Authorizing the Exchange of a Reserve in East Taieri Survey District, Otago Land District, for Other Land

At the Government House at Wellington, this 28th day of January 1953
Present:

HIS EXCELLENCY THE GOVERNOR-GENERAL IN COUNCIL

WHEREAS the land described in the First Schedule hereto is a reserve duly set apart for public utility :
And whereas it is expedient that the said land should be exchanged for the land described in the Second Schedule hereto, which the Governor-General deems of equal value and more suitable for the purpose of the reserve :
Now, therefore, pursuant to section 8 of the Public Reserves, Domains, and National Parks Act 1928, His Excellency the Governor-General, acting by and with the advice and consent of the Executive Council, hereby declares that the land described in the First Schedule hereto may be exchanged for the land described in the Second Schedule hereto.

FIRST SCHEDULE
DESCRIPTION OF RESERVE AUTHORIZED TO BE EXCHANGED
Otago Land District

ALL that area containing by admeasurement 1 rood 29·3 perches, more or less, being Lot 16 as shown on a plan deposited in the Land Registry Office at Dunedin under No. 6226, being part Section 27, Irregular Block, East Taieri Survey District, and being all the land comprised and described in certificate of title, Volume 331, folio 70 (Otago Registry), together with drainage rights granted by Transfer No. 167923 and subject to drainage rights granted by Transfer No. 167923.

SECOND SCHEDULE
DESCRIPTION OF LAND TO BE OBTAINED IN EXCHANGE THEREFOR
Otago Land District

ALL that area containing by admeasurement 1 rood 29·3 perches, more or less, being Lot 15 as shown on a plan deposited in the Land Registry Office at Dunedin under No. 6226, being part Section 27, Irregular Block, East Taieri Survey District, and being all the land comprised and described in certificate of title, Volume 352, folio 244 (Otago Registry), together with drainage rights granted by Transfer No. 167923 and reserved by Transfers Nos. 172142 and 173267, and subject to drainage rights granted by Transfers Nos. 168823, 170351, and 172142, and subject to agreement as to fencing contained in Transfer No. 174475.

PURSUANT to section 44 of the Public Reserves, Domains, and National Parks Act 1928, His Excellency the Governor-General, acting by and with the advice and consent of the Executive Council, hereby appoints

Moncrieff William Begg,
James Dempsey,
Neal Dempsey,
Melville Harold Dobbs,
Horace Bertie Rusling,
Ivan Lewis Bertram Rusling,
Roy Woolford Simpkin,
Stanley Harry George Wilson, and
Robert William Youle

to be the Retaruke Domain Board, having control of the land described in the Schedule hereto ; and hereby appoints Friday, the 30th day of January 1953, at 8 o’clock p.m., as the time when, and the Retaruke Hall, as the place where, the first meeting of the Board shall be held.

WELLINGTON LAND DISTRICT—RETARUKE DOMAIN
Section 14 and part Section 9, Block XII, Retaruke Survey District : Area, 10 acres 1 rood 38·5 perches, more or less. Vesting the Control of a Reserve in the Whangarei Borough Council

HIS EXCELLENCY THE GOVERNOR-GENERAL IN COUNCIL

WHEREAS the land described in the Schedule hereto has been duly set apart as a reserve for recreation purposes :
And whereas it is expedient that the control of the said reserve should be vested in the Whangarei Borough Council :
Now, therefore, pursuant to section 17 of the Public Reserves, Domains, and National Parks Act 1928, His Excellency the Governor-General, acting by and with the advice and consent of the Executive Council, hereby vests the control of the said reserve in the Whangarei Borough Council.

SCHEDULE
NORTH AUCKLAND LAND DISTRICT

ALL that area situated in Block XII, Purua Survey District, containing by admeasurement 1 acre and 24·1 perches, more or less, being Lot 46 as shown on a plan deposited in the Land Registry Office at Auckland under No. 38056, being part Allotment 2, Parish of Whangarei. Subject to the reservations and conditions imposed by section 59 of the Land Act 1948. (S.O. plan 36539.)

Vesting the Control of a Reserve in the Boy Scouts’ Association (New Zealand Branch), Incorporated

WHEREAS the land described in the Schedule hereto has been duly set apart as a site for a Boy Scouts’ Hall :
And whereas it is expedient that the control of the said reserve should be vested in the Boy Scouts’ Association (New Zealand Branch), Incorporated :
Now, therefore, pursuant to section 17 of the Public Reserves, Domains, and National Parks Act 1928, His Excellency the Governor-General, acting by and with the advice and consent of the Executive Council, hereby vests the control of the said reserve in the Boy Scouts’ Association (New Zealand Branch), Incorporated.

SOUTHLAND LAND DISTRICT

Section 93s, Waikiwi Town Settlement : Area, 39·7 perches, more or less. Subject to the reservations and conditions imposed by section 59 of the Land Act 1948. (S.O. plan 4617.)

Recreation Reserve in Wellington Land District Brought Under Part II of the Public Reserves, Domains, and National Parks Act 1928

HIS EXCELLENCY THE GOVERNOR-GENERAL IN COUNCIL

PURSUANT to section 34 of the Public Reserves, Domains, and National Parks Act 1928, His Excellency the Governor-General, acting by and with the advice and consent of the Executive Council, hereby orders and declares that the reserve for recreation in the Wellington Land District described in the Schedule hereto shall be and the same is hereby brought under the operation of and declared to be subject to the provisions of Part II of the said Act, and such reserve shall hereafter form part of the Torere Domain, and be managed, administered, and dealt with as a public domain by the Torere Domain Board.

SCHEDULE
WELLINGTON LAND DISTRICT

Section 42, Torere Village, situated in Block III, Hautapu Survey District : Area, 4 acres and 17 perches, more or less. Subject to the reservations and conditions imposed by section 59 of the Land Act 1948. (S.O. plan 13993.)
