Vesting in the Poverty Bay Catchment Board Control of Watercourses in the Poverty Bay Catchment District Excluding Those in the Borough of Gisborne, and Revoking Previous Order in Council

At the Government House at Wellington, this 16th day of September 1953

Present:

HIS EXCELLENCY THE GOVERNOR-GENERAL IN COUNCIL

PURSUANT to section 130 of the Soil Conservation and Rivers Control Act 1941, His Excellency the Governor-General, acting by and with the advice and consent of the Executive Council, hereby revokes the Order in Council dated the 20th day of March 1946 and published in the New Zealand Gazette No. 16 of the 21st day of the same month at page 350, vesting in the Poverty Bay Catchment Board control of watercourses in the Poverty Bay Catchment District as varied by an Order in Council dated the 6th day of December 1949 and published in the New Zealand Gazette No. 74 of the 8th day of the same month at page 2786, and hereby directs as follows, viz:

That all watercourses within the Poverty Bay Catchment District, excluding therefrom the Borough of Gisborne (New Zealand Gazette 1941, page 2726), whether natural or constructed or hereafter to be constructed, together with all machinery and appliances used therewith, but excepting therefrom all water supply races and stock races which at the date of this Order are under the control of any local authority and any watercourse situated upon and used wholly or in part for the drainage of any road reserve or highway, shall be under the exclusive care, control and management of the Poverty Bay Catchment Board on and after the date hereof.
