Revoking Order in Council Licensing Anthony Connelly to Use and Occupy Foreshore at Omaraiti Point, Hicks Bay, as a Site for a Breakwater, Jetty, and Mooring Jetties

At the Government House at Wellington this 13th day of October 1954

Present:

HIS EXCELLENCY THE GOVERNOR-GENERAL IN COUNCIL

WHEREAS by Order in Council dated the 6th day of August 1952 and published in the Gazette of the 14th day of the same month, at page 1355, Anthony Connelly was licensed to use and occupy a part of the foreshore and land below low-water mark at Omaraiti Point, Hicks Bay, as a site for a breakwater, jetty, and mooring jetties:

And whereas the said Anthony Connelly has not erected the breakwater, jetty, or mooring jetties and has applied to have the hereinbefore-recited Order in Council revoked, and it is desirable to revoke the said Order in Council:

Now, therefore, pursuant to the provisions of the Harbours Act 1950, His Excellency the Governor-General, acting by and with the advice and consent of the Executive Council, hereby revokes as from the 1st day of April 1954 the hereinbefore-recited Order in Council.

PURSUANT to section 53 of the Harbours Act 1950, His Excellency the Governor-General, acting by and with the advice and consent of the Executive Council, hereby authorizes the Wellington Harbour Board to invest the sum of ten thousand pounds (£10,000) of the Employers’ Liability Fund in the debentures of the Wellington City Council Loan 1954, for a term of ten years at 4 per cent, maturing in 1964.

Present:

HIS EXCELLENCY THE GOVERNOR-GENERAL IN COUNCIL

PURSUANT to the Harbours Act 1950, His Excellency the Governor-General, acting by and with the advice and consent of the Executive Council, hereby licenses and permits Blue Bird Taxis Limited (hereinafter called the company, which term shall include its successors or assigns, unless the context requires a different construction) to use and occupy a part of the foreshore and land below low-water mark at Dargaville, in Kaipara Harbour, as shown on the plan marked M.D. 7978 and deposited in the office of the Marine Department at Wellington, for the purpose of maintaining a ramp thereon as shown on the said plan, such licence to be held and enjoyed by the company upon and subject to the terms and conditions set forth in the Schedule hereto.

SCHEDULE
CONDITIONS

  1. This licence is subject to the Foreshore Licence Regulations 1940, and the provisions of those regulations shall, so far as applicable, apply hereto.

  2. The premium payable by the company shall be two pounds (£2), and the annual sum so payable five pounds (£5).

  3. The term of the licence shall be fourteen years from the 1st day of June 1954.

Present:

HIS EXCELLENCY THE GOVERNOR-GENERAL IN COUNCIL

PURSUANT to the Harbours Act 1950, His Excellency the Governor-General, acting by and with the advice and consent of the Executive Council, hereby licences and permits the Waitemata Towing Company Limited (hereinafter called the company, which term shall include its successors or assigns, unless the context requires a different construction) to use and occupy a part of the foreshore and land below low-water mark at Lagoon Bay, in Takatu Peninsula, as shown on the plan marked M.D. 9689 and deposited in the office of the Marine Department at Wellington, for the purpose of erecting and maintaining bins for holding shingle thereon as shown on the said plan, such licence to be held and enjoyed by the company upon and subject to the terms and conditions set forth in the Schedule hereto.

SCHEDULE

PURSUANT to the Public Works Act 1928, His Excellency the Governor-General, acting by and with the advice and consent of the Executive Council, and with the consent of the licensee, hereby revokes the Order in Council dated the 28th day of January 1948 and published in the New Zealand Gazette on the 29th day of the same month, at page 108, authorizing Edward August Gibb, of Franz Josef Glacier, Waiho, Farmer, to use water for the purpose of generating electricity.

Authorizing the Laying-off of Lynbrooke Avenue in the City of Auckland and in the Borough of Mount Roskill, Subject to a Condition as to the Building Line

THE HON. T. CLIFTON WEBB PRESIDING IN COUNCIL

PURSUANT to section 15 of the Municipal Corporations Amendment Act 1953 and section 125 of the Public Works Act 1928, His Excellency the Governor-General, acting by and with the advice and consent of the Executive Council, hereby authorizes the Auckland City Council and the Mount Roskill Borough Council to permit the laying-off of the proposed street described in the Schedule hereto at a width for part of its length of less than 66 ft., but not less than 54 ft., subject to the condition that no building or part of a building shall at any time be erected on the land shown edged green on the plan marked P.W.D. 144683, referred to in the Schedule hereto, within a distance of 42 ft. from the centre line of the said street.

SCHEDULE

THAT proposed street in the North Auckland Land District, City of Auckland and the Borough of Mount Roskill, containing by admeasurement 1 acre 2 roods 26 perches, more or less, being part Lots 1, 2, and 3, D.P. 20689, part Lot 5, D.R.O. Plan 835, and part Lot 1, D.P. 12970, all being part Allotments 75 and 74, Parish of Titirangi.

As the same is more particularly delineated on the plan marked P.W.D. 144683 deposited in the office of the Minister of Works at Wellington, and thereon coloured red.
