Revoking the Reservation Over Part of a Reserve in Motupiko Survey District, Nelson Land District

ORDER IN COUNCIL

At the Government House at Wellington, this 24th day of September 1952

Present:

HIS EXCELLENCY THE ADMINISTRATOR OF THE GOVERNMENT IN COUNCIL

PURSUANT to subsection (1) (b) of section 7 of the Public Reserves, Domains, and National Parks Act 1928, His Excellency the Administrator of the Government, acting by and with the advice and consent of the Executive Council, hereby revokes the reservation for a reserve for the accommodation of travelling cattle over the land described in the Schedule hereto; and hereby declares that the said land, being vested in the Crown, is Crown land available for disposal under the Land Act 1948.

NELSON LAND DISTRICT

ALL that area situated in Block X, Motupiko Survey District, containing by admeasurement 91 acres 1 rood 25 perches, more or less, being parts of Section 5, Square 34. As the same is more particularly delineated on the plan marked L. and S. 9/1933A, deposited in the Head Office, Department of Lands and Survey, at Wellington, and thereon edged red. PURSUANT to subsection (1) (b) of section 7 of the Public Reserves, Domains, and National Parks Act 1928, His Excellency the Administrator of the Government, acting by and with the advice and consent of the Executive Council, hereby revokes the reservation for Rabbit Board buildings over the land described in the Schedule hereto; and hereby declares that the said land, being vested in the Crown, is Crown land available for disposal under the Land Act 1948.

Recreation Reserve in North Auckland Land District Brought Under Part II of the Public Reserves, Domains, and National Parks Act 1928

Present:

HIS EXCELLENCY THE ADMINISTRATOR OF THE GOVERNMENT IN COUNCIL

PURSUANT to section 34 of the Public Reserves, Domains, and National Parks Act 1928, His Excellency the Administrator of the Government, acting by and with the advice and consent of the Executive Council, hereby orders and declares that the reserve for recreation in the North Auckland Land District described in the Schedule hereto shall be and the same is hereby brought under the operation of and declared to be subject to the provisions of Part II of the said Act; and such reserve shall hereafter be known as the Hatfield Bay Domain, and be managed, administered, and dealt with as a public domain.

Restricting the Grant and Disposal of Mining Privileges in the Otago Mining District

HIS EXCELLENCY THE ADMINISTRATOR OF THE GOVERNMENT IN COUNCIL

IN pursuance and exercise of the powers and authorities vested in him by section 34 of the Statutes Amendment Act 1940, His Excellency the Administrator of the Government, acting by and with the advice and consent of the Executive Council, hereby revokes the Orders in Council referred to in the Schedule hereto and hereby declares that from and after the date hereof no mining privilege shall be granted or transferred in respect of any lands in the Otago Mining District without the previous written consent of the Minister of Mines.

Authorizing the Borrowing by the Wellington City Council by Way of Hypothecation of Debentures Issued in Respect of a Loan of £265,700

Present:

HIS EXCELLENCY THE ADMINISTRATOR OF THE GOVERNMENT IN COUNCIL

WHEREAS by Order in Council made on the 19th day of September 1951 (hereinafter called the said Order in Council), and subject to the determinations as to borrowing and repayment therein set out, consent was given to the raising in New Zealand by the Wellington City Council (hereinafter called the said local authority) of a loan of two hundred and sixty-five thousand seven hundred pounds (£265,700) to be known as “Wellington City Water-supply Loan 1920, Renewal Loan 1952” (hereinafter called the said loan):

And whereas the said local authority, pending the raising of portion of the said loan amounting to two hundred and sixty-five thousand six hundred pounds (£265,600) in accordance with the said determinations, is desirous of borrowing the sum of two hundred and thirty-nine thousand and forty pounds (£239,040) (hereinafter called the said sum), being portion of the said amount of two hundred and sixty-five thousand six hundred pounds (£265,600), by hypothecation or mortgage pursuant to section 34 of the Local Bodies’ Loans Act 1926 of the debentures authorized to be issued in respect of the said sum:

Now, therefore, pursuant to section 7 of the Local Authorities Interest Reduction and Loans Conversion Act 1932–33 and section 8 of the Local Authorities Interest Reduction and Loans Conversion Amendment Act 1933, His Excellency the Administrator of the Government, acting by and with the advice and consent of the Executive Council, hereby consents to the said local authority borrowing the said sum or any part thereof by the hypothecation or mortgage of the said debentures to the State Advances Corporation of New Zealand at a rate of interest not exceeding three pounds five shillings (£3 5s.) per centum per annum, such interest to be computed on the daily-debtor balances in the accounts of the Corporation, repayable on demand but so that the term shall not exceed one year, and hereby prescribes that the money borrowed by the hypothecation or mortgage of the said debentures shall, pending the raising of the said sum, be repaid by annual or half-yearly instalments equivalent to the instalments of principal which would have been repaid if on the first day on which any moneys are borrowed by such hypothecation or mortgage the whole of the said sum of two hundred and thirty-nine thousand and forty pounds (£239,040) had been raised on the terms prescribed by the said Order in Council.
