FIRST SCHEDULE

THE Onehunga Borough Council, being the local authority having control of the streets in the Borough of Onehunga, by resolution declares that the provisions of section 128 of the Public Works Act 1928 shall not apply to the western side of the portion of Catherine Street adjoining all that parcel of land containing nineteen decimal six perches (19Β·6 p.), more or less, being Lots 3, 4, and 12 of Section l on Deeds Plan No. 1387, being part Allotment 6 of Section 22, Village of Onehunga, and being the whole of the land in certificate of title, Volume 593, folio 47 (Auckland Registry), limited as to parcels.

SECOND SCHEDULE

THE western side of all that portion of street situated in the North Auckland Land District, Borough of Onehunga, known as Catherine Street, fronting Lots 3, 4, and 12, Deeds Plan 1387, being part Allotment 6, section 22, Village of Onehunga.

As the same is more particularly delineated on the plan marked P.W.D. 143787, deposited in the office of the Minister of Works at Wellington, and thereon coloured red.

The North-western Side of Parenga Street, in the Borough of Dargaville, Exempted From the Provisions of Section 128 of the Public Works Act 1928

Pursuant to section 128 of the Public Works Act 1928, His Excellency the Governor-General, acting by and with the advice and consent of the Executive Council, hereby approves of the resolution passed by the Dargaville Borough Council on the 20th day of April 1954 and set out in the First Schedule hereto, in so far as it affects the side and portion of street described in the Second Schedule hereto.

THE Dargaville Borough Council, being the local authority having control of the roads in the Borough of Dargaville, by resolution declares that the provisions of section 128 of the Public Works Act 1928 shall not apply to the north-western side of Parenga Street adjoining parts of Tunatahi Block, being the land in Volume 717, folio 91; Volume 890, folio 285; Volume 169, folio 211; Volume 868, folio 126; Volume 1024, folio 79; Volume 723, folio 240 (Auckland Registry).

SECOND SCHEDULE

THE north-western side of all that street situated in the North Auckland Land District, Borough of Dargaville, known as Parenga Street, fronting subdivision of parts of Tunatahi Block.

As the same is more particularly delineated on the plan marked P.W.D. 143764, deposited in the office of the Minister of Works at Wellington, and thereon coloured red.

The Western Side of Portion of an Unnamed Street, in the Borough of Gore, Exempted from the Provisions of Section 128 of the Public Works Act 1928

Pursuant to section 128 of the Public Works Act 1928, His Excellency the Governor-General, acting by and with the advice and consent of the Executive Council, hereby approves of the resolution passed by the Gore Borough Council on the 27th day of April 1954, and set out in the First Schedule hereto, in so far as it affects the side and portion of street described in the Second Schedule hereto.

THE Gore Borough Council, being the local authority having control of the streets in the Borough of Gore, by resolution declares that the provisions of section 128 of the Public Works Act 1928 shall not apply to the western side of the portion of street adjoining Sections 7 and 8, Block XXIII, Town of Gore, being all of the land in certificate of title, Volume 102, folio 300 (Southland Land Registry).

SECOND SCHEDULE

THE western side of all that portion of an unnamed street situated in the Southland Land District, Borough of Gore, fronting a subdivision of Sections 7 and 8, Block XXIII, Town of Gore. As the same is more particularly delineated on the plan marked P.W.D. 143746, deposited in the office of the Minister of Works at Wellington, and thereon coloured red.

Pursuant to section 128 of the Public Works Act 1928, His Excellency the Governor-General, acting by and with the advice and consent of the Executive Council, hereby approves of the resolution passed by the Wellington City Council on the 9th day of December 1953, and set out in the First Schedule hereto, in so far as it affects the side and portion of street described in the Second Schedule hereto.

FIRST SCHEDULE

THE Wellington City Council, being the local authority having control of the streets in the Wellington City, by resolution declares that the provisions of Section 128 of the Public Works Act 1928 shall not apply to the northern side of the portion of Tapiri Street adjoining Lot 56 and part Lot 42, D.P. 168, being all (or part) of the land in certificates of title, Volume 42, folio 239, Volume 45, folio 299 (Wellington Registry), as is more particularly shown on the plan annexed hereto.

SECOND SCHEDULE

THE northern side of all that portion of street situated in the Wellington Land District, City of Wellington, known as Tapiri Street, fronting Lot 56 and part Lot 42, D.P. 168.

As the same is more particularly delineated on the plan marked P.W.D. 143616, deposited in the office of the Minister of Works at Wellington, and thereon coloured red.

Consenting to the Raising of Loans or Portions Thereof by the Napier City Council and Prescribing the Conditions Thereof

ORDER IN COUNCIL

At the Government House at Wellington, this 7th day of July 1954

Present:

His Excellency The Governor-General In Council

WHEREAS the Napier City Council (hereinafter called the said local authority), being desirous of raising the respective loans set out in the first column of the Schedule hereto, has complied with the provisions of the Local Government Loans Board Act 1926 (hereinafter called the said Act), and it is expedient that the precedent consent of the Governor-General in Council, as required by the said Act, should be given to the raising of the said loans:

Now, therefore, pursuant to section 11 of the said Act, as set out in section 29 of the Finance Act 1932 (No. 2), His Excellency the Governor-General, acting by and with the advice and consent of the Executive Council, hereby consents to the raising in New Zealand by the said local authority of the respective loans set out in the first column of the said Schedule, up to the respective amounts specified in the second column of the said Schedule, and in giving such consent hereby determines as follows:

  1. The term for which the said loans or any parts thereof may be raised shall be ten years.

  2. The rate of interest that may be paid in respect of the said loans or any parts thereof shall be such as shall not produce to the lender or lenders a rate or rates exceeding four per cent per annum.

  3. The said local authority shall, before raising the said respective loans or any parts thereof, make provision for the repayment thereof by establishing sinking funds under the Local Bodies' Loans Act 1926, or under such other statutory enactment as may be applicable in any respective case, and shall thereafter make payments to such sinking funds at intervals of not more than one year, at a rate or rates per cent which shall be not less than three pounds twelve shillings and sevenpence, such payments to be made in respect of every part of the said respective loans for the time being so borrowed and not repaid, the first such payment in each respective case to be made not later than one year after the first day from which interest to the lender or lenders is computed on any loan or part thereof so raised.
