ALL that area of approximately 3,850 acres, bounded by a line commencing at a point in Block VIII, Waitemata Survey District, being the easternmost corner of Allotment 245, Takapuna Parish, and running north-westerly along the north-eastern boundary of the said Allotment 245 to its intersection with a right line running parallel to and 250 links distant in a westerly direction from the western side of Old Wade Road; thence northerly generally along right lines running parallel to and 250 links distant from, the western side of the said Old Wade Road to the south-western boundary of Lot 1 on D.P. 39462, being part of Allotment 248, Takapuna Parish aforesaid; thence along a right line across that road, to and along the south-western boundaries of Lots 11, 12, and 13 on D.P. 36257, being parts of Allotment 237, Takapuna Parish aforesaid, along the south-western boundaries of Lots 6, 5, 4, and 3 on D.P. 40110, being parts of the said Allotment 237, and along the south-western, western, and north-western boundaries of Lot 2 on D.P. 40110 aforesaid, being part of the said Allotment 237, to a right line running parallel to, and 250 links distant in a westerly direction from, the generally western side of the Takapuna-Silverdale Main Highway (East Coast Road); thence northerly generally along right lines running parallel to, and 250 links distant from, the western and south-western sides of that main highway, to and along right lines parallel to, and 250 links distant from, the south-western side of the road forming the north-eastern boundaries of Allotments E.197, M.197, and N.W.197, Takapuna Parish, and Allotments 442 and 441, Paremoremo Parish, to Rosedale Road; thence along a right line across Rosedale Road, to and along the south-western boundaries of Lots 17, 16, and 15 on D.P. 39437, being parts of Allotment 437, Paremoremo Parish aforesaid, the western boundary of Lot 14 on D.P. 39437 aforesaid, being parts of the said Allotment 437-and-of Allotment 438, Paremoremo Parish, aforesaid, the western boundaries of Lots 13, 12, 11, 10, 9, 8, 7, 6, 5, 4, 3, 2, and 1 on the said D.P. 39437,-being parts of the said Allotment 438, the south-western boundaries of Lots 15, 14, 13, and 12 on D.P. 37510, being parts of the aforesaid Allotment 438, and along a right line to and along the south-western boundaries of Lots 10, 9, 8, 7, 6, 5, 4, 3, 2, and 1 on D.P. 37510 aforesaid, being parts of the said Allotment 438, to and along the north-western boundary of the last-mentioned Lot 1, to its northernmost corner; thence along a right line across the Takapuna-Silverdale Main Highway aforementioned, to the southern corner of Lot 9 on D.P. 40585 (now public road dedicated by Transfer 530023), being part of Allotment 251, Takapuna Parish aforementioned; thence northerly generally along the generally eastern side of the aforementioned main highway, to and along the generally south-eastern and southern sides of Glenvar Road, to a point on the eastern boundary of Lot 1 on D.P. 36089, being part of Allotment 189, Takapuna Parish aforementioned; thence along a right line across Glenvar Road aforesaid to and along the southern boundaries of part of Allotment 36 and of Allotment 37, of Okura Parish, crossing the two intersecting public roads, to the line of mean high water of the Hauraki Gulf; thence southerly generally along that line of mean high water to the north-eastern corner of Lot 3 on D.P. 29875, being part of Allotment 190, Takapuna Parish aforementioned; thence westerly along the northern boundaries of the said Lot 3 and of Lot 1 on D.P. 29875 aforesaid, being part of Allotment 190 aforesaid to Beach Road; thence along a right line across Beach Road to the southern corner of Lot 18 on D.P. 27647, being parts of the said Allotment 190 and of Allotment 267 of Takapuna Parish aforesaid; thence north-westerly along the north-eastern boundary of Lot 1 on D.P. 30028, being parts of the aforesaid Allotments 190 and 267 to its northernmost corner; thence south-westerly along the south-eastern boundary of Allotment 250, Takapuna Parish aforesaid, along a right line across the Takapuna-Silverdale Main Highway aforementioned, to and along the south-eastern boundary of Allotment 249 of Takapuna Parish aforesaid, and along a right line across Old Wade Road aforementioned, to the easternmost corner of Allotment 245 Takapuna Parish aforesaid, the point of commencement.

Constituting Napier United Urban Fire District

ORDER IN COUNCIL

At the Government Buildings at Wellington, this 23rd day of February 1954

Present:

THE RIGHT HON. K. J. HOLYOAKE PRESIDING IN COUNCIL

WHEREAS, pursuant to sections 18 and 21 of the Fire Services Act 1949, the local authorities whose districts or part of whose districts are included in the Napier Urban Fire District, the Taradale Secondary Urban Fire District, and the Bay View Secondary Urban Fire District made application for the abolition of the said fire districts and for the constitution of the area comprising the said fire districts, together with a further portion of the County of Hawke's Bay, as a united urban fire district:

And whereas, pursuant to the said section 18, the Fire Service Council has certified that the appropriate standards for a united urban fire district have been complied with:

And whereas, pursuant to section 24 of the Local Government Commission Act 1946, the said applications were referred to the Local Government Commission:

And whereas, pursuant to the Local Government Commission Act 1946, the Local Government Commission has recommended that action be taken pursuant to the Fire Services Act 1949 to give effect to the said applications:

Now, therefore, pursuant to the Fire Services Act 1949, His Excellency the Governor-General, acting by and with the advice and consent of the Executive Council, hereby orders and declares:

  1. That from the 31st day of March 1954, the Napier Urban Fire District, the Taradale Secondary Urban Fire District, and the Bay View Secondary Urban Fire District shall be abolished.

  2. That on the 1st day of April 1954, the areas described in the Schedule hereto shall be constituted a united urban fire district by the name of the Napier United Urban Fire District.

  3. That the number of members to be elected to represent the Councils of the City of Napier, the Borough of Taradale, and the County of Hawke's Bay on the Board of the district hereby constituted shall be three, who shall be elected in the following manner:

(a) Two members by resolution of the Napier City Council.

(b) One member by resolution of either the Hawke's Bay County Council or the Taradale Borough Council in accordance with the following procedure, viz.:

(i) At the first election of members of the Fire Board the Hawke's Bay County Council shall by resolution elect one member of the Board from candidates nominated by the County Council and the Taradale Borough Council.

(ii) At the triennial election of members of the Fire Board to be held in the month of February 1957, and at every alternate triennial election held thereafter, the Taradale Borough Council shall by resolution elect one member of the Board from candidates nominated as aforesaid.

(iii) At the triennial election of members of the Fire Board to be held in the month of February 1960, and at every alternate triennial election held thereafter, the Hawke's Bay County Council shall by resolution elect one member of the Board from candidates nominated as aforesaid.

(iv) In the event of any member elected under any of the foregoing provisions vacating office before the expiry of his term of office as a member of the Fire Board, the extraordinary vacancy so created shall be filled by resolution of the Council which elected that member, pursuant to section 27 of the Fire Services Act 1949.

  1. Notwithstanding anything contained in section 53 of the Fire Services Act 1949, the amounts to be paid by the uniting local authorities to the Fire Board of the District hereby constituted in the first year of the Board's operations shall be as follows:

(a) Hawke's Bay County Council, £500.

(b) Taradale Borough Council, £400.

(c) Napier City Council, the difference between £900 and 40 per cent of the estimates of the said Board as approved by the Fire Service Council.

NAPIER UNITED URBAN FIRE DISTRICT

ALL that area comprising the City of Napier.

Also, all that area comprising the Borough of Taradale.

Also, all that portion of Hawke's Bay County bounded by a line commencing at a point on the sea-coast where the northern bank of the Esk River meets the high-water mark of the ocean; thence proceeding generally westerly along the northern bank of that river to its intersection with the centre-line of the Waipunga Road; thence southerly along the middle of that road to the Taupo-Napier State Highway; thence easterly along the middle of that highway to the Hedgeley Road; thence generally south-westerly along the middle of that road to the Seafield Road; thence easterly along the Seafield Road to a public road forming the northern
