui Riding of the County of Ashburton commencing at a point on the boundary of the Borough of Ashburton on the southern side of Brucefield Avenue and being the northernmost corner of Lot 35, D.P. 2198; thence south-easterly along the south-western boundary of Reserve 2644 to and across Bridge Street and along the south-western side of Taurangi Road to a point distant 250 links from the south-eastern side of Bridge Street; thence south-westerly by a line parallel to and 250 links distant from the south-eastern side of Bridge Street to the westernmost corner of Lot 6, D.P. 13311; thence south-easterly along the south-western boundary of Lot 6, D.P. 13311 aforesaid, to the north-western boundary of Lot 1, D.P. 10505; thence south-westerly along that boundary to the northernmost corner of Lot 2, D.P. 10505; thence south-easterly along the north-eastern boundary of Lot 2, D.P. 10505 aforesaid, and its production to the north-western boundary of Lot 1, D.P. 11462; thence north-easterly along the north-western boundary of Lot 1, D.P. 11462 aforesaid, to its northernmost corner; thence again south-easterly along the north-eastern boundaries of Lots 1, 2, and 3, D.P. 11462, to the easternmost corner of the last-mentioned lot; thence by a right line to the northernmost corner of Lot 4, D.P. 11462; thence along the north-eastern boundaries of Lots 4 and 5, D.P. 11462, to the north-western boundary of Lot 6, D.P. 988 (all being part Rural Section 5800), being 250 links distant from the north-eastern side of Princes Street, thence south-westerly along that boundary to the north-eastern side of Princes Street, being a point on the boundary of the Borough of Ashburton; thence northerly generally along the boundary of the Borough of Ashburton, along Princes Street, Bridge Street, Kitchener Street, and Brucefield Avenue, to the point of commencement.

FIRST SCHEDULE

THE Wellington City Council, being the local authority having control of the streets in Wellington City, by resolution declares that the provisions of section 128 of the Public Works Act 1928 shall not apply to the western side of the portion of William Street adjoining Lot 41, and part Lot 42, D.P. 168, being all (or part) of the land in certificate of title, Volume 45, folio 299, Wellington Registry, as is more particularly shown on the plan annexed hereto.

SECOND SCHEDULE

THE western side of all that portion of street situated in the Wellington Land District, City of Wellington, known as William Street, fronting Lot 41 and part Lot 42, D.P. 168. As the same is more particularly delineated on the plan marked P.W.D. 143615, deposited in the office of the Minister of Works at Wellington, and thereon coloured red.

The Southern Side of Portion of Ruskin Street, in the City of Auckland, Exempted from the Provisions of Section 128 of the Public Works Act 1928, Subject to a Condition as to the Building Line

At the Government Buildings at Wellington this 11th day of November 1954

Present:

THE HON. W. J. BROADFOOT PRESIDING IN COUNCIL

PURSUANT to section 128 of the Public Works Act 1928,

His Excellency the Governor-General, acting by and with the advice and consent of the Executive Council, hereby approves of the resolution passed by the Auckland City Council on the 8th day of July 1954, and set out in the First Schedule hereto, in so far as it affects the side and portion of street described in the Second Schedule hereto, subject to the condition that no building or part of a building shall at any time be erected on the land fronting the southern side of the portion of Ruskin Street (described in the Second Schedule hereto) within a distance of 25 ft. from the centre line of the said portion of street.

FIRST SCHEDULE

THE Auckland City Council, being the local authority having control of the streets in the City of Auckland, by resolution declares that the provisions of section 128 of the Public Works Act 1928 shall not apply to the southern side of Ruskin Street fronting Lots 1 and 2 of a subdivision of portion of Allotment 70, Section 1, City of Auckland, and being all the land contained and comprised in certificate of title, Volume 584, folio 157, Auckland Registry.

SECOND SCHEDULE

THE southern side of all that portion of street situated in the North Auckland Land District, City of Auckland, known as Ruskin Street, fronting part Allotment 70, Section 1, Suburbs of Auckland, situated in the City of Auckland. As the same is more particularly delineated on the plan marked P.W.D. 144831 deposited in the office of the Minister of Works at Wellington, and thereon coloured red.

Authorizing the Laying-off of Torbay Street off Brooklands Road in the City of New Plymouth, Subject to a Condition as to the Building Line

At the Government Buildings at Wellington this 11th day of November 1954

Present:

THE HON. W. J. BROADFOOT PRESIDING IN COUNCIL

PURSUANT to section 15 of the Municipal Corporations Amendment Act 1953 and section 125 of the Public Works Act 1928, His Excellency the Governor-General, acting by and with the advice and consent of the Executive Council, hereby authorizes the New Plymouth City Council to permit the laying-off of the proposed street described in the Schedule hereto at a width for part of its length of less than 66 ft., but not less than 40 ft., subject to the condition that no building or part of a building shall at any time be erected on Lots 5, 6, 7, 13, 14, and 15 of a subdivision of the land shown edged green on the plan marked P.W.D. 145026, referred to in the Schedule hereto, within a distance of 35 ft. from the centre line of the said street.

SCHEDULE

THAT proposed street in the Taranaki Land District, City of New Plymouth, to be known as Torbay Street, containing by admeasurement 1 rood 4 perches, more or less, being part Lot 2, D.P. 6520, being part Section 47, Fitzroy District, situated in Block V, Paritutu Survey District.

As the same is more particularly delineated on the plan marked P.W.D. 145026 deposited in the office of the Minister of Works at Wellington, and thereon coloured red.

PURSUANT to section 128 of the Public Works Act 1928,

His Excellency the Governor-General, acting by and with the advice and consent of the Executive Council, hereby approves of the resolution passed by the Wellington City Council on the 9th day of December 1953, and set out in the First Schedule hereto, in so far as it affects the side and portion of street described in the Second Schedule hereto, subject to the condition that no building or part of a building shall at any time be erected on the land fronting the western side of the portion of William Street (described in the Second Schedule hereto) within a distance of 25 ft. from the centre line of the said portion of street.
