HIS EXCELLENCY THE GOVERNOR-GENERAL IN COUNCIL

Pursuant to section 112 of the Public Works Act 1928,
His Excellency the Governor-General, acting by and
with the advice and consent of the Executive Council, hereby
orders and declares that the portions of road described in the
Schedule hereto shall, on and after the date of this Order
in Council, become Government road.

SCHEDULE

APPROXIMATE areas of the pieces of road declared to be
Government road:

A. R. P. Adjoining or passing through
2 0 36 Sections 9, 96, and Crown land, Block II.
6 2 16 Sections 84, 95, 116, 117, and Crown land, Block
II, and Crown land, Block V.
3 2 23 Sections 11, 13, 15, 17, 19, and Crown land, Block
IV, and Sections 13, 138, and Crown land,
Block I.

Situated in Teviot Survey District (Otago R.D.).

Authorizing the Laying-off of Donald Lane, in the Borough
of Cambridge, Subject to a Condition as to the Building
Line

HIS EXCELLENCY THE GOVERNOR-GENERAL IN COUNCIL

Pursuant to section 15 of the Municipal Corporations
Amendment Act 1953 and section 125 of the Public
Works Act 1928, His Excellency the Governor-General, acting
by and with the advice and consent of the Executive Council,
hereby authorizes the Cambridge Borough Council to lay-off
the proposed street described in the Schedule hereto at a
width for the whole of its length of less than 66 ft., but not
less than 40 ft., subject to the condition that no building or
part of a building shall at any time be erected on Lots 2, 3,
and 4 of a subdivision of the land fronting the said street as
shown on the plan marked P.W.D. 143300, referred to in the
Schedule hereto within a distance of 35 ft. from the centre-
line of the said street.

SCHEDULE

That proposed street in the South Auckland Land District,
Borough of Cambridge, to be known as Donald Lane, con-
taining by admeasurement 2 roods 11·25 perches, more or
less, being part Allotments 556, 557, and 558, Town of
Cambridge East.

As the same is more particularly delineated on the plan
marked P.W.D. 143300, deposited in the office of the Minister
of Works at Wellington, and thereon coloured red.

Directing Sale of Railway Land at Fernhill Under the Public
Works Act 1928

HIS EXCELLENCY THE GOVERNOR-GENERAL IN COUNCIL

Pursuant to the Public Works Act 1928, His Excellency
the Governor-General, acting by and with the advice and
consent of the Executive Council, hereby directs the sale of
the land described in the Schedule hereto, such land being
no longer required for the public work for which it was taken.

ALL that parcel of land containing 3 acres 17 perches, more or
less, being parts of Sections 3, 4, and 5, and part closed road,
Block VII, Dunedin and East Taieri District, and being all
the land comprised and described in certificate of title, Volume
279, folio 23 (Otago Registry).

Consenting to the Raising of the Balance (£21,000) of the
Mount Eden Borough Council’s Loan of £38,000 and
Prescribing the Conditions Thereof

HIS EXCELLENCY THE GOVERNOR-GENERAL IN COUNCIL

Whereas the Mount Eden Borough Council (hereinafter
called the said local authority), being desirous of
raising a loan of thirty-eight thousand pounds to be known
as Streets Restoration Loan 1953 for the purpose of meeting
the said local authority’s share of the cost of restoring and
surfacing Dominion Road and Mount Eden Road, after
removal of tram tracks, including the resurfacing of railway
bridges, has complied with the provisions of the Local Govern-
ment Loans Board Act 1926 (hereinafter called the said
Act):

And whereas by Order in Council made on the 22nd day
of December 1953 consent was given to the raising of portion
of the said loan amounting to seventeen thousand pounds:

And whereas the said local authority is now desirous of
raising the balance of the said loan amounting to twenty-one
thousand pounds (hereinafter called the said sum), and it is
expedient that the precedent consent of the Governor-General
in Council, as required by the said Act, should be given to
the raising of the said sum:

Now, therefore, pursuant to section 11 of the said Act,
as set out in section 29 of the Finance Act 1932 (No. 2), His
Excellency the Governor-General, acting by and with the
advice and consent of the Executive Council, hereby consents
to the raising in New Zealand by the said local authority of
the said sum for the said purpose up to the amount of
twenty-one thousand pounds, and in giving such consent
hereby determines as follows:

  1. The term for which the said sum or any part thereof
    may be raised shall be ten years.

  2. The rate of interest that may be paid in respect of
    the said sum or any part thereof shall be such as shall not
    produce to the lender or lenders a rate or rates exceeding
    four per cent per annum.

  3. The said sum or any part thereof shall be repaid as
    follows:

(a) By twenty equal payments of six hundred and sixty-
eight pounds five shillings and ninepence each,
one of such payments to be made at the end of
every half-year commencing from the date on
which the said sum is raised. Each such half-yearly
payment shall be applied firstly in payment of
interest computed at the rate of four per cent per
annum on the amount of principal for the time
being outstanding at the beginning of each such
half-year and the balance of such half-yearly
payment in reduction of principal.

(b) By a payment at the end of the tenth year from the
date of the raising of the said sum of an amount
equal to the amount to which the said principal
has been reduced in accordance with the preceding
paragraph (a) hereof after payment of the afore-
said twenty half-yearly payments.

  1. The payments referred to in clause 3 hereof shall be
    made in New Zealand and no such payment shall be made
    out of loan money.

  2. The rate payable for brokerage, underwriting, and
    procuration fees in respect of the raising of the said sum
    or any part thereof shall not in the aggregate exceed one-half
    per cent of any amount raised.

  3. No money shall be borrowed under this consent after
    the expiration of two years from the date thereof.
