At the Government House at Wellington, this 30th day of
September 1953
Present:
HIS EXCELLENCY THE GOVERNOR-GENERAL IN COUNCIL
P URSUANT to section 9 of the Public Works Amendment
Act 1948, His Excellency the Governor-General, acting by
and with the advice and consent of the Executive Council, hereby
directs that the width of those portions of the proposed service
lane described in the Schedule hereto shall be for parts of their
lengths, less than 12 ft. but not less than 10 ft.
SCHEDULE
THOSE portions of a proposed service lane in the City of Lower
Hutt, together containing by admeasurement 15.61 perches, being
parts Lot 9, D.P. 12645, and being part of Sections 24 and 28, Hutt
District.
As the same are more particularly delineated on the plan
marked P.W.D. 141264, deposited in the office of the Minister of
Works at Wellington, and thereon coloured blue.

HIS EXCELLENCY THE GOVERNOR-GENERAL IN COUNCIL
P URSUANT to section 149 of the Public Works Act 1928,
His Excellency the Governor-General, acting by and with
the advice and consent of the Executive Council, hereby
consents to the Franklin County Council stopping the portion
of road described in the Schedule hereto.
SCHEDULE
APPROXIMATE area of the piece of road permitted to be
stopped: 1 acre and 26.7 perches.
Adjoining part Lot 4, D.P. 25115, being part Wharekawa
No. 2 Block, and part Lot 3, D.P. 27512, being part
Allotment 163, Koheroa Parish.
Situated in Block XVI, Opaheke Survey District (Auckland R.D.). (S.O. 37585.)
In the North Auckland Land District; as the same is
more particularly delineated on the plan marked P.W.D.
141262, deposited in the office of the Minister of Works at

Akaroa Harbour—Barry’s Bay Co-operative Dairy Factory

HIS EXCELLENCY THE GOVERNOR-GENERAL IN COUNCIL
P URSUANT to the Harbours Act 1950, His Excellency the
Governor-General, acting by and with the advice and
consent of the Executive Council, hereby licenses and permits
Barry’s Bay Co-operative Dairy Factory Company, Limited
(hereinafter called the company, which term shall include
its successors or assigns, unless the context requires a different
construction) to use and occupy a part of the foreshore and
land below low-water mark at Barry’s Bay, Akaroa Harbour,
as shown on plan marked M.D. 9584 and deposited in the
office of the Marine Department at Wellington, for the
purpose of the use of a whey tank and pipe-line thereon as
shown on the said plan, such licence to be held and enjoyed
by the company upon and subject to the terms and conditions
set forth in the Schedule hereto.
SCHEDULE
CONDITIONS
(1) This licence is subject to the Foreshore Licence
Regulations 1940 and the provisions of those regulations
so far as applicable, apply hereto.
(2) The annual sum payable by the company shall be five
pounds and the annual sum so payable three pounds.
The term of the licence shall be fourteen years from
the 23rd day of September 1953.

Wharf—and Prescribing Dues for the Use of Same

HIS EXCELLENCY THE GOVERNOR-GENERAL IN COUNCIL
P URSUANT to the Harbours Act 1950, His Excellency
the Governor-General, acting by and with the advice and
consent of the Executive Council, hereby licenses and permits
David Charles Barrett, William Charles Barrett, and Ross
Walton McWhannell, as trustees for the inhabitants of the
district (hereinafter called the trustees, which term shall
include their administrators, executors, or assigns, unless the
context requires a different construction), to use and occupy
a part of the foreshore at Takamatua in Akaroa Harbour,
as shown on plan marked M.D. 3541 and deposited in the
office of the Marine Department at Wellington, for the
purpose of maintaining a wharf thereon as shown on the
said plan, such licence to be held and enjoyed by the
trustees upon and subject to the terms and conditions set
forth in the First Schedule hereto, and doth prescribe that
the dues and rates set forth in the Second Schedule hereto
shall be charged and taken by the trustees for the use of
the said wharf.
FIRST SCHEDULE
CONDITIONS
(1) This licence is subject to the Foreshore Licence
Regulations 1940, and the provisions of those regulations
shall, so far as applicable, apply hereto.
(2) The annual sum payable to the Minister by the
Trustees shall be one shilling payable on demand.
(3) The term of the licence shall be fourteen years
from the 20th day of September 1953.
(4) The Master of every vessel discharging ballast at
the said wharf shall have all such ballast taken away and
deposited above high water mark or at such place as may
be approved of by the Minister or by any person appointed
by the Minister for that purpose.

RESHIPMENTS
When any goods which have already paid wharfage dues
at Akaroa are reshipped, no charge whatever shall be made
for outward wharfage: Provided that when such goods are
reshipped a declaration shall be forwarded with the waybill
that such goods have paid wharfage, and stating the date
when, and by whom, and in what ship such goods were
imported.
STORAGE
Rent on all goods stored, at per ton, per week or s. d.
part of a week, weight or measurement
Minimum charge
Wool or sheep-skins, per bale, for a week or part of
a week
Free storage allowed for twenty-four hours. All
goods stored to be at risk of consignee.
BERTHAGE
On every steamer or sailing vessel under 100 tons s. d.
register hauling alongside the wharf, per ton

On every steamer or sailing vessel of and over 100
tons register, for the first 100 tons register, per
ton, per day or part of a day
On every steamer or sailing vessel of and over 100
