Consenting to the Raising of Portion (£80,000) of the Nelson Harbour Board’s Loan of £500,000 and Prescribing the Conditions Thereof

At the Government House at Wellington this 8th day of September 1954
Present:
HIS EXCELLENCY THE GOVERNOR-GENERAL IN COUNCIL
WHEREAS the Nelson Harbour Board (hereinafter called the said local authority), being desirous of raising a loan of five hundred thousand pounds, to be known as Nelson Harbour Board Empowering Act 1948 Loan 1949 (hereinafter called the said loan), for the purpose of carrying out the works authorized by the Nelson Harbour Board Empowering Act 1948, has complied with the provisions of the Local Government Loans Board Act 1926 (hereinafter called the said Act):
And whereas consent has already been given to the raising of portions of the said loan amounting in the aggregate to two hundred and ninety-five thousand pounds:
And whereas the said local authority is now desirous of raising a further portion of the said loan amounting to eighty thousand pounds (hereinafter called the said sum), and it is expedient that the precedent consent of the Governor-General in Council, as required by the said Act, should be given to the raising of the said sum:
Now, therefore, pursuant to section 11 of the said Act, as set out in section 29 of the Finance Act 1932 (No. 2), His Excellency the Governor-General, acting by and with the advice and consent of the Executive Council, hereby consents to the raising in New Zealand by the said local authority of the said sum for the said purpose up to the amount of eighty thousand pounds, and in giving such consent hereby determines as follows:

The term for which the said sum or any part thereof may be raised shall be fifteen years.

The rate of interest that may be paid in respect of the said sum or any part thereof shall be such as shall not produce to the lender or lenders a rate or rates exceeding four per cent. per annum.

The said sum or any part thereof shall be repaid by the annual redemption of debentures in the years set out in the first column of the Schedule hereunder of the amounts stated opposite each such year in the second column of the said Schedule.

The payment of interest and redemptions in respect of the said sum shall be made in New Zealand.

No amount payable either as interest or as a redemption in respect of the said sum shall be paid out of loan money.

The rate payable for brokerage, underwriting, and procuration fees in respect of the raising of the said sum or any part thereof shall not in the aggregate exceed three-quarters per cent. of any amount raised.

No money shall be borrowed under this consent after the expiration of two years from the date hereof.

Appointing Principal Authorities for the Election of Members of the Taranaki Harbour Board by the Electors of Combined Districts

HIS EXCELLENCY THE GOVERNOR-GENERAL IN COUNCIL
WHEREAS by the First Schedule to the Harbours Act 1950 provision is made, inter alia, for the election of members of the New Plymouth Harbour Board:
And whereas by Order in Council dated the 18th day of October 1950 and published in the Gazette of the 19th day of the same month, at page 1862, provision is made for the appointing of principal authorities for the election of members of Harbour Boards by the electors of combined districts:
And whereas by the Taranaki Harbour Board Act 1954 the name of the New Plymouth Harbour Board was changed to the name of the Taranaki Harbour Board and the constitution of the Taranaki Harbour Board was altered:
And whereas it is desirable to amend the hereinbefore-recited Order in Council of the 18th day of October 1950 and to make provision for the appointment of principal authorities for the purpose of the election of members to the Taranaki Harbour Board by the electors of the combined districts of that Board:
Now, therefore, pursuant to the Harbours Act 1950 and the Taranaki Harbour Board Act 1954, His Excellency the Governor-General, acting by and with the advice and consent of the Executive Council, hereby amends the hereinbefore-recited Order in Council of the 18th day of October 1950 by omitting so much of the Schedule thereto as relates to the New Plymouth Harbour Board, and hereby selects and appoints the local authorities set forth in the second column of the Schedule hereto to be the respective principal authorities for the combined districts set forth in the first column of that Schedule for the purposes of the elections under the said Acts of certain members to the Taranaki Harbour Board.

Exempting Land in the Southland Land District from the Operation of Part III of the Coal Mines Act 1925

PURSUANT to the Coal Mines Act 1925, His Excellency the Governor-General hereby gives the following notice.
NOTICE

The land described in the Schedule hereto is hereby exempted from the operation of Part III of the Coal Mines Act 1925.

The notice dated the 31st day of May 1954 published in the Gazette of the 10th day of June 1954, No. 36, at page 983, exempting land from the operation of the said Part III is hereby revoked.
SCHEDULE
All that piece of land situated in the Wairoa Survey District containing 1 rood 2-3 perches, more or less, being Lot 30, D.P. 4361, being part of Section 94, Block III, Wairoa Survey District, and being part of the land comprised in certificate of title, Volume 155, folio 103, Southland Registry; excepting, however, all mines, seams, and beds of coal now lying in or under the said piece of land.
As witness the hand of His Excellency the Governor-General this 16th day of September 1954.
