Altering and Redefining the Boundaries of the Redcliff Rabbit District (Notice No. Ag. 5521)

At the Government House at Wellington, this 21st day of October 1953

Present:

HIS EXCELLENCY THE GOVERNOR-GENERAL IN COUNCIL

PURSUANT to the Rabbit Nuisance Act 1928 and to section 29 of the Rabbit Nuisance Amendment Act 1947, His Excellency the Governor-General, at the request of the Minister of Agriculture made on the recommendation of the Rabbit Destruction Council, and acting by and with the advice and consent of the Executive Council, hereby—

  1. Alters and redefines the boundaries of the Redcliff Rabbit District by adding thereto the areas of land the boundaries of which are described in the First Schedule hereto.

  2. Declares that the boundaries of the said district as so altered and redefined shall be those set forth in the Second Schedule hereto.


FIRST SCHEDULE

BOUNDARIES OF THE AREAS TO BE ADDED TO THE REDCLIFF RABBIT DISTRICT

FIRST, all that area in the Waimate County, in the Canterbury Land District, containing 4,600 acres, more or less, commencing at a point on the northern boundary of the Redcliff Rabbit District, the said point being the westernmost corner of Rural Section 18848, situated in Block III, Elephant Hill Survey District; thence proceeding north-easterly along Zig Zag Road, to and south-easterly generally along Buchanans Road and Serpentine Valley Road and following the southern boundary of the Waihaorunga Rabbit District (N.Z. Gazette No. 33, 2 June 1949, page 1291) to its junction with the northern boundary of the Redcliff Rabbit District (N.Z. Gazette No. 6, 10 February 1944, pages 105–6) near Waihao Downs Railway Station; thence westerly generally along the northern boundary of the said Redcliff Rabbit District to the westernmost corner of Rural Section 18848, the point of commencement.

Secondly, all that area in the Waimate County in the Canterbury Land District, containing 6,400 acres, more or less, commencing at a point on the eastern boundary of the Upper Waihao Rabbit District (N.Z. Gazette No. 62, 2 December 1948, page 1479) the said point being the easternmost corner of R.S. 26329, situated in Block I, Elephant Hill Survey District; thence proceeding south-easterly along the road forming the north-eastern boundary of Section 1, Block I, Elephant Hill Survey District (Takitu Settlement), to the western boundary of the Redcliff Rabbit District (N.Z. Gazette No. 6, 10 February, 1944, pages 105–6); thence southerly generally along the western boundary of Redcliff Rabbit District to the southernmost corner of Section 1, Block VI, Elephant Hill Survey District (Takitu Settlement), being the junction with the Upper Waihao Rabbit District; thence north-westerly and north-easterly along the boundary of the Upper Waihao Rabbit District to the point of commencement.


SECOND SCHEDULE

BOUNDARIES OF THE REDCLIFF RABBIT DISTRICT

ALL that area in the County of Waimate, of the Canterbury Land District, containing 55,000 acres, more or less, bounded by a line commencing at a point at the intersection of the left bank of the Waitaki River with the north-western boundary of Rural Section 22389, in Block VI, Elephant Hill Survey District; thence proceeding in a north-easterly direction along the said north-western boundary of R.S. 22389, to and north-westerly along the south-western boundaries of S.G. Runs 83 and 82, to and north-easterly along the north-western boundaries of S.G. Runs 82 and 81 and the south-eastern boundary of R.S. 26329 to a public road (the boundary of the Upper Waihao Rabbit District follows this boundary from the starting point to the last point mentioned); thence generally in an easterly direction along this road and Zig Zag Road, to and south-easterly along Buchanans Road, to and south-easterly along Serpentine Valley Road to its junction with Elephant Hill Road at Waihao Downs Railway Station; thence easterly along the main highway (Waihao Downs–Waimate Road) to the right bank of the Waihao River at Waihao Forks; thence along the said right bank of that river to the north-eastern boundary of R.S. 20184 (the boundary of the Waihaorunga Rabbit District follows this boundary from the intersection of Serpentine Valley Road and Bridge Road to the last-named point); thence generally in a southerly direction along the said north-eastern boundary of R.S. 20184, to and along the main highway (Waihao Downs–Waimate Road), to and continuing generally southerly along

Mount Harris Road, to and along the Cock and Hen Road to the Middle Road at the south-west corner of Section 3, Block IX, Waikakahi Settlement; thence south-easterly along the said Middle Road and the Glenavy-Redcliff Road to its junction with a public road at the north-eastern corner of Lot 110 of Reserve 642 in Block XIV, Waitaki Survey District; thence southerly along the said public road to the left bank of the Waitaki River; thence north-westerly generally along the said left bank of that river to the point of commencement.

Authorizing John Andrew Paterson, of Titirangi, Havelock, Sheep Farmer, to use Water for the Purpose of Generating Electricity

Present:

HIS EXCELLENCY THE GOVERNOR-GENERAL IN COUNCIL

PURSUANT to the Public Works Act 1928, His Excellency the Governor-General, acting by and with the advice and consent of the Executive Council, hereby grants to John Andrew Paterson (hereinafter referred to as the licensee) a licence, subject to the conditions hereinafter set forth, to take and use from an unnamed stream (hereinafter referred to as the said stream) situated in Section 1, Block IX, Gore Survey District, for the purpose hereinafter set forth, a stream of water not exceeding 1 cubic foot per second at any one time.


CONDITIONS

IMPLIED CONDITIONS

  1. The conditions directed to be implied in all licences by the Water-power Regulations 1934 and the Electrical Supply Regulations 1935 shall be incorporated in and shall form part of this licence, except in so far as the same may be inconsistent with the provisions hereof.

LICENCE SUBJECT TO REGULATIONS

  1. This licence is issued under the Water-power Regulations 1934, and is subject thereto and to the Electrical Supply Regulations 1935, the Electrical Wiring Regulations 1935, the Radio Interference Regulations 1934, and to all regulations hereafter made in amendment thereof or in substitution therefor respectively.

UTILIZATION OF WATER AND LOCATION OF HEADWORKS

  1. Water shall be used under this licence solely for the purpose of generating electricity and shall be taken from the said stream at the point in Section 1, Block IX, Gore Survey District, indicated on the plan marked S.H.D. 260, deposited in the office of the State Hydro-electric Department at Wellington.

GENERAL DESCRIPTION OF WORKS

  1. The licensee is hereby authorized, subject to the conditions hereof, to construct, maintain, and use the following works for the purpose of this licence, the positions of the said works being indicated on the said plan S.H.D. 260:

(a) Headworks consisting of an intake with a pipe-line leading to the power-house hereinafter referred to, giving a static head of approximately 270 ft.

(b) A pelton wheel and power-house with all necessary equipment for generating electricity, situated in Section 1, Block IX, Gore Survey District.

(c) A tail-race leading from the aforesaid power-house back to the said stream.

SYSTEM OF SUPPLY

  1. The system of supply shall be classified under paragraph (j) of regulation 21–01 of the Electrical Supply Regulations 1935, and shall be a direct current system of 110 volts.

DURATION OF LICENCE

  1. Unless sooner lawfully determined, this licence shall continue in force until the 31st day of March 1974.

RENTAL

  1. For the purpose of assessing the annual rental payable in respect of this licence, the licensee may install a suitable maximum-demand indicator to the satisfaction of the Inspecting Engineer of the State Hydro-electric Department, and failing such installation the rental shall be assessed on the maximum generating capacity of the plant installed. The present plant is rated at 3 kilowatts.

NO RIGHT TO WATER CONFERRED

  1. Nothing in this licence shall of itself confer upon the licensee any right to water.
