A PROCLAMATION

PURSUANT to section 35 of the Public Works Act 1928, I,
Sir Humphrey Francis O’Leary, the Administrator of the
Government of New Zealand, hereby declare the land described
in the Schedule hereto to be Crown land subject to the Land Act
1948.

SCHEDULE

APPROXIMATE areas of the pieces of land declared to be Crown land :—
A. R. P. Being Coloured on Plan

deposited in the office of the Minister of Works at Wellington, and
thereon coloured as above mentioned.

A PROCLAMATION

PURSUANT to section 25 of the Public Works Act 1928, I, Sir
Humphrey Francis O’Leary, the Administrator of the
Government of New Zealand, hereby proclaim and declare that the
Crown land described in the Schedule hereto is hereby set apart
for road ; and I also declare that this Proclamation shall take
effect on and after the 8th day of December 1952.

Vesting the Management of the Wharf and Shed at the Grove, Queen
Charlotte Sound, in the Marlborough County Council, and Pre-
scribing Dues for the Use of Same

ORDER IN COUNCIL

At the Government House at Wellington, this 26th day of
November 1952

Present :

HIS EXCELLENCY THE ADMINISTRATOR OF THE GOVERNMENT IN
COUNCIL

PURSUANT to the Harbours Act 1950, His Excellency the
Administrator of the Government, acting by and with the
advice and consent of the Executive Council, hereby vests in the
Marlborough County Council (hereinafter called the Council, which
term shall include its successors and assigns unless the context
requires a different construction), the management of the wharf and
shed at the Grove, Queen Charlotte Sound, such vesting to be
subject to the terms and conditions set forth in the First Schedule
hereto, and prescribes that the dues and rates set forth in the Second
Schedule hereto shall be charged and taken by the Council for the
use of the said wharf and shed.

FIRST SCHEDULE

CONDITIONS

  1. The vesting of the said wharf and shed is subject to the
    Foreshore Licence Regulations 1940, and the provisions of those
    regulations shall, so far as applicable, apply hereto.

  2. The term of the vesting shall be fourteen years from the
    17th day of November 1952.

  3. The annual sum payable by the Council to the Minister shall
    be 1s. payable on demand.

  4. The master of every vessel discharging ballast at the said
    wharf shall have all such ballast taken away and deposited above
    high-water mark, or at such place as may be approved by the Minister
    or by any person appointed by the Minister for that purpose.

  5. The Council shall at all times exhibit therefrom and maintain
    at the Council’s own cost suitable and necessary lights for the
    guidance of vessels: Provided that no light shall be exhibited
    until after it has been approved by the Minister.

SECOND SCHEDULE

INTERPRETATION AND DUES

  1. The following terms used in this Order in Council shall have
    the meanings in this clause given to them except where they are
    inconsistent with the context, viz :—

“Goods” shall mean all wares, merchandise, and commodities
of every description, and all chattels, live-stock, and other
articles :

“Master” shall mean any person for the time being in charge
of any vessel :

“Vessel” shall mean every description of vessel and shall
include launches and boats.

BERTHAGE

  1. Every person who shall berth his vessel at or alongside
    the said wharf shall pay the sum of 2s. 6d. per trip, or a fixed
    charge of £1 1s. per annum, computed from the 1st day of April
    in each year.

STORAGE

  1. For first forty-eight hours .. .. .. Free
    For each day or part of a day thereafter— s. d.

  2. The master of each vessel shall furnish the Council with a
    certified statement of all goods landed on or shipped from the
    wharf, and the master shall be responsible to the Council for
    payment of all dues, wharfage, and storage charges.
