Licensing Control Commission—Awarding Compensation to Owners

TAKE notice that, pursuant to the provisions of the Licensing Amendment Act 1948, the Commission has awarded the following amount of compensation to Ernest Arthur Turnbull, the owner, consequent upon the cancellation of the publican's licence in respect of the premises shown below:

Railway Hotel at Middlemarch—

Ernest Arthur Turnbull, care of Messieurs Ross, Meade, and Dowling, Solicitors, Princes Street, Dunedin, as owner, the sum of £1,595.

And further take notice that no person (other than the above-named person and other than a person claiming lien as mortgagee) shall be entitled to receive the compensation or make any claim in respect of the compensation awarded unless notice in writing of such claim, stating whether compensation is claimed by him as owner or as licensee, is lodged with the Commission within six weeks of the 8th day of October 1953, being the date of publication of this notice in the Gazette; and further take notice that any mortgagee from an owner or licensee shall, upon giving written notice to the Commission within one month after the 8th day of October 1953 aforesaid, have a lien on the amount of compensation payable to the mortgagor for the amount of the mortgage debt and any interest or other charges owing to the mortgagee under or in respect of the mortgage.

Regulations Respecting the Blue Ensign of H.M. Fleet (Naval Reserve Flag)

QUEEN'S REGULATIONS AND ADMIRALTY INSTRUCTIONS (ARTICLE 126)

WITH reference to clause 1 (c) of the above regulations as published in the New Zealand Gazette No. 65, dated 9 October 1952, the definition of the term ‘‘Reservists’’ in the regulations governing the wearing of the Blue Ensign by British merchant ships and fishing vessels has been slightly relaxed. Time-expired Royal Naval Reserve ratings who have completed twenty years' service in the Royal Naval Reserve (mobilized time counting double) may in future be reckoned in the number of reservists required to qualify.

No alteration has been made to the minimum number of reservists required in the crew to qualify for an Admiralty warrant authorizing the wearing of the Blue Ensign.

Biological Product Exempted from the Provisions of the Stock Remedies (Biological Products) Regulations 1951 (Notice No. Ag. 5509)

PURSUANT to subclause (14) of regulation 40 of the Stock Remedies (Biological Products) Regulations 1951, notice is hereby given that the Stock Remedies Registration Board has resolved that the provisions of the said regulation shall not apply to the biological product known as ‘‘Aurofac’’.

Price Order No. 1493 (New Zealand Lemons Other Than Meyer Lemons)

PURSUANT to the Control of Prices Act 1947, the Price Tribunal acting with the authority of the Minister of Industries and Commerce, hereby makes the following Price Order:

  1. This Order may be cited as Price Order No. 1493, and shall come into force on the 9th day of October 1953.

  2. (1) Price Order No. 1480* is hereby revoked.

(2) The revocation of the said Price Order shall not affect the liability of any person for any offence in relation thereto committed before the coming into force of this Order.

APPLICATION OF THIS ORDER

  1. (1) This Order applies with respect to all New Zealand grown lemons (other than Meyer lemons) sold by way of retail.

(2) The provisions of this Order as to maximum retail prices shall apply notwithstanding that any such lemons are sold otherwise than by weight.

MAXIMUM RETAIL PRICES

  1. (1) Subject to the provisions of this clause, the maximum retail price that may be charged or received by any retailer for any lemons to which this Order applies shall be computed as follows:

(a) For lemons sold at any place in the North Island, north of a straight line drawn from Tirua Point on the West Coast to Young Nick’s Head on the East Coast: At the rate of 6d. per pound.

(b) For lemons sold elsewhere in the North Island: At the rate of 7d. per pound.

(c) For lemons sold in the South Island: At the rate of 8d. per pound.

(2) If in respect of any lot of lemons sold by a retailer the maximum price calculated in accordance with the foregoing provisions of this clause is not an exact number of pence or half-pence, the maximum price of the lot shall be computed to the next upward halfpenny.

(3) Notwithstanding anything to the contrary in the foregoing provisions of this Order, and subject to such conditions, if any, as it thinks fit, the Tribunal, on application by any retailer, may authorize special maximum prices in respect of any lemons to which this Order applies where special circumstances exist or for any reason extraordinary charges (freight or otherwise) are incurred by the retailer. Any authority given by the Tribunal under this subclause may apply with respect to a specified lot or consignment of lemons or may relate generally to all lemons to which this Order applies sold by the retailer while the approval remains in force.

DUTY IMPOSED ON RETAILERS

  1. Every retailer who offers or exposes any such lemons for sale in any shop shall keep in a prominent position in such proximity to the lemons to which it relates as to be obviously descriptive thereof a ticket, placard, or label on which shall be stated in legible and prominent characters the retail price per pound of the lemons.
