Present:

HIS EXCELLENCY THE GOVERNOR-GENERAL IN COUNCIL

PURSUANT to the Public Works Act 1928, His Excellency the Governor-General, acting by and with the advice and consent of the Executive Council, hereby grants to Nathan Nathaniel Harvey, of Clova Bay, Havelock, Sheep Farmer (hereinafter referred to as the licensee), a licence, subject to the conditions hereinafter set forth, to take and use from two unnamed streams (hereinafter referred to as the said streams), situated in Section 2, Block IX, Orieri Survey District, for the purpose hereinafter set forth, a stream of water not exceeding 1 cubic foot per second at any one time, and to lay, construct, put up, place, and use the electric lines hereinafter described.

CONDITIONS

IMPLIED CONDITIONS

  1. The conditions directed to be implied in all licences by the Water Power Regulations 1934 and the Electrical Supply Regulations 1935 shall be incorporated in and shall form part of this licence, except in so far as the same may be inconsistent with the provisions hereof.

LICENCE SUBJECT TO REGULATIONS

  1. This licence is issued under the Water Power Regulations 1934, and is subject thereto, and to the Electrical Supply Regulations 1935, the Electrical Wiring Regulations 1935, the Radio Interference Regulations 1934, and to all regulations hereafter made in amendment thereof or in substitution therefor respectively.

UTILIZATION OF WATER AND LOCATION OF HEADWORKS

  1. Water shall be used under this licence solely for the purpose of generating electricity, and shall be taken from the said streams at the point in Section 2, Block IX, Orieri Survey District, indicated in the plan marked S.H.D. 290, deposited in the office of the State Hydro-electric Department at Wellington.

GENERAL DESCRIPTION OF WORKS

  1. The licensee is hereby authorized, subject to the conditions hereof, to construct, maintain, and use the following works for the purpose of this licence, the position of the said works being indicated on the said plan S.H.D. 290.

(a) Headworks consisting of an intake, water-race, and dam, with a pipe line leading to the powerhouse, hereinafter referred to, giving a static head of approximately 350 ft.

(b) A Pelton wheel and powerhouse, with all necessary equipment for generating electricity, situated in part 2 of Section 27, Block IX, Orieri Survey District.

(c) A tail race leading from the aforesaid powerhouse to an unnamed stream.

(d) Electric lines leading from the aforesaid powerhouse as follows:

(1) In a south-easterly direction to a house situated in part 2 of Section 27, aforesaid.

(2) In a south-westerly direction to a shed with a branch line leading in a south-easterly direction to another house situated in part 2 of Section 27, aforesaid.

(3) In a north-westerly direction to a house situated in Section 2, aforesaid.

The said lines being more particularly shown by red lines on the aforesaid plan S.H.D. 290.

SYSTEM OF SUPPLY

  1. The system of supply shall be classified under paragraph (j) of regulation 21-01 of the Electrical Supply Regulations 1935, and shall be a direct-current system at a pressure of 110 volts.

DURATION OF LICENCE

  1. Unless sooner lawfully determined this licence shall continue in force until the 31st day of March 1960.

RENTAL

  1. For the purpose of assessing the rental or annual sum payable in respect of this licence, the licensee may install a suitable maximum-demand indicator to the satisfaction of the Inspecting Engineer of the State Hydro-electric Department, and failing such installation the rental shall be assessed on the maximum generating capacity of the plant installed. The present plant is rated at 5 kilowatts.

NO RIGHT TO WATER CONFERRED

  1. Nothing in this licence shall of itself confer upon the licensee any right to water.

Consenting to the Raising of Loans by Certain Local Authorities and Prescribing the Conditions Thereof

ORDER IN COUNCIL

At the Government House at Wellington, this 14th day of July 1954

Present:

HIS EXCELLENCY THE GOVERNOR-GENERAL IN COUNCIL

WHEREAS the several local authorities enumerated in the Schedule hereto, being desirous of raising the respective loans stated opposite their names therein, have respectively complied with the provisions of the Local Government Loans Board Act 1926 (hereinafter called the said Act) and it is expedient that the precedent consent of the Governor-General in Council, as required by the said Act, should be given to the raising of the said loans:

Now, therefore, pursuant to section 11 of the said Act, as set out in section 29 of the Finance Act 1932 (No. 2), His Excellency the Governor-General, acting by and with the advice and consent of the Executive Council, hereby consents to the raising in New Zealand by the respective local authorities mentioned in the first column of the said Schedule of the respective loans set out in the second column of the said Schedule, up to the respective amounts specified in the third column of the said Schedule, and in giving such consent hereby determines as follows:

  1. The terms for which the said loans or any parts thereof may be raised shall not exceed the respective terms (in years) stated in the fourth column of the said Schedule.

  2. The rate of interest that may be paid in respect of the said loans or any parts thereof shall be such as shall not produce to the lender or lenders a rate or rates exceeding four per cent per annum.

  3. The said respective loans or any parts thereof, together with interest thereon, shall be repaid by equal aggregate annual or half-yearly instalments extending over the respective terms as determined in clause 1 hereof.

  4. The payment of all such instalments shall be made in New Zealand, and no such instalment shall be paid out of loan money.

  5. The rate payable for brokerage, underwriting, and procuration fees in respect of the raising of the said respective loans or any parts thereof shall not in the aggregate exceed one-half per cent of any amount raised.

  6. No money shall be borrowed under this consent after the expiration of two years from the date hereof.
