Amending the Description in a Warrant Reserving Land in North Auckland Land District for Public Buildings of the General Government

PURSUANT to the Land Act 1948, and of every other power and authority enabling him in that behalf, the Minister of Lands hereby amends the description in the Schedule to a Warrant dated the 23rd day of September 1949, and published in New Zealand Gazette No. 57, of the 29th day of that month, by substituting the description of the reserve set forth in the Schedule hereto for the description of the reserve set forth in the Schedule to the said Warrant.

NORTH AUCKLAND LAND DISTRICT

Lots 11, 12, and 13, Town of Kohukohu Extension, situated in Block X, Mangamuka Survey District: Area, 23·49 perches, more or less. (S.O. plan 26205.)

Revoking Part of a Warrant Declaring Areas to be Closely Populated Localities and Declaring Area to be a Closely Populated Locality for the Purposes of the Transport Act 1949, Section 36

———

PURSUANT to section 36 of the Transport Act 1949, the Minister of Transport hereby revokes that portion of the Warrant dated the 1st day of December 1937,* which relates to an area at Wakefield, and hereby declares the area described in the Schedule hereto to be a closely populated locality for the purposes of the said section to the intent that a person driving any motor-vehicle on any road therein shall be subject to the maximum speed limit of thirty miles an hour fixed by the said section.

SCHEDULE

SITUATED within Waimea County—

All that area at Wakefield consisting of—

  1. Nelson–Westport State Highway No. 54 (all that portion commencing at a point 10 chains measured along the said highway in a westerly direction from its junction with Pitfure Road and terminating at a point 5 chains measured along the said State highway generally in a south-westerly direction from the southern boundary of the Wakefield Domain).

  2. Wakefield–Woodstock Main Highway No. 252 (all that portion commencing at its junction with the Nelson–Westport State Highway No. 54 and terminating at the western end of the Wai-iti River Bridge).

  3. Edwards Street (all that portion commencing at its junction with the Nelson–Westport State Highway No. 54 and terminating at the junction of Edwards Street and Pitfure Road).

  4. Arrow Street.

  5. Pitfure Road (all that portion commencing at its junction with Edwards Street and terminating at a point 9 chains measured along Pitfure Road generally in a south-westerly direction from its junction with the Nelson–Westport State Highway No. 54).

Declaring Area to be a Closely Populated Locality for the Purposes of the Transport Act 1949, Section 36

———

PURSUANT to section 36 of the Transport Act 1949, the Minister of Transport hereby declares the area described in the Schedule hereto to be a closely populated locality for the purposes of the said section to the intent that a person driving any motor vehicle on any road therein shall be subject to the maximum speed limit of thirty miles an hour fixed by the said section.

SITUATED within Ohinemuri County—

All those roads at Waihi Beach, including all that portion of the Waihi Beach Main Highway No. 465, commencing at a point 33 chains measured generally in a south-westerly direction along the said main highway from its junction with Leo Street and terminating at a point opposite the north-western corner of Section 1, Block V, Waihi Beach Township.

Declaring Trailer Units Forming Part of a Multi-axled Motor Vehicle to be Trailers

PURSUANT to subsection (1) of section 2 of the Transport Act 1949, the Minister of Transport hereby determines that the vehicles specified in the Schedule hereto, forming part of multi-axled vehicles as defined by section 2 of the said Act, shall be deemed to be trailers.

PURSUANT to regulation 5 of the Motor Drivers Regulations 1940, the Minister of Transport hereby approves of the persons named in Column 2 of the Schedule hereunder as Testing Officers under the said regulations for the Authority specified in Column 1 of the said Schedule.

Assent to Agreement for Grant of Easement in Favour of Harold Stapleton Barry, of Auckland, Butcher, Over Land in Block IV, Waitemata Survey District, Taken for a Post Office

———

WHEREAS by an agreement dated the 22nd day of March 1954, Harold Stapleton Barry, of Auckland, Butcher, being the registered proprietor of an estate in fee simple in that piece of land in the North Auckland Land District containing 1 rood 0·3 perch, more or less, being Lot 21, Block I, D.P. 10801, being part Allotment 189, Parish of Takapuna, and being the whole of the land comprised and described in certificate of title, Volume 422, folio 82 (Auckland Land Registry), agreed to grant Her Majesty the Queen the right to discharge septic tank effluent through the field tiles situated on the said land:

And whereas the said Harold Stapleton Barry is entitled to receive compensation for the granting of such rights:

And whereas by the said agreement the Minister of Works has agreed to grant to the said Harold Stapleton Barry the right to discharge sewage in the manner set out in the said agreement into pipes constructed in that piece of land in the North Auckland Land District containing 1 rood 0·3 perch, more or less, being Lot 20, Block I, D.P. 10801, being part Allotment 189, Parish of Takapuna, and being the whole of the land comprised and described in Proclamation No. 10192 (Auckland Land Registry) taking land for a post office:

And whereas the said Harold Stapleton Barry has agreed to accept such grant of easement in full satisfaction of the said compensation:

Now, therefore, the Minister of Works doth hereby give notice, pursuant to section 97 of the Public Works Act 1928, that he assents to the agreement hereinbefore referred to.

Notice of Intention to Take Additional Land in Block IX, Tauranga Survey District, for a Public School

———

NOTICE is hereby given that it is proposed, under the provisions of the Public Works Act 1928, to take the additional land described in the Schedule hereto for a public school; and notice is hereby further given that the plan of the land required to be taken is deposited in the post office at Tauranga and is there open for inspection; and that all persons affected by the taking of the said land should, if they have any well-grounded objections to the taking of such land, set forth the same in writing and send such writing, within forty days from the first publication of this notice, to the Minister of Works at Wellington.

APPROXIMATE area of the piece of additional land required to be taken: 2 acres 2 roods.

Being part Allotment 9, Parish of Te Puna.

Situated in Block IX, Tauranga Survey District (Auckland R.D.).

In the South Auckland Land District; as the same is more particularly delineated on the plan marked P.W.D. 143397, deposited in the office of the Minister of Works at Wellington, and thereon edged red.
